Question: Help I am working abroad in Switzerland: need to justify request for Cost of Living adjustment? I have ask my company for a weekly per diem to supplement the higher cost of food, personal care and transportation here (I moved here from Atlanta). They asked me to prove my case. Answer: I think you need not to compare the standard of living of the country of origin to where you are living to day. What you need is to spell out all the cost you are incurring per day/ week/ month. The total/sum of it should be compared with what you are currently paid per day/week/month. If what you are currently paying/ cost of living is greater than what you are paid, then you have proved the case. But also even if what you are paid is greater than the cost of living, the magnitude should count.
If you can prove that you missed some important information on the cost of living at the time you entered the contract with your company.
But also if there are economic incidences that have arisen after the contract, like inflation, economic depression and the alike unforeseeable incidences;those again will be enough proof.
Question: what are the laws regulating the cost of living adjustment? if a companany approves a cost of living , is it legal for them to deny any one an increase?
Answer: Is the cost of living adjustment limited to certain job categories, pay grades, full/part time status, certain seniority, or job performance (check the employee handbook or union contract), attendance criteria? If there are any of those conditions on the cost of living adjustment, then yes, the cost of living adjustment can be denied. If not, then all people meeting the criteria should be eligible.

Answer: Right, not everyone has a pension or any other income to back up their SS. My elderly mother is REALLY struggling right now, between the cost of food, the cost of her medications, etc. Sure, she has Part D, but it only covers so much, and she always hits the gap before the year is through.
After the Navy, my father split his life as a machinist between two companies, 20 years with one and the last one he was with for about 28 years, finally retiring at 71. That company had NO retirement plan at all - no 401K, no pension, nothing. He then ended up very ill with cancer and passed away at 73 - didn't even get to enjoy his hard-earned free time.
There were nine of us children growing up, so working a traditional job outside the home was out of the question for my mother. The daycare would have been too expensive. So she always cleaned houses, took care of elderly people, and babysat other people's children for extra income. She did anything she could do where she could take the young ones of us with her. That's right, my mother took care of nine kids, cooked and cleaned for everyone, then on top of that, went and cleaned other people's houses and took care of other people's kids. I really have no idea how she did it all. My father worked hard in a hot shop as a machinist, then came home and tended his large garden, which supplied our family with a lot of food. The garden was hard work, but it was also his greatest love. In his younger years, he also painted houses and mowed lawns on the side for extra money as well. Basically, both my parents worked their fingers to the bone 24-7-365 and in the end, had precious little to show for it.
AND, even though our family could have very likely qualified for government help over the years, we never took a single dime of it... EVER. My father just wouldn't stand for taking any form of charity. Oh, and he also didn't believe in credit cards, so they didn't live on borrowed money either. Unfortunately, after he retired and my mother just couldn't do extra jobs anymore, their income dwindled to the point that credit cards became a necessity for certain expenses.
Anyway, my mother lives on the SS from my father's income, and because SS is based on how much you earned over the years (not how many years you worked), and my father was never paid what he was worth, her SS really isn't all that much. It is just not enough to pay the bills, buy groceries, pay for all her medications, plus all the extras like home repairs, etc. I am saddened to say that at almost 74 years old, my mother is living in debt and believe me, it's been a necessary evil. She is very thrifty (always has been), spends on a budget, scrimps wherever she can, wastes nothing, and still doesn't have enough.
Why have I mentioned all this? You didn't need any part of my parents' life story, right? Well, here is why. All this leads up to the fact that even though those yearly COLAs are small, they mean a lot to my mother. She says things like, "$22 is $22... that'll buy some groceries." So for her, cutting them off is just another kick in the teeth.
I apologize for writing a book. I visited my father's grave today (I don't like to go on Memorial Day when everyone else is at the cemetery), and it's difficult not to think about all these things when I go.

Answer: well, simply put, if you make, say, $100 a week and with prices rising in housing and food, among others, it might cost you $130 for the same products once costing you $100. if an adjustment occurs, your salary would rise to meet this 'adjustment'. nice but not likely to happen.

Answer: You are getting no money from a cost of living adjustment because the cost of living did not go up during the period it is based upon.
There was talk about a 2010 stimulus payment, but to date it has not gone through and it is not likely that it will. Blame the Republican as they all vote against it.

Does this mean we are going to be paying an average of 3.3% more per paycheck? If I got a 3% raise for my annual review, does this mean they just raised my pay for the cost of living adjustment and it really won't make a difference?

Answer: The cost of living adjustment for those individuals receiving social security benefits will be increasing 3.3%. This means they will receive that percentage increase in the monthly amount they receive.
The percentage of withholding from your salary will remain at 7.65% however the wage base for social security tax withholding will increase from the $94,200 to about $96,000 of salary.
You are absolutely correct in that the raise they gave you didn't equal the increase in the cost of living for 2006. You certainly didn't receive a performance increase. By not at least keeping up with the cost of living you are just getting into a situation where your salary will result in less and less buying power each year.
You might also want to check out the department of labor web site to see if they list the cost of living adjustment there. They publish it each month in the federal record.
I say look there because the social security adjustment usually doesn't reflect the full cost of living increase each year.

Without endorsing any particular party or candidate, I suggest we all make a point of voting in new blood in the coming 06 & 08 elections. You can still vote democrat, republican or independent; just resolve that they will not be incumbents.

Answer: It depends. If you work for the governement, you most likely have a COLA built in to your contract with your agency or government entity.
If you work in the private sector pay increases are discretionary and you have no right to a raise.
In fact, your coworker could be the only one to receive a raise and you'd have no recourse.

Thanks for the answer, I did not have the attorney actually turn me down, there was a conflict of interest in that he had a personal relationship within the company. I understand that they do not have to pay me more than min.but, the problem is they are giving all other employees the cost of living adjustments. Unfair pay practice at best, and if I make any complaint about it they retaliate. I had even been threaten physical violence. I initially had a lawsuit but dropped it through a settlement against my attorney's judgement. The settlement basically stated I'd receive the cost of living adjustment equal to that of all other employees for the remainder of my employment. this held true for two years then the old administration left and my settlement mysteriously disappeared, since my attorney had not agreed to the settlement he did not have any proof and they stated I had forged the copy I had. I'm not trying to be an a%% I am just trying to support my family on far less money
Answer: employers do not have to give any salary above minimum wage, you have all ready had one attorney turn you down why do you want to spend more money to get the same results.

Answer: The Cost of living adjustment is only there to ensure that the benefits keep up with inflation. Since they are tied to the inflation rate - there is no COLA increase if there is no inflation.

Answer: yeah its a raise only in a nominal sense. But since this adjustment is based on CPI, what it means is that the raise is going to be by the amount increased in the price level. namely, the raise is going to offset some of the negative effects of inflation. So, its not an actual raise per se.
