It states the legal basis on which you think you should be able to adopt this child, why the court has jurisdiction to grant the adoption, your qualifications to adopt this child and the name that you want to be given to your child when the requested adoption becomes final.

Answer: YES, your child is your child, it doesn't matter if it's a natural son or addopted one.
Green card holders can file a petition for children and spouses only.
Other extended family members are not petitioned by residents, only by citizens.

My husband is from Honduras, and is there now, while I am in the U.S. (I'm a citizen, born and raised here). He has three children age 8, 12 and 14 that we want to bring here when he is able to return. I had one attorney tell me to just petition for them as my stepchildren, but another said it would be easier and faster if I adopted them. What is the best way to do this? If I adopt them, will they still need a financial sponser? I'm not rich, but I want to help these kids get a decent education, and live in a home with solid walls and roof and indoor plumbing and a real floor.
We actually just got married 3 weeks ago, but we have been together 4 years, had 2 children (1 passed away) and just lost a pregnancy through miscarriage in August. I don't think he just married me for papers, or he would have done it a long time ago. We are truly in love. He went back voluntarily because he knows there is a penalty, and because he wants to spend some time with his aging mother, and hadn't seen his children in almost 8 years. I don't have a lot of money to pay for attorneys, so I'm trying to do all the research into the different options before I decide which attorney to go with and the best way to do it. We are truly in love, and can't wait to be together as a family (and have he children all together).

Question: Can couple adopt a relative if they have a history of mental problems? And they also are financially strapped as is.

Answer: It would likely be turned down, with good reason. Would you honestly want mentally unstable people with financial problems adopting a child-even if it's a relative? If they have problems taking care of themselves, raising a child isn't going to make things any better for them. You'd end up having three people with mental problems instead of two.

When I say adopting I don't mean adopting from the wild. I mean adopting from other zoos, and breeding, to do their part in extending the species.
Answer: Zoos in the U.S have a breeding program. This allows them to basically compare an animals needs and the zoos that can fulfill them. In other cases they can also be acquired if they are trying to breed them and your zoo contains an Okapi which is found to be a good match for another, thru DNA sampling, but Im guessing this wont be happening So theres really not much you can do besides hope your local zoo gets lucky, or the president himself tries to acquire room for them so he might get a chance.

CPS did not find me to be an unfit father, yet they severed my rights anyway. My sister lives in the state of Colorado and we live in California. Answer: Have your sister call the social worker and provide her with all her information and let her know she is interested in adoption. They might consider her but might not. It will depend on her criminal history or CPS history. Also, it will depend on if she is willing to adopt and maybe not allow contact with you (depending on why they terminated your rights).
Also, it depends on who the child is placed with now. If the child is currently with a relative (either paternal or maternal) they will not move her to another relative unless her current placement is not appropriate. And it depends on the child's age, how attached is the child to the current caregiver, are there siblings to consider, does the child know your sister, etc. Each situation is different. If the child has been in a current foster home for over 6 months the foster parents can file for 'de facto parent' status, which gives them a stake in the case. If the child is significantly emotionally attached to the caregiver (either relatives or foster parents) the judge could rule in their favor of adoption. Also, the judge is going to want to know...why hasn't your sister come forward already, what relationship does she have with the child, etc...and that is given a lot of consideration.
Without knowing the details of the reasons for removal and all the case decisions, I can't say for sure if she has a chance at adoption. I can say she cannot file for adoption in her state or even california. The child is in the custody of the county of (where ever you are). The dependency court judge will make the determination on who adopts the child and a large part of his/her decision will be based on the social worker's report...so it is imparative that your sister contact the social worker right away, but knowing they will do a full background check on her and any other adult living in her home and that she will have to answer a lot of intrusive and tough questions. If she is willing to do that, have her call right away.

Answer: If you have the adoption decree and birth certificate, you would most likely use the I-130 to request permanent resident status for your daughter as an immediate relative. Check the US immigration website www.uscis.gov to find out for sure, because it may be different for adult children than for younger children.
Question: Biological Parents Petition: Adopted Child This is a very interesting case.
My wife was adopted in the Philippines by her Aunt, a US citizen, thinking that she will be petitioned and moved to the US, but it did not happen, the US government did not recognize/approved the adoption for the reason that the adoption process was not followed, etc.. The adoption took place in the Philippines, processed, new birth certificate was given, in short, all the papers are "new" and legal in the Philippines.
Time past and my wife became a nurse, got a work here in the US(LPR) and soon to be a citizen. All the papers submitted to the embassy was the adoption papers like birth certificate and she used her aunt as her mother in all the papers she signed here( SSN, Insurance Etc.).
Now, she is planning to petition her biological mother, is it possible? is there any other way she can petition her biological mother? She wanted her mother to stay here permanently.

Answer: No, I do not believe this is possible since she is now her, legally, her aunt's child. I believe the biological mother gave all rights up when she allowed the adoption to go thru, including any citizenship in the U. S. of A. possibilities thru her.

Question: Can I petition my younger siblings from the Philippines since my mother died? Ages 7, 12 and 20.? My mother died just 3 days ago and left behind my siblings. Answer: There are many things that you are not saying about your situation. Why are you in the US and your siblings are not? What is your current status in the US?
Granting that you are of legal age, a US citizen & financially qualified to make a petition, it will take 22 years ++ to get your siblings to the US. By then, they will either be of legal age or married. I suggest that you bankroll the education of your 20 yo sister so she will be able to financially support (help you) your siblings.

Answer: No, I don't and I think the media has a lot to answer for. I doubt Madonna is the best mother in the world - but growing up with boundless resources to do whatever you want and be whoever you want to be has got to be better than growing up with nothing.

My pets come from rescue shelters as well, but individuals have freedom of choice.

Answer: No. If it's a legal adoption the ties to the child's biological parents severed. The child cannot adopt citizenship from the biological parents and cannot petition them. He would be able to petition his adopted parents though.

Answer: Once the adoption is final, Dick has no obligations for child support. If Jane and Harry get divorced, Jane would have to go after Harry for support. Also, Harry will have as much legal right to custody and visitation as a biological father would have.
Jane asking Dick to visit the child has nothing to do with support. The two are exclusive as far as the courts are concerned.

Answer: I am also experiencing the same problems like you. Our legal system does not frame a time limit for any issue, except if the Govt decides to hold it in a fast track court. Here too, it takes a long time. The main problem is we have no right to interfere in the Justice system, and that includes reputed lawyers also to speed up the Justice. Even though we get Justice, it is always delayed Justice. And as usual we hear the common refrain"Justice delayed is justice denied". There is no remedy at present, so, dear friend, we have to wait.

Answer: The I-130 immigrant petition is filed for any family member to allow them to come in as an immigrant. IR-2 is a particular immigrant category, which covers minor unmarried children of US citizens. IR-3 and IR-4 covers adopted children of US citizens. Your mother doesn't pick the category, she files the form and USCIS assigns the proper category, once they process and approve the petitions. She will need to file 2 separate petitions for the children, one for each. check out www.uscis.gov and go into the forms section. you'll find it there.

In your case, I hope the natural father would see the benefit of be removed from his legal obligations via the adoption by your present husband. All of the people in this story are maturing, I hope. Still the money angle will usually carry the day for someone in your ex-lover's circumstance. Especially, if there is a chemical issue in his life. Many men boast of their "love" for the children while knocking down some brews at the local bar. I think he will sign if one of his relatives will explain the story to him.
