The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.
The Bill will also eventually force private insurance companies out of business, and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government.
However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated. If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.
The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own.
The irony is that the Congress doesn't have any authority to legislate in most of those areas to begin with! I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care..
This legislation also provides for access, by the appointees of the Obama administration, to all of your personal healthcare information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a direct violation to protection against unreasonable searches and seizures. A direct violation of the specific provisions of the 4th Amendment to the Constitution. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.
If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you. It is called a tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment.. However, that doesn't work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.
So, there are three of those pesky amendments that the far left hate so much, out of the original ten in the Bill of Rights, that are effectively nullified by this law It doesn't stop there though.
The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;
The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.
I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights. Article 6 of the Constitution requires the members of both houses of Congress to "be bound by oath or affirmation to support the Constitution." If I was a member of Congress I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.

At this year’s annual conference, I received the Outstanding Senate Bill Award and due to my hard work and dedication, was selected by my fellow delegates and advisors to represent Massachusetts at the annual Conference on National Affairs (CONA) this summer. The Conference on National Affairs is a 7-day conference held at Blue Ridge Assembly in North Carolina. It is aimed to further student awareness of national and international concerns, while teaching and upholding the Y Core Values of Caring, Honesty, Respect and Responsibility. At this conference, I will research a federal issue and must then write a proposal that addresses the problem and suggests a solution. I will then go through the legislative process, deferentially discussing and debating my proposal with the youth legislators of other states. This conference is a once in a lifetime opportunity and I am excited of the experiences that lie ahead.
As you may imagine, a trip like this requires financial support. I need to raise a total of $900 dollars by (WEEKDAY/MONTH/DAY) to be able to attend. Question: Should the government enact more federal programs to offset recession? The marshall plan worked great to bring America out of a depression.. Should a simular plan be put in place to combat un-imployment and help to rebuild our aging intrastructure; redistribution of wealth.
Answer: The Marshall plan did absolutely nothing to end the depression. What it did was to provide a prototype of American welfare by taking our commidities and airlifting them in to a democratic enclave that was being starved out by a totalitarian regime (headed by predecessors of the current Vladimir Putin, and we had better not ever forget that). The industrial output needed to combat both the Japanese and the Nazis did. When will this idiot nation get it through our collective heads that it is industrial production that drives economies, and NOT government programs? Every single government dollar that is spent on welfare is a net reduction in the GDP. I am NOT speaking to the issue of whether or not this help is needed. Many times it is. But, not one welfare recipient has EVER increased our net domestic production.
Tax dollars are just like water. They don't increase, they just go from one pocket (ours) to another (the government's) to another (welfare recipients). Tax funds spent on government giveaways accomplish nothing except for postponing the inevitable. How do we pull out of a recession? Simple. Repeal (not modify, not renegotiate) NAFTA. Put under immediate review ANY AND ALL regional trade agreements. File a counter suit against the EU for their predatory policies towards Microsoft, and then inform Steve Jobs and Bill Gates that they need not worry about outsourcing their monopoly overseas, because if they move a majority of their corporate assets overseas (and any other corporation for that matter), they will be treated as a foreign corporation. Conduct a comprehensive and top to bottom review of ALL Government welfare programs. Build a fence, not a virtual fence, not a symbolic fence, not a someday fence, but a real fence, that people have to either climb over or dig under to circumvent. And then man it with real US soldiers with real US weapons with REAL orders to stop any and all infiltrators at gunpoint.
These simple steps should accomplish several things. First, it will stop the bleeding in American industry. Second, it will put foreign governments on notice that the America of Neville Chamberlain is gone. And from now on they deal with America the way it really is, not America the way they wish it was.

Answer: You should qualify for the federal displaced worker program. Your local unemployment office should have some info.
Question: Has anyone ever had their Fed. student loans default and then get sent to this thing called the FTB offset? Franchise Board Tax offset unit with Edfund ?
I think that's what FTB stands for, I got a letter in the mail.

Can you receive financial aid (Not loans, but the grants) if the loan is in the Offset program? Has anyone ever had this happen, what happens, what does this mean?
Answer: Once you are in default you can not get any grants, loans, work study, or any kind of federal or state financial aid.
Being in default means they now have the right to charge you an exorbitant amount in penalty fees and make your loan have a higher interest rate. A loan originally of about 2,000 could EASILY become a loan of 15,000 or more depending on how long you let it set there without paying on it. There is no way to get around paying on student loans, they NEVER go away.
Being in default also means they will prob start garnishing your wages and seizing your income tax returns.
Question: Does the UC blue and gold program cover housing? When the blue and gold program covers systemwide tuition and fees, do they use federal student aid to offset the difference. I guess im really asking does the blue and gold program cover my fees and then would I still be able to receive federal student aid to pay for housing and other expenses?

Question: Why do Obama supporters feel like his plan is what our nation needs? The Obama-Biden plan for health care will put the federal government increasingly in control of decisions previously made by private businesses. The plan also seeks government funding for health care costs previously paid for by private businesses and corporations, essentially making all American taxpayers financially responsible for health care costs, regardless of whether or not they wish to contribute financially to the health care needs of others. Some details include:
* Requiring "insurance companies to cover pre-existing conditions so all Americans regardless of their health status or history can get comprehensive benefits at fair and stable premiums." Insurers may not cover pre-existing conditions now in order to protect themselves and their clients from rising costs associated with those conditions that could rapidly make premiums even much more expensive than they are. Requiring coverage of pre-existing conditions not only interferes with the natural right of private individuals and businesses to freely enter into contracts but also will lead to increased — not decreased — costs.
* "Covering a portion of the catastrophic health costs [businesses] pay in return for lower premiums for employees." However commendable this may seem, it nevertheless is a forced redistribution of wealth. It is unavoidable that this will be an expensive federal program, that, like every other federal program, will expand over time. As such it will be funded by taxpayers, who will see the federal hand taking money from their wallets to give to others, in this case as subsidies to businesses to offset health care costs.
Total federal outlays for the Obama-Biden health care plan: $50-$65 billion according to the website. The costs will be covered, you guessed it, by increasing taxes on the wealthy.
As this brief analysis indicates, the Obama-Biden plan as described in documents and pages on the campaign website amount to, essentially, a modern socialist encyclopedia.
There is no doubt that Barack Obama is a tremendously talented speaker, and perhaps an inspiring leader. That does not mean that his policies are in keeping with the vision of limited government given form by the Founding Fathers in the Constitution.
Rather, like most of those who have either sought the Presidency or actually occupied the White House, from either of the two major parties — and this includes John McCain as well — he seeks a radically expanded role for the federal leviathan in Washington.

Answer: One thing we need to recognize is that Obama’s health care plan is going to be very expensive. Common sense says there is no way you can get so much more in benefits for so much less in costs. Medicare is a government-sponsored program for our senior citizens. It’s going bankrupt. Social Security is a government sponsored welfare plan that promises retirement income to senior citizens. It is also on the fast track towards bankruptcy.
Do you really want the government to be in charge of your health care?
I have emailed Obama’s office several times asking for details of his plan, including premiums, co-payments and deductibles. The “responses” I have gotten include requests for contributions, requests to work for his campaign, and invitations to attend his rallies. But I have gotten no information on how much it will cost me to participate in his plan. I don’t think he knows.
Insurance, whether on your car or your health, is not designed to cover everything. And in the case of health insurance, the very concept of insurance fails if there is a provision allowing the young and healthy to opt out. Paul Krugman, a liberal economist who writes for the New York Times, says the opt-out provision in Obama’s plan is a deal killer. It will make the plan prohibitively expensive. The young and healthy will opt out and avoid paying the premiums. When they get older and develop medical issues, they will opt in.
One thing is for sure: Obama’s plan will not be paid for just by premiums paid by participants. It will have to be heavily subsidized by our income taxes and other taxes. So we’re all going to “participate,” whether we want to or not.
The idea that we can have “free” health care, ”free” college, and all kinds of other benefits paid for by taxing the “rich” is ridiculous. We will either tax the rich out of existence or out of the country. Then where will be get the money to pay for all the benefits “we” want, “we” need, and “we” deserve? We can’t borrow it. Japan and China and our other major trading partners are already getting nervous about our deficit spending. They’re concerned about the safety of the money they have invested in the U.S.
Politics is all about promises, but it’s about promises MADE, not promises KEPT. Neither Obama nor McCain can keep their campaign promises. Watch and you will see.
Question: Will my tax refund be offset due to a defaulted student loan? Here's the situation......
My student loan went into default about 7 months ago. I spoke with a collection company called Allied Interstate who was now handling the collection, and rehabilitation program. I entered into a student loan repayment program for 185.00 a month. I have made 6-7 payments now, and I have two payments left to rehabilitate my loan to "normal" status. I asked the account manager if my tax refund would be offset, or garnished..........he told me "no", and just to make sure, to call a 1-800 number...........which is an automated service through the government to check if you have any federal debts. I called and the voice exclaimed I had no federal debt and that nothing would be offset. My question is..............after I file my tax return, as long as I don't miss any payments with the rehab program, could anything happen to change my status to offset while I am waiting for the return? As the collection agency rep correctly explained, you will not be subject to refund offset, so long as you are actively honoring a repayment plan that you established with your lender.
As long as your loan is in the hands of the collection agency, you can relax with the assurance that the Department of Education has not asked the IRS for an administrative offset. That only happens when the collection agency gives up, and returns your file to the Department.
Refund offset is a last resort for the Department when a borrower refuses to negotiate with the collection agency, or when a borrower has failed to keep the promises he/she made when establishing an alternative repayment plan. So long as you are honoring your plan, you have nothing to worry about. In fact, when your loan is rehabilitated in a couple of months, the status will no longer reflect that the loan is "in default" at all.
I hope that reassured you. By the way, the IRS would notify you if the Department had requested a refund offset, because, by law, you must be given the opportunity to contest it. Chances are extremely slim that you could win a challenge to the offset, but my point is simply that you would already know if the Department had requested an administrative offset. If you haven't received a letter from the IRS, that's another reason that you can breath easy.

MISSION — Between 20 and 25 undocumented immigrants arrive each week for kidney dialysis at Mission Regional Medical Center’s emergency room.
“They have no way of paying for it, and in six months they rack up $750,000,” said Mitch Ladyman, the hospital’s trauma coordinator. “That’s just a number we’ll never get reimbursed.”
And while the federal government has a $1 billion federal program intended to help with unpaid hospital emergency care, a recent Associated Press report shows a large chunk of that money has gone uncollected by cash-strapped hospitals.
Federal officials can’t explain why overburdened communities have not grabbed the cash.
Nationally, only 15 percent of the money has been handed out three-quarters of the way through the program’s first year, according to the AP.
Texas as a whole is slated to receive almost $25 million for the 2006 fiscal year.
Rio Grande Valley hospital officials say they take whatever disbursement they can or risk cutting hospital services essential to the community.
“We’ve definitely applied for and have definitely gotten some of it,” said Dan McLean, CEO at South Texas Health Systems in McAllen, which includes McAllen Medical Center and Edinburg Regional Medical Center.
The health group has collected about $2.41 million since it filed its first claim for its five facilities in February 2006.
That may seem large, but in the last eight months alone, the hospitals have provided more than $118 million in uncompensated care, said hospital group spokeswoman Dalinda Guillen.
The $1 billion financial dispensation is through September 2008 and authorized under the 2003 Medicare law. Hospitals are paid a percentage of the ER costs on quarterly cycles, so they receive money six to nine months after the actual procedures.
Some hospitals are reluctant to apply for funds because they don’t want to do the paperwork, say hospital and public health officials. The government also trims submitted hospital bills and returns money based on costs, not on services provided.
Hospitals feel uncomfortable asking patients about their citizenship status.
“A lot of undocumented patients already don’t access care,” said Sonal Ambegaokar, a health policy attorney at the National Immigration Law Center, a non-partisan policy center that works with low-income immigrants based in Los Angeles.
“The few that go in, if they hear they are being asked about their immigration status, they’ll assume they’ll not be able to get care … that will affect the public health.”
Local hospitals dismiss the objections, noting the required paperwork is only two pages long and their employees are trained to sensitively ask questions.
“I understand the reluctance of a hospital that doesn’t see that many undocumented patients,” said Mission hospital Chief Financial Officer Randy Slack. “But when you’re treating a number of undocumented patients, it’s worth your while to go through all the hoops and troubles to get partial reimbursements.”
Mission’s hospital has also received a “six-figure amount,” he said.
“It covers cost of supplies and labor, operations to treat those patients who are undocumented,” Slack said. “If money went away, we might have to find other areas to cut to keep bottom line balanced.”
For South Texas Health Systems, the trauma room or pediatric ICU unit could become financial casualties if it continues to lose money through uncollected ER care, McLean said.

Question: have any of you who didnt get rebate check on time or at all from weeks ago ever get it yet or find out what? happen to it??? i called my state and they have no record of me being in their offset program, nor does the TOP however i did owe 165 in state taxes from 2006. im still worried!!! now get this there is a record of offset for my dau father and it was submitted well befor dec 07 and he does owe me arrears, he got both federal and stimulus check back, not a penny less than he was told... he TOLD me, were friends. now i dont hold ill feelings he pays currrently + arrears, BUT what are the chance of offset line and state saying no debt and me still getting offset??? how the hell did someone registered get through cracks??

Answer: If your state has a record of you being in arrears for taxes owed to the state, the irs will forward money from your economic stimulus check the amount owed to the state. You can get more information at www.irs.gov

If you plan on answering my question, I would like legitimate answers and not anything related. This includes bigoted answers for whatever reason (religion, tradition, etc.) because that is counterproductive.
There are so many positive things that could be done to help the economy and the people. Examples:
Same-Sex Marriage: Dr. M. V. Lee Badgett of University of Massachusetts research estimates the potential impact on businesses of same-sex marriage legalization to be $2 billion to the wedding industry alone.
A 2004 Congressional Budget Office (CBO) report examines the impact of allowing the 1.2 million Americans in same-sex domestic partnerships in the 2000 Census to marry and finds the impact to be comparatively small in terms of the huge Federal budget. While some spending on Federal programs would increase, these outlays would be offset by savings in other spending areas. The report predicts that if same-sex marriage was legalized in all 50 states and on the Federal level, the U.S. government would bring in a net surplus of US$1 billion per year over the next 10 years.

Pot-Legalization: In California Assemblyman Tom Ammiano, D-San Francisco, wants the state to tax and regulate all pot as it does alcohol. State Board of Equalization chairwoman Betty Yee, a supporter, projects the law would generate $990 million annually through a $50-per-ounce fee for retailers and $392 million in sales taxes. (The state now collects $18 million each year in taxes on medical marijuana.)
Imagine this done on a federal level.

Answer: I have a problem with taxing medical marijuana. What other prescription medication gets taxed. comparing this with alcohol is a poor comparison indeed as there are few and short lived medicinal value to a shot of vodka.
Is this allowable due to the mind altering effects? I don't think so in as much as 1/3 of medications will alter your mind in some way.
So, what are you left with: REALITY People are willing to pay a tax to get "high". they already have to get special physicians to prescribe pot to them and then get a card that cost more $$ to buy the pot. In my opinion, this is a slippery slope to getting taxed on all prescriptions which in the USA are already the most expensive in the world.
My opinion on same sex marriage is that everyone should have the same rights to be miserable as heterosexual people. Discrimination is just wrong in most cases. such as I would not have a person convicted of sexual crimes watching over my kids...am I discriminating? Yes, but with merit
Question: Turbo tax costs me (state tax) money by forcing me to itemize - why ? Having struggled with Turbo tax for quite a few hours now I have come to the conclusion that there is no way round a fundamental flaw for people like me. Based only on my federal return, the program makes me itemize my deductions, allowing me to be ~$100 better off than using the standard deduction. Then when I complete my DC state return, the rule is that if I itemized federal, then so must the state return. Since on the state return the state tax is not deductible, I have almost no deductibles. With Turbo tax, if I choose the standard deduction for my federal return, I get $4k worth more of deduction, and so my federal taxes are ~ $400 lower. Offsetting the federal difference, I am therefore ~ $ 300 better off than following the only (bad!) option offered in Turbo Tax. Why doesn't Turbo tax give me the option to choose standard deduction (or even - why doesn't it check the State return in deciding the deduction) ???
I appreciate the input from the reply from Bostonian as I don't really have anyone to refer to on this. Apart from the minor misconception (I am better off with the standard deduction than itemizing - not the other way round), my biggest problem was that TT really didn't allow me to choose to take the standard deduction as far as I could tell - thus I had to abandon rather than pay $300 extra overall - this really wasted my time. Surely software would give me the choice ?
I just noticed the mis-typing in my initial mail that probably lead to the confusion. I don't know how to correct it as I am new to this. I meant to say that "Without TT ...." in one of my sentences that started "With TT".
Answer: That's not a TT thing, it's a DC thing. DC obviously requires you to itemize on the District return if you itemize on your Federal return. There are several states with similar requirements. Therefore you have to figure out which way works out for you best and go with that. In your case you're $300 better off over all by itemizing so that's the best way to file.
You'd have the same situation with any other tax software.
Question: Do you think Obama unveiled his Patients Bill of Rights to offset the fact he broke yet another empty promise? Obviously, at this point, most thinking people realize that when Obama makes a promise/guarantee he's either oblivious to details that would make keeping that promise nearly impossible or he's simply lying to gain political advantage.
So in light of the fact this health care bill will A) cost at least $300 billion more than Democrats said it would and B) force a majority of employers to make changes to their health plans (contrary to Obama's promise that if you like what you got, nothing would change)................Does this seem like an attempt to throw some sugar on a very sh*tty situation?? (Also, he cut the backroom deal with PhRMA which broke multiple campaign promises and endorsed an individual mandate to buy private insurance after campaigning AGAINST this mandate)
