Question: How to receive full amount of child support and money owed through our divorce settlement? My ex owes me money from a divorce settlement and hasn't paid me a dime. He also owes back child support and current child support but because he has another child from another relationship, the state of Indiana can not take out more than half of what he makes. What should I do to enforce him to pay the full amount of child support and the settlement from the divorce. Again if I take him to court what can I expect. His wages are already garnished and can't be garnished anymore. Any suggestions?

Answer: get off your fat *** and get a job and stop trying to take his earned money i don't know the circumstances of the divorce or relationship but it sounds to me that all you give a **** about is him giving you as much money as possible.

Question: How will the child support money that I receive for my son be affected? My son's father was recently fired from his job (on purpose), he plans on collecting unemployment from the state of Illinois gov't. Does the unemployment office allot a certain amount for child support? Also, should I take any action to report him to the child support office, to notify them that he is temporarily unemployed so that they can have an account of the money he will owe in arrears?

Answer: If he quit his job he will not get unemployment. If he is unemployed he can file to get the payments reduced to the minimum. In most states that's $99 a month.

Question: How does child support work in the state of Alabama? My boyfriend and I are no longer together. Since our seperation and even before he hasnt done much to support our son. To make a long story short, What all do I have to do in order to obtain Child Support? I live in Alabama and I wasnt quite sure how it worked.

Answer: If his name is on your son's birth certificate, then you can just file. If his name is not on the birth certificate, you'll have to get a paternity test. Once you have proof that he's the father (cause there is no marriage) then you can file for child support. You'll need to have an attorney file the paperwork with the court. The amount of support is based on the income of both of the parents. There are certain percentages based on your income compared to his etc... For example if he earns more than you then the percentage he pays will be higher. Either way he's going to pay something. You can also make the support retroactive to the time when he "abandoned" his child (left the home) or if he never lived with you then you can make it retroactive to your son's birth. Of course the hardest thing about child support is enforcement. If he leaves his job or works for someone whiling to pay him cash, then it will be hard to collect the money. That being said you should file as soon as possible. Even if he tries to avoid paying, the clock will be ticking and the amount will be accumulating. Sooner or later your son will get something.

Answer: I think that if I was laid off at my current job I would go work at McDonald's to feed my children, and anyone who doesn't IS a deadbeat father....and if they are too injured to work, then they will receive compensation from the government which can be used to support their children. And as far as increasing and decreasing child support, if you are not paying a proper percentage of your salary to support your children, then why shouldn't it be raised? People (including you, judging by the tone of your question) seem to think of child support in the same way as alimony. It isn't. Any father who makes children and then tries to get out of supporting them, or comes up with excuses for why they can't support them, is a DEADBEAT. Plain and simple.

He has already lost his license, due to multiple dui's, so that's not really a question. He has no professional license, unless you can get a license for being a con artist.

Answer: It is based on income. If he has no reported income, no reported job ? The only thing they can do is take away his drivers license, professional license, and send him to jail. Make sure he is reported. Peace.

Question: Does child support division consider how many children you have? I am paying child support for my daughter in my previous marriage. I caught my ex wife cheating on me, and filed for divorce. Her being the mother, she got primary custodian of our daughter, and I got standard visitation. I am having to pay child support, which I have NO problem against because I love my daughter, however, I am now remarried, and we are expecting twins. Will they take into consideration the fact of me having two other children and have some kind of deduction for my obligated child support? I live in Alabama. Well, technically, child support is based on your income. Do you people who think im saying my daughter is worth less, does that mean my twins should have to suffer so all my money goes to my daughter? Answer: Only if you decide to divorce your current wife. Then child support will be calculated on how many children you are obligated to support and the number of households they reside in. Having more children does not diminish your obligation to support them.

Question: How does child support work when you share custody? There is no court order yet. The procedures are just beginning. If the child spends equal time with both parents, me being the mom and I make more money, who would pay child support? And what is a custodial and non-custodial parent?

Answer: The 1st thing that will be determined is custody. If you are granted full custody, the father will be expected to pay child support, and should be granted scheduled visitations. They will base child support on both incomes. If you are granted joint-custody, and the child lives equal time in both homes, I'm not sure what child support would be paid, and to whom. The judge will work that out, along with which parent is responsible for insurance, etc.

Question: How do they calculate child support if the dad does not work? This isn't a real life situation so don't read to much into it. But lets say that a man with a child whom he is currently paying cs for and is having money taken out of his paychecks quits his job. He quits his job because he married a super rich woman who supports him. Legally the court can't take money from her to support the child but how do they calculate how much he has to pay?

Answer: According to federal law the standard calculation of income may be based on the following median natioanl income based on census data, minimum wage or an average of his past wage (and the standard is not which ever is highest!). The income level is then imputed to the father on the idea that "he is not currently working and this is a voluntary condition, but if he were working full time he could make at least the imputed amount." In my county in Washington, the standard is minimum wage full time 8.07 an hour multiplied by 173.33 work hours per month, but in King county where Seattle is the standard is median income which is close to $1800 a month. Wage history is useally the best as the court likes solid numbers. The point is the father CANNOT be voluntarily under or un employed, if he is the court will hand him an income that he doesn't actually make. Have fun!

Answer: Here's what I would do, as the dad in a similar situation. My ex decided to just take me to court and rake me over the coals, even though I paid my child support. She just wanted to teach me a lesson, as to who was in charge. I would tell your ex first that if the payment doesn't come regularly, you are going to Child Support Services, and they will extract the money from your check. Give him the chance to man up and do it. If he is a jerk and doesn't pay still, contact your local government offices that deal with child support issues. Try to both be good parents. I am sure you are. But treat each other with some respect. You hurt him and he has hurt you. Play nice for your kids. I wish my ex had felt that way.

Answer: Thousands of dollars. The lawyer alone could really cost you a pretty penny. If you have not filed anything yet and no court orders are set up you can file in the state you currently live in now as long as you met the residency requirements. Go on line to the Superior or Supreme Court of your State in your county and look in the Self Serve Section for family court forms. If you were never married than you may have to file for paternity if his name is not on the birth certificate. But if his name is on the Certificate than your will also want to establish sole custody along with child support and visitation. You can file also to waive or defer filing fees for forms for later or make payment arrangements with the court. Now servicing him can be done in several ways since he is out of state which can be done but by certified registrar mail or publication in the last known area that you know he lived or by process server which costs more. If you do a web search to find his location you may get that done a lot cheaper than hiring a PI but be sure that it is reliable and guaranteed one so do a BBB check on it before you pay anything.I have listed some legal sites below that you can ask any other questions you may have.

Answer: I've known a couple guys that owe child support to their ex-girlfriends whom they've had children with. In all of these instances the dad was a complete deadbeat, and way to irresponsible to be having kids in the first place. It's not even the fact that they refuse to pay, it's the fact that they have no job and no money and choose to spend all the money they come by on weed or other drugs. I'm sure there are different cases all around, I don't judge guys who owe or can't even pay child support, but in the cases I've seen it's all been pretty much the same story.

Also he has a 2nd order against him he pays now for 3555,00 a year once you give him those 2 deductions and her only the tax credit he makes roughly 3,000 less than her. Answer: If she has sole custody, HER salary isn't taken into account. I have sole custody of my son, my ex-husband has visitation. I make more than him, but he still has to pay child support. It,s to support the child: Even if she makes more, if the child is with her more and she has the bulk of the expenses, it's normal your boyfriend has to pay child support.

Question: What reasons legally can child support be less than minimum wage calulates? We are filing for joint custody, and he will have the child maybe 2 afternoons a week and every other week end. He thinks the judge is going to lower the child support just b/c he will not work. Question: What age will my dad stop paying child support? I have just turned 18 and live in Alabama and my dad pays $1500 a month in child support. I am currently in high school. I will start college in the fall and he says that when I turn 19 he can stop paying child support to me. Should he have to keep paying until I graduate college? Also, he says if he pays things like tuition or other college fees then that counts as child support and he won't have to pay. Anyone have any answers about this?

Answer: don't ask your dad to read the order. he already knows what it says and likely will not tell you. contact a family law attorney in your state. some times you can find one that will give you a free consultation and see if they may be able to tell you where you can get a copy of the order yourself and may possibly explain it to you. it all will depend on what is written in the child support order. good luck.
