Question: How would you go about changing the custody agreement without a lawyer if both parents consent to agreement? Answer: The parent who wants custody would have to file for a custodial modification in the court where the original custody order was granted. If no objections are entered, the judge approves it if he feels it is in the child's best interests and the change in custody is entered as a matter of record.
Depending on where you live, no lawyer may be needed and the forms are readily available from the clerk of the court.
Question: Master tenant doesn't have a Consent to Sublet agreement from LL. Is a sublet contract valid for subtenant? I signed a sublet contract to rent a room from a master tenant. However, found out the the master tenant never received permission to sublet. Does that make the contract I signed between the master tenant and subtenant illegal?
Answer: No. It might mean that the master tenant will be liable to you if the landlord evicts. The master tenant has agreed to provide you with housing. If he provides it, with or without permission, then he has performed his end of the contract. If he fails to provide it, because of lack of permission or for any other reason, then he has breached. The fact that he MIGHT be unable to provide the housing does not void the contract. BTW, he might not need the consent of the landlord. That would depend on the terms of the lease between the landlord and the master tenant.
Question: Is it illegal to destroy an original prenup agreement without consent of the other party. Is this a felony? I was forced into signing a prenup on the eve of my wedding 15 years ago. Answer: There are undoubtedly signed (and possibly notarized) copies anyway. It will avail you little or naught to destroy the original.Get a lawyer of your own. Do it now, and get a good one. Your combined marital assets will pay for it.
Question: Why can't a Senator simply vote nay on the Unanimous Consent Agreement to stop the health care bill? To those that know anything about the US Senate:
About the health care bill. If a unanimous consent agreement is necessary in order for the rules of floor debate to be agreed to, why can't a Republican (who doesn't want the health care bill to pass) simply just not agree to it?
For context, the House Rules committee decides on proposed rules for how a particular bill is going to be debated on the House floor, and then a majority of the House must agree to the rules for debate (and for bill consideration) to proceed. However, in the Senate, the party leaders (rather than a committee) typically meet together and then propose the rules for debate, but then, ALL the senators must agree to it for the bill to proceed. So why couldn't a Republican senator simply voice opposition to the unanimous consent agreement of the health care bill to stop it from being discussed on the Senate floor (so it couldn't be passed in the Senate, so it couldn't be enacted into law)?
I know that it could be, in part, political calculation - if they can defeat the bill without resorting to drastic measures, they'd be more popular. But the problem is that once the unanimous consent agreement is formed, it's much, much more difficult to stop the bill, so a gamble of letting the bill go forward as normal in hope of getting a higher benefit could backfire if the bill starts appearing likely to pass. Disagreeing with the unanimous consent agreement would spend much of the Republicans' little political capital, but would ensure that the health care bill would fail.
Another reason why they might not want to disagree with the unanimous consent agreement is because of tradition - Senate custom is that if you disagree with a bill you vote against it after debate is closed, or you vote against closing debate - but you don't vote against OPENING debate (which the unanimous consent agreement does). So refusing to open debate might not be politically pragmatic for Republican Senators.
But many Republicans, including Congressional Republicans, are much more ideological than politically pragmatic - they truly want to defeat the bill at all costs, because some actually believe that it would "bankrupt America" or kill senior citizens or euthanize certain people in society or refuse care to Republicans and force everyone to participate in it. Senators that believe this (yes, some do) could easily vote nay on the unanimous consent agreement; why wouldn't a single crazy simply vote no?
Answer: Because it would be political suicide, just as it would be if the Democrats used the "nuclear" option to only require 51 votes to overcome a Republican filibuster...
Question: child custody consent agreement? My child's father and I have agreed on custody and visitation. Is there a way to do this ourselves and file it through the Court system and have a judge sign off on it with out paying an attorney 750.00. Answer: Anything that says implied consent sounds fishy to me. Sounds like some police state term. Whatever happens if I get hit with it I am going to fight it because I do not believe implied consent laws in most cases are Constitutional. The term "Implied" sounds like an excuse not to allow probable cause to be the grounds for a warrant and this is not kosher if we are following the law of the land.

I have just started graduate school and had/have four years of student loans under deferment, the original loan note states the circumstances under which deferment is granted and I do currently meet those circumstances...However, two months ago I received a letter informing me that my loans had been sold to a new creditor. After several phone calls and conversations I have been told that Wells Fargo does not offer academic deferments, only forbearances. Is this ok? I signed loan agreements with the first creditor, can a second creditor buy the loans and legally change the agreement without my knowledge or consent?
Yes, I know the difference between deferment and forbearance...it's a few thousand dollars a year. Deferment delays payments and freezes the balance, forbearance delays payments but does not freeze interest accrual.
I understand that private student loans are highly un-regulated, having searched through my original papers it just seems odd to me that the terms a loan note can just be changed without the borrower's knowledge or permission.
Answer: Check your original loan agreement again. Is there anything in it that states that they can be sold to another company? The answer is probably. It probably does say something in that original loan agreement that states if your loans are sold you would be subject to any terms of the new company. So, yes... this is probably legal and exactly the reason you should be weary of private loans.

During this time they asked if they could get a cat. We said the usual...as long as we dont smell anything etc. We agreed to another cat and a dog with the same stipulations. Now we are going back to a written rental agreement, with their consent, but we would like to have no pets due to the odor that eminates from their apt. We also live in the same house in the downstairs apt. Also, their dog continually barks. Can we specify no pets in the new lease as long as we give them ample time to find a new home for them.?
Answer: Well as an devoted animal lover I would say don't kick them out, HOWEVER! If there is an odor and the dog barking all the time, I think they are not responsible pet owners and yes you can draw up a new lease and give them 30 days to sign it without the pets, (which I doubt will happen), or move. Remind them that you said in your verbal agreement as long as you didn't smell them, which you do and the dog is barking all the time. OR if you want to continued with the same renters and can take the odor and barking, you can always raise the rent for your inconvenience or ask for more of a deposit? for the possible clean up you'll have when they move out. You would never know I have 2 cats. Good luck.

This resolution recapped statements from numerous UN resolutions against Iraq and authorized the president to use military force against Iraq, with whatever means he deemed nescessary. this resolution deemed the action against Iraq as a response to terrorism.
Whether a person sees it that way or not thats how congress drafted the resolution and voted on it.

Answer: Okay, you need to research HIPA. It is a privacy act which does not allow employers to require employees to discuss their ailments with their employers. It should be sufficient to provide a doctors note that you are under their care.
In the event that a hardship is created or you are unable to perform the main/ essentail functions of the job, then the employer has the right to terminate employment.
Your employer needs to decide if your case has created a hardship on their business. If it has not, then they should try to work with you. They cannot require you to sign a consent, call asking your friends , go to your home to check on you, ask your neighbors, or do anything that invades your right to privacy concerning your health. They were given a 30 day notice that the rental policy was coming into affect. Answer: The law presumes that you read something BEFORE you sign it. Unless you can prove fraud (ie, they added a page after signature), you're basically up a creek. The fact that you were pressured to sign the agreement doesn't matter.

Answer: It means that they can give the rights and obligations the company has to someone else without first getting your consent. Basically, they're saying that if the company sells your division or gets bought out or merges with another company, it can give the company's rights and obligations to that company or to the new company that comes out of a merger.
