Child Support Pass-Through
Provision by which States can disburse part of a child support payment collected on behalf of a public assistance recipient instead of keeping the funds to reimburse the State and disregard the payment in determining eligibility for assistance. Question: How much will the child support order change? My boyfriend pays $335 a month for child support to the mother of his daughter and we have a child on the way. How much will this affect the child support that his daughter receives? Will it be raised? lowered? Also the daughter will be moving to another state in May...Will this affect anything? Answer: He has to have it re evaluated but yes, they typically they will reduce child support to a degree. He can also mention he is not accepting the fact the mother is moving out of state as it will limit his time with her and ask the judge if he can make accommodations with child support to help him be able to fly out and visit his daughter a couple times a year, and to also have her flown out for vacations if she is old enough. Now, understand they will ask what amount you make to decide how much basic care your boyfriend is responsible for your baby on the way once it is born, or when you plan to go back to work or stay a stay-at-home mom. Just make sure he doesn't try and act like he shouldn't support his daughter. Good luck. Un-like others I'm not going to make a comment as to whether he should have had children or not because that isn't what you were asking, and frankly, if everyone waited to have children when they had a high paying job, well you would be surprised at how many of the most educated people who give back are from families of lower incomes.

Answer: It is usually from the date of filing the motion for child support. A judge has discretion to use the filing date or not.

Answer: You have to file for a modification with the court. You may be able to ask the child support office for it, but they will probably tell you to file papers with the court house. NJ & NY both use the judicial process, so child support orders cannot be modified without a judge. You file in the same court that started everything.

Answer: You realize you're asking for legal advice from the general Yahoo population? I'd ask a lawyer this if I were you!
Question: Is it fair that the USA will not enforce a German child support order, because this particular child is? Is it fair that the USA will not enforce a German child support order, because this particular child is taken/retained in Germany in violation of a US child custody order and this mother is held in contempt of court in the USA for not returning that child to her American father? The father has a US child custody order in his favor and the German mother has a German child custody order in her favor that conflict each other. The father has the right to file criminal charges against the German mother for not returning her daughter to her American father which would be counter productive.
Answer: This is a very difficult situation. The American courts granted custody to the father while the German courts granted custody to the mother. Since the child is on German territory and the German courts have granted the mother custody, they are not obliged to extradite the child to the US. An American court MAY petition the German courts, but if they refuse there is not to much they can do. Also, you did not mention, who was asigned custody first? the mother or the father.
Question: How much does it cost to hire an attorney to get a child support order? I have been a single parent for almost 6 years (had my daughter at 16). About how much will it cost if I hire a lawyer to pursue child support from my ex? There has never been any agreement established and he has never paid anything for her support.
Added: He signed an acknowledgment of paternity right after she was born and is on her ammended birth certificate. My biggest worry is that he job hops or just doesn't work.
Answer: You should start with the District Attorney's office. Thye have an obligation to pursue the child support on behalf of the parent and child without cost to the parent. Then they will serve the employer too so that monies are sent directly to them. That way if he changes jobs, moves, defaults or any of these situations or others, the DAs office will keep looking for him. They will also demand IRS tax returns be applied to any arrears if applicable. You will also be protected if for any reason there is another child support order being served for a different child.
Question: Can a child support order be overturned if the order was the result of a fraudulent welfare claim? My brother-in-law was unmarried and fathered a child with the woman he lived with. She inherited a large amount of money after they had the child, booted him out, and started seeing his other brother. She blew through the money, lost the house, and went on welfare. The address she gave was not where she was living, and she had never lived there. It wasn't even the same county she lived in. She also filed using her maiden name, even though her legal name was her exhusband's name. As soon as she started getting welfare, my brother-in-law was ordered to pay child support. (When she had all the money, she wouldn't take any money from him, because she didn't want him to make any claims to the child, like visitation.) What can be done? He isn't making enough money to pay the support and live at the same time.

Dear Editor:
So many letter writers have based their arguments on how
this land is made up of immigrants. Ernie Lujan for one,
suggests we should tear down the Statue of Liberty because
the people now in question aren't being treated the same as
those who passed through Ellis Island and other ports of
entry. Maybe we should turn to our history books and point
out to people like Mr. Lujan why today's American is not
willing to accept this new kind of immigrant any longer.
Back in 1900 when there was a rush from all areas of Europe
to come to the United States, people had to get off a ship
and stand in a lo ng line in New York and be documented.
Some would even get down on their hands and knees and kiss
the ground. They
made a! pledge to uphold the laws and support their new
country in good and bad times. They made learning English a
primary rule in their new American households and some even
changed their names to blend in with their new home.
They had waved good bye to their birth place to give their
children a new life and did everything in their power to
help their children assimilate into one culture.
Nothing was handed to them. No free lunches, no welfare, no
labor laws to protect them. All they had were the skills and
craftsmanship they had brought with them to trade for a
future of prosperity. Most of their children came of age
when World War II broke out. My father fought along side
men whose parents had come straight over from Germany ,
Italy , France and Ja pan . None of these 1st generation
Americans ever gave any thought about what country their
parents had come from. They were Americans fighting Hitler,
Mussolini and the Emperor of! Japan . They were defending
the United States of America as one people. When we
liberated France , no one in those villages were looking
for the French-American or the German American or the Irish
American. The people of France saw only Americans. And we
carried one flag that represented one country. Not one of
those immigrant sons would have thought about picking up
another country's flag and waving it to represent who they
were. It would have been a disgrace to their parents who
had sacrificed so much to be here. These immigrants truly
knew what it meant to be an American. They stirred the
melting pot into one red, white and blue bowl. And here we
are in 2006 with a new kind of immigrant who wants the same
rights and privilege s . Only they want to achieve it by
playing with a different set of rules, one that includes the
entitlement card and a guarantee of being faithful to their
mother country. I'm sorry, that's not what being an
American is all about. I believe that the immigrants who
landed on Ellis Island in the early 1900's deserve better
than that for all the toil, hard work and sacrifice in
raising future generations to create a land that has become
a beacon for those legally searching for a better life. I
think they would be appalled that they are being used as an
example by those waving foreign country flags. And for that
suggestion about taking down the Statue of Liberty, it
happens to mean a lot to the citizens who are voting on the
immigration bill. I wouldn't start talking about dismantling
the United States just yet.

Answer: I have been saying for years that we need to do a Constitutional amendment. We the People need to demand that a amendment to the Constitution states that if your here illegal, You or a born child on our soil can not become a citizen, you can receive no health care, medical supplies, welfare, or any other item that comes free to U.S. citizens, as well as stating that Illegals have no rights under the Constitution as to legal counsel, trail to stay here, or anything that can delay them in our country, just that they will be deported ASAP, to the farthest point in their own country, also in this amendment it will punish employers for hireling with harsh fines, putting owners and CEOs in jail for years requiring them to pay the lost taxes on illegals, lost SS, lost medical collected, lost school fees for teachers, etc., just keep piling on the fees and punishment.
If there are no jobs why would an illegal come here? If there are no jobs, free things for them to steal, no gift citizenship, no schools, no medical then they would go home.
We let in some 1 million legal aliens a year that take years to apply and come, why should We the People just give criminals (illegals) citizenship or any other thing we paid for all our life?

I agree with you and cannot see how anyone in support of illegal immigration can possibly expect equal rights and treatment (under the law) for illegals. The thought of it is absurd.

On a personal note, I am insulted by illegal immigration and their lack of respect. It is illegal for any flag other than the Texas flag to be flown at the same level as the American flag (condition for Texas acceding).
Here in West Texas, I see Mexican flags flying at the same level or higher. I recently had a 26 year old mexican patient who knew not one word of English, and he has lived here for years.
This nation is becoming more and more pathetic and unless good people start standing out, it will only get worse.

Answer: Because you asked for an opinion, I will say, No, I don't agree with that letter, neither is 100% correct. The letter is only showing her personal opinion and her own interpretation of history. She is trying to mix history with her feelings to make the letter sounds right, but people will notice.

Answer: i agree with the letter writer, we should not take down the Statue of Liberty, and i also agree that the immigrants from Europe who went to the East Coast were just looking for a better life and they did it legally. But for purposes of argument, during the 1900s, was it economical for somebody to cross the border and live in the West? Was the West not in the same category as that of Mexico at that time? I do believe that California was bought from Mexico, isn't that right? Was there really a border that was guarded at that time to repel people from Mexico in entering the borders?
Question of fact: Was it really the intent of the European Migrants to be taken and temporarily detained at Ellis Island for processing/documentation or they were apprehended in their attempt to sneak into America without the intent of documentation?

the thing is is that jesus is easy to accept (he is a son) my wife is easy to accept (she will only be exactly identical to me once she has fully picked up the spirit again) basically it comes down to this. adam and eve said "we are better than you god" god said "screw you i'm taking away the spirit and returning you to dust (spiritless) until you pass through the two flaming swords that guard the gate to the garden of eden" or in other words, god can be considered wrong for allowing free will, he can be considered wrong for not allowing it.(when you make a decision it often has catch 22 consequences even if you are right) all things (miracles) good are possible with god, and even without him they happen (without understanding him fully) but he is pretty vicious to those who turn on there own. these guys are outcasts as far as i am concerned, because they don't have the spiritual "card" in my book to write a song like this (i am really difficult to understand, i can "see" through bullshit, i might support someone who does the same thing in a different manner) because they have bred athletes who take no responsibility for their children (in the sense they don't act like men) because to me this song is just lame (while still catchy) at the end of the day i don't care, god is forever just (those who find and love him have often suffered more than those who have not)
(when i say these guys are outcasts i ultimate refer to those who are wrong) i don't know, but i "perceive" by their words that the guy from outkast seems to be right. the thing is that others take what has happened to the outkast guy (who seems to be right, because he has struggled with it) as opposed to people who think that everytime a person get's pregnant it is because the girl is somehow evil, and trying to set a trap (even if, many in this world don't have a choice and struggle and ultimately love each other through the worst of circumstances). in the end i would prefer that all children have spiritual fathers. (a father who thinks that they are his children over mine is only right if he acts that way)
i only say this ( and i keep race separate from this, white slave owner's are much more guilty in my eyes than any athlete of any particular race, i only pick on athlete's because in a material sense they are able, secondly i am careful in judgment (and sometimes wreckless) because i don't know everything that any person (or athlete) does in there private time, and it may be that these people (athlete's or otherwise, i have read a few stories lately on this type of stuff and put some thought into it) prefer to keep the public out of their lives except for what they choose to show (which i don't disagree with)

…like the well known story of al Qaadee Abu Bakr ibn at Tayyib when he was sent to the Christian King in Constantinople. The Christians respected him and knew of his standing so they feared that he would not bow to the king when he entered upon him, so they made him enter through a small door so that he would enter bowing down. However, he became aware of their plot so he passed through the door backwards, facing them with his backside, he did the opposite of what they intended.
When he sat down, someone tried to speak ill of the Muslims and said to him; ‘What is it that is being said about ‘Aa-ishah, your Prophet’s wife?’ Intending to bring up the story of ‘al Ifk’ that the Shee’ah relate as well.
Al Qaadee stated:
‘Two women have been vilified and falsely accused of fornication; Maryam and ‘Aa-ishah. As for Maryam, she came carrying a child while not having a husband, and as for ‘Aa-ishah, she did not bear a child while having a husband.’
So he defeated the [argument of] the Christians.
The point of his argument was that the innocence of ‘Aa-ishah is a lot clearer and easier to prove than the innocence of Maryam, and that the accusation is closer to Maryam than it is to ‘Aa-ishah. This being the case, since it has been established that those who levied such an accusation against Maryam were liars, then establishing that those who accused ‘Aa-ishah of the same were liars is more rightful.
The model of this debate is that two groups are compared to each other. One group has more and greater virtues as well as less and smaller ills than the other. So if an ill were directed to them, they counter that the ills of the second group are more and greater [1], such as the statement of Allaah the Exalted:

This is the case with the Jews and Christians when compared to the Muslims, and it is the case with the people of innovations when compared with the people of the Sunnah, especially the Raafidah [of the Shee’ah].
It is the same case with Ahlus Sunnah against the Raafidah concerning Abu Bakr and ‘Alee. The Raafidee cannot establish the Eemaan of ‘Alee, his trustworthiness and that he is in Jannah, let alone his Imaamah, if he does not establish the same for Abu Bakr, ‘Umar and ‘Uthmaan. Otherwise, whenever he tries to establish that for ‘Alee alone, the evidences would not support him. Just as if the Christians would like to establish the Prophethood of ‘Eesaa and not of Muhammad, the evidence would not support them either.

Question: Laser pointers and Aircraft.....BS? So the ONLY thing I can think of, as to why it's illegal is that, being a pilot myself, there are certain times (namely during landing) that there are critical fight phases, and a distraction of any kind could cause more stress than needed.
Other than that, as far as I know there has NEVER been a case where a laser pointer has downed an aircraft. So why is it illegal?

I am a retired scientist who has worked with lasers since they were invented by a college classmate, Gordon Gould, in 1958. It is hilarious to read about the paranoia pilots have when a harmless laser beam is aimed in their direction. Even though it is harmless, the FAA had a law passed making it illegal to point any laser pointer at an aircraft.
The latest incident occurred recently when a commercial pilot is supposed to have observed a green laser light near Treasure Island, and it set off a wild goose chase involving the CHP, HBP and the local Laguna Beach Police Dept.
Here are some facts about laser pointers. They typically emit about a milliwatt (0.001 watts) of power concentrated in a 1/8-inch diameter beam. In order for potential damage to the eye, the entire beam must enter exactly into the pupil of the eye and be held there for many seconds. To achieve this, the beam would be required to pass through the windshield without any angular reflection or distortion and hit a spot ¼ inch in diameter inside the cockpit and held there. It would be physically impossible to achieve this by aiming a handheld laser from the ground toward a moving aircraft.
In Huntington Beach, a youth was arrested, and, I understand, could get three years in prison for aiming a laser light in the direction of a police helicopter. The pilot alleges he was blinded for two hours after the beam hit the windshield and was magnified to fill the cockpit. The truth is, by the pilot's own admission, the light was scattered upon hitting the windshield, reducing its intensity sharply when he saw it. Almost everyone knows that energy cannot be created or destroyed. It can only be changed in form.
The question I would like to ask legislators is why is it unlawful to point a low-level laser at an aircraft a mile away, but okay for the same laser to be legally used in a classroom, where young children are sitting a few feet away? The FDA has approved the lasers to be safe, after many studies. Why is the FAA scaring the public about laser safety?
I am not suggesting that anyone should violate the law, which I consider a bad one, but I want to point out its absurdity.

Answer: Hi: As you are a pilot then you know that while flying at night if you suddenly have a lit up cockpit your eyes take time to adjust to that light. ( remember the bit about the cones in your eyes during flight training)
If you are on final approach and suddenly it gets very bright in the cockpit you will not be able to see very well for about 5 minutes.
It is not the actual lazer that does the damage it is any light at all.
It just happens that only a lazer has the power to send that concentrated light over a great distance.

Question: Why do school textbooks still use Ernst Haeckel's "evolutionary recapitulation" model though proven a fraud? Like Darwin, Haeckel claimed that the developmental stages of an embryo retrace its evolutionary past. In other words, the human embryo supposedly goes through a fish stage, an amphibian stage, a reptile stage, and so on. Countless students have therefore been taught, “Ontogeny recapitulates phylogeny.” Support for this notion came, not from scientific research and observation, but solely from Haeckel’s own diagrams.
Ernst Haeckel was a professor of zoology in Germany from 1865 until 1909. In 1868, he fabricated the embryologic evidence for evolution by fraudulently producing the diagrams to “prove” the theory. Reputable German scientists immediately began refuting his evidence, demonstrating that Haeckel had falsified his pictures. Notwithstanding, these diagrams have been taught in biology textbooks at the high school and university levels as recently as the 1990s and the idea they purport to prove is still presented in textbooks today.
The so-called gill slits of a human embryo have nothing to do with gills, and the human embryo does not pass through a fish stage or any other evolutionary stage. The development of the human embryo reveals steady progress toward a fully functional human body. Never in the course of development does a human embryo absorb oxygen from water as fish do with gills. (The human embryo is fully supplied with oxygen through the umbilical cord.) Question: Can someone help me with this? I'm not sure where to start. I guess by saying I'm 18 years old, and my husband is in the Marine Corps. In February 2010 I found out that I was pregnant with our first child. I had an ultrasound and I was 8 weeks, my baby's heart was beating 143 beats a minute, and everything looked perfect. My husband left for Afghanistan March 26. At my 13 week ultrasound, there was no heartbeat. They did an internal ultrasound and my baby measured at 8 weeks, 5 days. I couldn't believe it. I felt like my whole world came crashing down. With time, I thought I had passed through it. I thought I was done with the grief and done with crying over losing the baby, even though I'm still young and I have plenty of time to be a mother, I wanted this baby, even though it wasn't planned. I had to go through the miscarriage without my husband by my side for support.
Later, I found out basically all my friends are pregnant. I see their updates, their ultrasounds, read about their experiences being pregnant and how it feels and how excited they are.
Every time I think I'm alright, I think I've gotten through the hurt.. Someone else tells me they're pregnant and how excited they are. It literally breaks my heart. I want to be happy for them, but I feel like I'm resenting them, but I don't hate them by any means. I'm jealous.. and I can admit that.
I just need to know how to get over this. I need to know how to be there for my friends through their pregnancy without driving myself insane..
Has anyone been through the same or similar situation? What did you do?
Answer: I would suggest seeking counseling for this. I can understand why you would be upset when all your friends are pregnant and you should be to but you unfortunately lost it. Jealousy can cause lots of things and resentment can be one thing it causes because you want your child and cant have it but they can have theirs and sometimes you just cant understand why. Just go and talk to a counselor about your feelings and they should be able to help you work through this.
Just try and take it one day at a time because that is all you can do. I am so sorry for your loss and I hope you feel better soon.

TULTITLAN, Mexico - Gathered below an overpass on Independence Avenue, dressed in the multiple layers typical of homeless travelers, the migrants watched for the next northbound freight train through Tultitlan.
Many of them, mostly young men and boys, prepared to hop onboard, hobo-style, on an ever-more-precarious trip that might get them as far as the United States.
But fewer migrants are achieving that goal. Central Americans who for years have passed through Mexico en route to the U.S. are increasingly cutting their trips short as they run out of cash or become discouraged by fewer opportunities farther away from home.
The lingering presence of the migrants in this town, about an hour's drive outside Mexico City, is tearing the small community apart, with some residents providing migrants with food, clothes and aid, others complaining of their alleged crimes, and a new local government maneuvering to get rid of them.
Treatment of immigrants has become a divisive and embarrassing issue for Mexico. A country that has historically sent millions of its own people to the U.S. and elsewhere in search of work, Mexico has proven itself less than hospitable to Central Americans following the same calling.
Church and human rights groups say the migrants passing through are falling prey to kidnappers, extortionists and killers while the Mexican government does little to protect them. The national Human Rights Commission says it has recorded, in the last three years, 10,000 kidnappings of migrants, who are most frequently seized by predatory gangs who demand money from the victims' families in their home countries.
In Tultitlan, migrants also complain of being beaten, rousted and robbed, often by local police.
Jose Juan Hernandez, a state human rights officer, said he is investigating 30 formal complaints from the first half of this year. Hernandez, who regularly visits the migrants in their squalid, temporary encampments, provides water and tips on how not to fall into the hands of kidnappers and thieves.
"Very few want to stay in Mexico," he said, adding that he sometimes sees women or entire families with children as young as 5 trying to make their way north. "They suffer a lot and risk everything. They see the economic situation is bad here and they don't like the way they are treated."
But many migrants stay because they fear life would be worse in the U.S., where they could be arrested if caught after entering illegally and where job opportunities have withered. Money often is tight, and many relatives in Central America or in the U.S. who might have helped are themselves strapped.
Hernandez has seen the number of arriving migrants increase by about 30 percent in the last year, with a huge uptick in Hondurans after the coup d'etat on June 28 that ousted their president and threw their country into political turmoil.
Among some residents of Tultitlan, there is sympathy. Nearly every day, bread distributor Jose Manzano drives by the knots of men sheltering under the overpass. When he can, he stops and hands out pallets of surplus bread from the trunk of his car.
"I see hunger, I see need, and I see gratitude in their eyes," said Manzano, 55. "If I can help a little, why not?"
Patricia Camarena, an activist who works with the advocacy group Apoyo al Migrante, or Migrant Support, also brings help and basic first aid. She scolded authorities for what she considers to be historical inaction.
"I feel angry because how can Mexico ask for immigration reform (of the United States), as well as talk about human rights?" she said as she washed the feet of a young migrant and gave him a pair of fresh socks. "I cannot stay quiet about what's happening."
A new city administration that took office in August, however, feels differently. Mayor Marco Calzada said he wants the federal government to deport the migrants. When they were just passing through, it was a manageable problem, he said, but now large numbers are staying and forming criminal bands.
Officials say the Tultitlan municipality, with a population of more than 432,000, sees hundreds of immigrants arriving each week.
"The numbers are over the top," Calzada said. "They have invaded neighborhoods. They steal, they kidnap, they rape."
City Hall is fielding complaints, the mayor added, but neither he nor his public security director, Jose Luis Medina, could provide statistics.
Advocacy groups counter that the Central Americans are being made scapegoats for all local crime.
By the overpass, near where a new suburban train makes its way and past where commuters must walk to reach their destinations, the migrants sit in small groups or around rudimentary campfires. Some beg, some use drugs and some pick up legitimate day labor.

You made a very comparison of those that came here legally and those that choose to violate the laws of our country just to get a better life for themselves and their family back in their country of origin without abiding by the laws here and assimilating as they should.
