Finalization Hearing
A court hearing where in most states an adoption becomes final. Usually, the adoptive parents and the child to be adopted go to court with the adoption caseworker, and their lawyer if it is an independent adoption, and provide testimony to the court regarding the appropriateness of the adoption. If the judicial officer is satisfied that all legal requirements have been met, and that the adoption would be in the best interests of the child, the Decree of Adoption will be signed, finalizing the adoption, and the Certificate of Adoption will be signed and transmitted to the Department of Vital Records, so that the child's new birth certificate can be created and properly issued.
Question: I am preparing to represent myself in court for the finalization of my divorce, Any advice on preparation? Preparing for a hearing seems overwhelming, does anyone have any advice from their own experiences.
Answer: If you're going without an attorney, consider consulting with a custody/divorce coach. It's not really all that expensive and you can share your experiences with others in your same spot.
It can be really intimidating, particularly if you're going up against someone who has an attorney. Get really familiar with your state's divorce and custody laws so you can articulate yourself as best you can.
Question: Do banks ask for downpayment upfront prior to finalization of loan? We are trying to buy an RV and the dealer told us he wants ALL of our downpayment upfront so the bank can see where the money is coming from. I have never heard of this before- usually it is a check of good faith and not the entire amount. Anyone ever heard of this?
Answer: The dealer keeps the down payment, the lender gives them the rest of the money if you are approved.
If not, they have your money and will try anything to keep from giving it back to you.
But, if they cant get you financed, they cant keep your money.
Question: 2 questions. my final hearing for my divorce is this wk. once at court will i get a document saying its over? right after I leave the court house or do they not give you a legal paper claiming the finalization? secondly, afraid my ex is going to pull **** there. can it still be finalized and if she pulls stuff then would we still have to keep going back to court? but wanna know that it will be over right then and there.
Answer: Sorry, but it will take the court some time to prepare a final decree. A couple weeks. It is possible that the final hearing could be delayed by somone pulling something. if she just fails to appear, and no lawyer appears for her, you can probably still finish it up.
Question: Should I continue without the contract or call it halt until it's finalized? Recently, I was asked to join in forming a new film company as a "Member." I've even received a copy of the finalized contract about a month after the details were all worded out. However, I've been working on the new film as an actor of the company- without hearing anything about getting to the signing of the contract- for about three months now......nothing has been finalized and no more mention of the contract finalization has been heard about since.
Answer: I'd move on to another project. I've been in a similar situation where I made it clear to the person making the video that I wanted to have a signed contract so we were clear on where the both of us stood. Having been in positions where you are simply taking the other person's word for it, and nothing happening, I kept harping on a signed contract because I knew what would happen if we didn't have one.
Months went by, with me doing my work, getting no money for it, and continually reminding them about the contract. In the end, I decided to stop working with them (I had just lost my day job and couldn't afford to waste my own money/time on the project anymore). They stiffed me for some of the money, but paid some (hence my wanting the contract in the first place, I wanted to make sure the money side of things was clearly stated for both of us so nobody got screwed).
The fact is, if these people are legit and passionate about having you involved, they would get off their butts and make a contract. There are plenty of boilerplate ones to be found, even for the arts, so it shouldn't be harder than spending 30 minutes writing one up. If they can't be bothered to do it, then they're not taking you or their own work seriously.
EDIT: On rereading - have you actually signed it yourself? If you have a copy, there's nothing to stop you from signing it, then literally handing it to them and asking them to sign it in your presence. (Make sure they get a copy too)

Answer: There is nothing wrong with Islam really. However you may want to rethink your thoughts on the Koran. Keep in mind that the only way to read the Koran or the Torah or the Bible is to interpret it. Rabbis spent thousands of years interpreting stuff in the Torah. Same with the Koran. Some peace loving Muslims interpret it as a Holy book that promotes society and peace. Unfortunately, the only Muslims you hear about are the ones that interpret it as "everyone who isn't Muslim must die".

Question: How will a company I received a job offer for test me for drugs and a physical? I just received a job offer from a out of state company. They went through the benefits and others and they said I needed to pass a drug test and a physical. I haven't heard from them since. How will they test m on this? What is a usual step in getting a job? It is a big company and seems like there are a lot of steps before the the finalization.

Question: Divorce finalization? I'm going into court tomorrow morning to get my uncontested divorce finalized. Has any one been through this process? they called it a prove up or something like that.
How long does this process take and what is involved in the hearing? we have no kids and no property to divide, I'm still very nervious about going in front of the judge. Can anyone give me some tips or reassurance?
My husband is across the country and had been served with papers and has not responded. I am doing this with a lawyer, but I'm terrified about being in front of the judge.
Answer: A "prove up" hearing is essentially an uncontested or default hearing wherein the court will swear you in and ask you questions reqarding your assets and debts. You will answer these questions under oath and essentially tell the court there are no assets and debts to divide.
The court will then do whats called a "jurisdictional", which means the judge will ask you questions related to whether or not you met the jurisdicitonal requirements to file for divorce in your venue... like how long have you lived in the state, the county, etc. The court will then enter a judgment of dissolution.
This does not mean you are divorced. You will then have to prepared a Judgment for the court to sign. You should contact a paralegal in your area to help you with it. You then submit the Judgment to the court clerk and check back in a couple of weeks to see if the Judge signed it. Once the Judge signs it your case is over.
Don't sweat this hearing. Its easy. The court will be patient with you because you are not an attorney and the matter is uncontested.

Question: Anxiety...feeling overwhelmed...what do you think? I have had anxiety for the past 4 years and have managed it very well. I had been taking lexapro (20 mg) for the past three years and the past three or four months I started going back down to 10 mg. Recently we just found we are moving again (third time in two years) we have just been having some problems with the guy we are renting from and for some reason though I feel so guilty about moving. We aren't in any contract or anything at all, I just feel guilty, like we are leaving him hanging. I also am feeling overwhelmed with the whole moving part too, packing and un packing and being a new place....it seems that change like this seems to make the anxiety come out a little more. I started taking 20 mg of the lexapro again since it seems I've had the added stress. The other thing is that I had been so busy the past few months that I wasn't taking my medicine every day either sometimes I would end up skipping a couple of days...do yout hink that has an effect too? I have been doing much better trying to get back on track taking it every day again. We also have an adoption finalization hearing coming up in 9 days, but the date has already been changed four times before so I just am soooo worried it is going to change again, I just want this over with. I guess bottom line....is it normal for me to feel overwhelemd right now and just have the added feeling of anxiety? Am I just overreacting to everything??

Answer: You should do your best to take your Lexapro everyday around the same time to keep it level in your system. If something isn't broke, why fix it? (Why would you cut down on your medication?) I have learned the hard way to not feel guilty or weak by having to take medicine, I ended up being very bad off because I quit taking mine once and it took me a long time to recover. Just because you are on medication doesn't mean you won't have rough days, but they will pass and don't dwell on them. God Bless!

Question: I need to know, please read details on important medical question.? I have a relative with serious health issue.
he is in final stages of liver failure and the Dr. has stated there is nothing more they can do for him. he has about 17 out of the 20 or so symptoms. Doctor has set up home care to make him comfortable stating he'll have good days and bad. my big question is, can anyone say how long he has to live, we can't ask the Dr. because my relative is always present and don't want him to hear any finalization talk going on.. thank you for any info, we have to know.
He is 68 and has other issues so he is not a transplant candidate.
Answer: We've recently gone through a similar situation. My aunt was 50 years old with breast cancer. The doctors had told us on four occasions that she would only last for a couple of weeks (one time they had told us a few hours) but she survived for many months afterwards. She finally was sent to a health care facility and past away last week. To answer your question, there is no definite answer a doctor can tell you. They can only estimate and sometimes the estimation is off. Each individual is different and people's resistance to illnesses is different. I'm sorry you and your family is going through this tough time.

Question: How long does a no fault divorce take in NY? My bf says it's filed but it's been almost 2.5 or 3 years now. Just scared. :( Boyfriend is very good friends with his "wife"/ ex, and they email/chat regularly. I don't hate her, but I can say that I hate hearing about her. lol. :( We live on west coast and she lives in NY. I can just imagine that they have cute convos and they get exited to see messages from each other. Question: Revision of Motion? WA family law question? On May 4, 2010, we had a hearing for Modification of Support and motion for back support and atty fees (her motion) and a Motion for Reimbursement of overpaid daycare (our motion).
Support was revised as incomes had changed and 2 years had past.
Our Motion for reimbursement was granted in the amount of $947
Her motion for atty fees and back support was denied.
On May 14 they filed a Motion to Revise Commissioner's Ruling and Notice to Appear (6/10/10).
They are citing RCW 2.24.050 and LR 0.7.(Spokane County Superior Court, WA) Their grounds for this motion are that mom feels like shes being punished because the judge retro'd the daycare but refused the back support. And that their discovery findings were ignored. And states that no child support worksheets were filed with the last amendment of the previous order so they were for all intent and purposes potentially invalid pursuant to the statue. Which is 1/2 right and 1/2 wrong. the last hearing was a contempt motion, which revised the temp child support order in place, adding the daycare to the transfer payment. although, no child support worksheets were filed at that hearing, but they were filed 2 months prior when that same order was amended due to a tax exemption discrepancy. the prior order has been a temp child support order since feb 2008, we began modification and finalization of this order in march 2010 as mother refused every attempt we made to finalize this order.
So....my question is What exactly do I file in response to this?
Do I file a Motion to Deny? Just a declaration? I cant find any local court instructions, rules or forms that tell me what it is I file in response?
I know I am running out of time to file a response so any help would be appreciated. We are pro-se going against a very shady lawyer who knows all the loop holes and knows how to manipulate and take advantage of pro-se people.
Answer: 1. Judges always look more kindly on pro se litigants, so don't feel as though you are at a complete disadvantage.
2. Motions for Revision are seldom granted. Essentially the ex is asking a superior court judge to make a finding (a very public finding) that the commissioner blew it. This doesn't happen unless it is crystal clear that there was no reasonable basis for the commissioner to make the decision that was made.
3. The statute is VERY clear that when the overpayment of daycare expenses exceed 20% of the annual obligation, the court is REQUIRED to order reimbursement. There is no discretion permitted. Ordering back support is discretionary.
4. I would recommend that you draft a Memorandum in Opposition to Petitioner's Motion for Revision.
RCW 2.24.050 just states that a litigant has the right to have a commissioner's ordered reviewed by a Superior Court judge. The ONLY information that the judge can consider is the information that was before the commissioner. The judge cannot consider anything that wasn't before the commissioner.
In the Memo, you can break your argument down by sections:
I. Relief Requested
Respondent asks the Court to deny the Petitioner's Motion for the Revision of the ordered entered on May __, 2010.
II. Support for Requested Relief
The files and records herein.
III. Facts
Provide a VERY brief description of the evidence and arguments presented to the commissioner.
IV. Argument
This will be the most difficult part for a lay person, because this is where you would insert your legal argument. I'm including a snippet from a motion that I recently filed regarding overpayment of daycare in Washington.
An obligor parent is entitled to reimbursement for certain expenses not actually incurred by the obligee parent. RCW 26.19.080(3), Fairchild v. Davis, 148 Wash.App. 828, 207 P.3d 449, 450 Wash.App. Div. 3,2009. “If an obligor pays court . . . ordered day care or special child rearing expenses that are not actually incurred, the obligee MUST reimburse the obligor for the overpayment if the overpayment amounts to at least twenty percent of the obligor's annual day care or special child rearing expenses.” RCW 26.19.080(3)(emphasis added).
Then you insert the specific facts of YOUR situation.
This might also be a useful statement, depending on what evidence/arguments she presented: The petitioner’s declaration is self-serving and not adequate to prove that she had actual expenses. See, e.g., Fairchild v. Davis, 148 Wash.App. 828, 207 P.3d 449, 451 Wash.App. Div. 3,2009.
You should include separate subsections that contradict the rest of her arguments.
V. Conclusion
This should be a VERY brief summary of your overall Memo.
This is what I used in a recent Motion - this is only specific to daycare expenses. You would probably want to expand yours just a little bit to address the other arguments she is making.
Adequate proof of incurred expenses is necessary to prevent “ ‘a windfall.’ ” Kim v. O'Sullivan, 133 Wash.App. 557, 564, 137 P.3d 61 (2006) (quoting Lavigne v. Chase, Haskell, Hayes & Kalamon, P.S., 112 Wash.App. 677, 687, 50 P.3d 306 (2002)). For the petitioner to prove that she incurred out-of-pocket expenses, she would need admissible evidence like cancelled checks or tax returns. See, e.g. Fairchild v. Davis, 148 Wash.App. 828, 207 P.3d 449, 451 Wash.App. Div. 3,2009.
Question: What do you think about this? Another example of how the foster care system needs reform bad guardian ad litem? July 2008 son was born and placed with us. Birth mom had a history with the agency had children removed and history of not working her plan. She did not show up for anything they lost contact after she left hospital. Only able to reach her once. They started permanent custody hearings in September. We met the guardian ad litem (GAL) before the first hearing. They had hearings monthly until they were able to server her with papers. She was served did not show up and PC was taken in December. We adopted in May got the finalization in June. The GAL called me a few days ago to ask where the case stood and what was happening. I informed him the adoption was complete.
Shouldn't he have known that? He has been our son for months and he still had an open file and had no idea he was not a foster child anymore. Anything could of been going on and he had no idea
He came to the house once before the first PC hearing to observe the home and our son. We never heard from him again till a few days ago. he went to all the PC hearings which we did not go to and we found out later we could of been there if we wanted but we did not know so we did not go.
I know he was invited to the adoption matching in April by the Social worker but he did not show
Answer: Yes, he should have known. His job is to advocate for your son's interests in legal and custody proceedings, and he can't do that if he has no idea what's even going on with your son. This was a MAJOR slip up.
To be fair to him, the reason it happened is almost certainly that he has so many children on his caseload that he's having trouble meeting all their needs, and that's unfortunate for all involved. It's probably that he's overworked, not indifferent. This is all too common, and I've frequently heard of uninvolved GALs, which is a shame, since their work is so important.
Even so, he needs to do his job. It wouldn't have been that tough for him to phone you now and then, at the very least. You shouldn't have to do ALL the followup in pursuing his help, or force him to act on your son's case. (In fact, since the GAL is supposed to be unbiased toward any adult involved in the case, it would be better for you not to have to be the one directly asking him to get work done.)
I would suggest talking to his supervisor-- not in an accusing or confrontational way, but just with the facts like you told us. He may need some help managing his caseload, or to be reminded of his responsibilities.
Question: what does this mean? My husband and i separated for nearly a year and barely spoke. Now, in the 11th hour..... one month before finalization, he wants to reconcile. Haven;t thought about him for a very long time. Moved away and made my own life for myself, though I admit, I didn;t do much dating, but concentrated on my work, etc. Now, since hearing his voice, I feel I really do miss him. We separated due to the fact that we argued constantly about really stupid things, both acted extremely immature, though there was no abuse, infidelity, etc. I am considering a reconciliation, but I am confused and a bit scared of just returning to the same turmoil. Is this normal? Do most separated couples go through a reconciliation consideration period, and what happens if so. I feel I could be happy with him, but am scared at the same time. He seems sincere in his request, and he is a good man. But I wonder if all of this is just both of us grieving before it is really over, as we didn't really talk during the sep, or if it is the real thing. Anyone been though this? Advice, please.
Answer: If neither one of you has done anything to understand and eliminate the causes of your troubles then they will be back. Just being apart makes them less acute, but is changes nothing at the core. It really is that simple. If you want to reconcile then start with some individual and couples therapy, before you start living and acting like husband and wife again.
Reconciliation is a lot better than divorce IF you (as individuals and as a couple) really change.

I could hear the horn of the car from my room. It showed finalization of my mortal life. It was time. A fraction of me felt relieved I was finally leaving this place but, another part of me was afraid of where I was going from this place. I’d known all my life that I would, one day have to leave, but now I wished that one day wasn’t today. Only when I saw the shaky diamonds that reflected on the wall from my earrings, I realized I was trembling. After all these years this thought finally hit me: I would never see my friends, family or the people that cared for me again. After I become a fully mature vampire I surely couldn’t be around them because of the bloodlust and stuff. I felt like crying. No! Keep it together, Keep it together! I shouted in my head. Stopping me before I could get a major headache, the car horn went off again. Now I would have to go down in front of my family and friends and act all keyed up and content. I said my farewell to my room – more like my place of escape.
All my life I knew I would have to attend a vampire school and take vampire tuition. Now after sixteen years of mortality, I would have to start learning my duties and skills as a bloodsucker. My family didn’t care that I was going to be locked up in some vampire institution – well they can’t actually do anything about it. In this period, being a vampire is a great way of having more lifetime opportunities, as it said on some magazine, but I think it’s a great way of having a suckish life. I walked down the steps deliberately ignoring the family photo’s that passed by.
Two years ago my sister, stepdad and mum had died in an accident, so I got trapped with my dad, his wife and her son. I’d never seen my dad before because he abandoned my mum when he found out she was pregnant with me (she was just thirteen). Then my stepdad, Joel came into the picture. He was like the dad I never had which is accurate in a way. My mum was my best friend. She was the reason I woke up in the mornings. Don’t cry, don’t cry, I though to myself. The worst part is she wanted my father to look after me .My father (biological father) Kyle is twenty-nine now and all my friends think ‘His so damn gorgeous’. Kyle’s wife (Agnes) is thirty-one. I wasn’t too keen on her when I first met her but she’s grown on me.
I was on the last flight of stairs. I’d always complained about how long the staircase was but, strangely, today I wished it was longer. As I walked past the imaginary boundary line, all conversation stopped and all eyes were on me. I rolled my eyes.
“What am I, a science project?” I regretted saying that. Now was not a good time to crack jokes but I did hear a few snickers. I decided to have a quick peek around the room. Hell the room was so claustrophobic especially with everyone looking at me.
“That’s my Deena trying to crack jokes in a time like this just like her mother.” I couldn’t believe it. The best voice on the planet was calling to me. My grandma. Beside her was my Aunt Dakota, Uncle Allen and grandpa Rio.
Considering the person I was running to, I didn’t care if I embarrassed myself in front of everyone. I ran and wrapped my arms around grandma. “Grandma it’s so good to see you. I’ve missed you so mu –” She put a hand up to cut me off.
“How many times have I said call me Lilly it sounds younger.” Everyone in the room burst into laughter and I started crying. I knew where my mum got her sense of humour from. I would miss grandma so much. My dad told the driver to go on a spin whilst I said my goodbyes. There were so many people in the room; the driver would probably need to go on a trek (looking for dinosaurs) if he wanted to come back on time. I greeted my aunt, uncle and grandpa. I studied the room around me and noticed all eyes still on me. I travelled clockwise through the room making small talk.
By the time I reached my friends, my tissue roll was finished from all the sobbing. I knew for sure I’d run out of tears. Before I could get a word out, my best friend, Nina swung her arms around me so tight, I’m sure I couldn’t breathe.

Question: How long does a divorce take to finalize in Long Beach, CA? I am filing my judgement at the Long Beach, CA courthouse, but no one can tell me how long it takes to receive the finalization. Does anyone have any experiences with the Long Beach Courthouse?
I would love to hear about anything related to the Long Beach courthouse because I have only seen one other question here on Yahoo answers and it scared me... about some person who's paperwork got lost by the court... I am in a hurry to get this over with.

Thanks for your answers. I have waited 6 months already, and only need to send the signed (by both) judgement into the court to get the finalization. Any ideas how long that takes to process that paperwork? Thats what I am trying to figure out.

Answer: Don't know about Long Beach but as for California, you have to WAIT 6 months from the filing date in order to finalize it. So, take a deep breath and TRY to relax.
Under California law there is a statutory "waiting period" of six months before the parties to a dissolution proceeding are legally returned to the status of single persons.
Question: What? We have to file a child support application and pay a fee? Ok, my SO had his divorce finalized back in March. Last August when they had the first set of paperwork done it stated that his ex was to pay child support and that a temporary order would be set up and then an official one at the finalization of the divorce. Anyway, it was to be withheld from her paychecks, but she hasn't had a steady job or home since then so we figured they couldn't keep up with her (especially since we barely can).
Finally, we have a definite address and place of work for her so my SO called the Child Support Recovery here in Iowa (she lives in MO) to get them to going on it. Come to find out that someone didn't do their paperwork and no order has ever been set up. The lady at the agency told my SO that he would have to fill out an application and send it in with $25 to process the support order.
I told him he was getting screwed because he is a guy. Which I was joking when I said it, but unfortunately it is mostly true. She is only ordered to pay $78 a month, but when the roles were reversed and she was trying to get him for support they were going to take $477 a month + insurance.
Ok. My question is, has anyone every heard of this (filing an application with a fee) or should we be complaining to someone?
Answer: Go back to where the order was suppose to be issued to start with. If he has it in writing somewhere in his paperwork you should be able to track it easily.
