I've recently filed, he didn't show up to court, so they ruled anyway because paternity had been established and he made no effort to cooperate with financial info. I have sole legal and physical custody, with an order for child support. He's never seen her (his choice) and she's 16 mos, I would let him. Is this something he did, or just what automatically happens?

I'm sorry, What I'm trying to add is that NY will only allow for certain cases to get a paternity test and nobody will do one without a court order, we tried. So, can I make the state allow me to have one?
Answer: In the state of NY, you can get a paternity test with a doctor's prescription too. That is something to consider.
FYI-- not all labs are certified to perform testing for the state of NY. Be sure to look for one that is NYSDOH certified. DDC is certified, so you can look on www.dnacenter.com for more information on how to begin the testing process.

Question: What options do you have for lawyers if you cant afford one, and you cannot get a public defender/? I was served a summons for child support, filiation, and child custody, i was willing to pay and do it all but the mother of my "child" (we still haven't determined that) is making this twice as difficult and she's doing it all through a lawyer which i cannot afford and i cannot get a public defender because it doesn't involve jail time. Lawyers in town were all $2000 retainers fee and $200 an hour. I'm an average joe i don't make that much money or even have that much sitting around. I only have twenty days to contest it and have tried every option. Does anyone have a clue what i can do? This girl is trying to make my life hell she wrote in the summons i only get supervised visitation which she has no valid reason for i don't drink i can pass any drug test shes just trying to make my life hell because i've moved on. That i'm responsible for all medical, that she doesnt have a means of income, that i make way over what i do, and that if i contest to it i'm responsible for her lawyers fees and court costs. She's trying to make me look bad and i'm out of ideas or ways to go about things. i'm not a dead beat dad, i've tried to be there the mother didnt even call me to tell me the baby was born i called to check up on things and then she told me she had had her. she changed the due dates a million times. She's threatened me telling me if i dont do this i wont ever get to see the baby, that i'll just be paying her the rest of my life, and shes a nasty girl, i'll openly admit it was a mistake from hell but my "daughter" shouldnt have to pay for that. ideas? anyone? Answer: Just a quick reponse to the answer above concerning dna tests. You need a COURT ordered, doctor administered dna test. A home test is worthless in court.

Shortly after breaking up she started to date a guy over the internet that lives in Az. He has flown out here once, and paid her to fly out there once, so they have meet in person. Since moving out my ex has more or less stopped seeing her daughter and rarely calls to talk to her.
She has made my daughter many promises to come see her and has broken them all. We got into a fight once because friend (not her boyfriend a different friend) was flying into town and she wanted to keep our daughter out of school to visit with the friend. I said no, that she needs to go to school that she shouldn't stay home just because one of her mom's friends was in town. In the end the mom won and got to take our child and she did not go to school. My ex was saying I'll never see my daughter again, but two days later I got her back. That was Oct 14th (or in the basic area) my daughter has not seen or heard from her mom since that day.
Now my ex just came back from Az last night, now she wants to move out there and take our daughter. I tried to file for custody for her, but the courts say because the mom and I were never married, that I have no rights to my daughter. That I even with me on the birth certificate, I need to file for a "filiation." Problem is, I'm worried once my ex finds out I need to do that, and that I have no rights over my daughter she will just take her and run.
I can't afford an attorney, and I really don't want her mom that more or less abandoned her to be able to take her and run across country with her.
Has anyone else gone through this before? If so what did you do? I almost feel like I should sue over sex discrimination since her mom has preference based solely on her gender.
Answer: Since she has been living with you and goes to school in your district, it will lean slightly in your favor.You need to document her mothers inconsistency and flakiness. Literally write it all down in a notebook with times and dates.That will count against her in court. I would suggest getting a lawyer. You can get one for this type of case for $500-$1000. Good luck.

Answer: Unfortunatly you are going through what most men in the US with kids are going through (An evil mother) who cares nothing for the babies father.

You can try, and I would keep trying but the man never wins in court even if the mother is not a good mother.
It is why some men kill their ex-wives. Something I would advise you to never do and don't let it get you that angry.
