Question: Does the ex stll pay child support if I have sole custody? I have been separated for over 2 years and have just begun the uncontested divorce procedure. Along with this procedure I am going for sole custody. My ex does not support the three children we have together in any way, not financially, not in school, not at doctors, not in counseling, not at all, as a result I am seeking to change our status from joint custody, to me having sole. With this does that mean that he is no longer expected to pay child support, not that he has yet, but aside from the accumulating arrears, doesn't he have to continue to be billed?

Answer: Yes,he sure does have to pay support. The only thing that will relieve him of his child support payments is if you remarry,your husband wants to adopt the child and your ex agrees to sign over his rights. He is required to pay support until the child is at least 18 regardless of the custody order.
