Child Neglect

Child neglect is defined as any recent act, or failure to act, that results in the death of a child, or in an endangerment of a child, or the creation of an imminent risk of the death or serious physical or emotional harm, or sexual abuse of a child. The term "neglect" is defined in both Federal and State legislation, and can vary to some degree from state to state. The Federal Child Abuse Prevention and Treatment Act (CAPTA) provides a definitional foundation for States by identifying a minimum set of acts or behaviors that characterize neglect or maltreatment of a child.

Question: Child Neglect? My x-wife just moved 16 hours away from me with my 2 sons who are 8 & 10. My son calls me the other day and tell me that his mom leave's him and his brother at the house by them selves from 1pm till 6pm everyday after school and he hates it....can this be any form of child neglect? And is there something I can do? Also they have been missing school latley they say so could that also be child neglect? Signed Lost Father

Answer: Children that young should never be left alone. I always ask what are the circumstances. Are you paying child support? Is the mom leaving them because she has to work? The ultimate concern should be for the children. If she's leaving them alone because you're not supporting them; then you are the culprit. If that's not the case then call the authorities and get a lawyer.
