Initiating Jurisdiction
The state, tribal or county court; or administrative agency, which sends a request for action to another court or agency which can exercise legal authority against a party to an action. In cases where a State is trying to establish an initial child support order on behalf of a resident custodial parent, and does not have Long-Arm Jurisdiction (i.e., cannot legally claim personal jurisdiction over a person who is not a resident), it must file a Two-State Action under the Uniform Interstate Family Support Act (UIFSA) guidelines. (Tribes are not subject to UIFSA.) (See also: Long Arm Jurisdiction; Two-State Action; Uniform Interstate Family Support Act)
Question: How can I figure out what Indian Tribe I am from? I am not sure what tribe my family is from. I was told Cheyenne but I would like to know if there is any free site of some kind that I can find out my ancestry and what tribe as well I am from. I have many cultures in my family but I want to know what I actually am. Any tips would be nice, thank you.
Answer: You need to do basic genealogy linking yourself to your parents/grandparents/great grandparents/ etc. untill you come to the original Native person in your family. Contrary to popular belief tribes do have records of their people and the US also kept very good track of tribal people -- There were annual census taken on my reservation as far back as the 1880s. DNA tests cannot show you what tribe you descend from even if you do show Native DNA. Again, the best and ONLY way to know for sure if you descend from a Native person and what tribe you descend from is to do the research (free) or hire someone to do it for you ($$).
Question: If you register with your indian tribe are you registered with the nation? I recently got my Cherokee Nation Card in and compared it to my husbands, he is registered with his tribe and not with the Cherokee Nation. Does that mean if there were special rights to native americans he would not receive them?
Answer: You really aren't giving enough information to provide a good answer to this. The Cherokee Nation is the tribe in Tahlequah, Oklahoma. However the Eastern Band of the Cherokee Indians located in North Carolina is sometimes referred to as part of the Cherokee Nation. If he were a member of that tribe he would enjoy the same benefits as you. If however he were a member of a non-federally recognized Cherokee tribe such as those state-recognized in Georgia or Tennessee, he would only be eligible for any "rights" or benefits afforded him by that particular state.
Now if he is registered with any other federally recognized tribe, he as well as you should have a Certificate of Degree of Indian Blood card (called the white card) and that is what allows you both to obtain certain medical services and other benefits provided under the Bureau of Indian Affairs and the Department of Interior.
There are a great many false "tribes" popping up around the country and some of them have practices that are not only financially suspect but downright dangerous to your well being. There is a list of false tribes on the Cherokee Nation website.

Question: Have you ever heard of an indian tribe called the "Sue" tribe? Its Pronounced Sue tribe, but its probably spelt differently. My boyfriend claims hes like 2% indian (even those hes white as snow lol) I was just trying to find info on the tribe. Is there a website with a list of indian tribes in America?
Answer: Hey sarahe086,
The settelers called the Lakota indians Sioux, and the name stuck when they were moved onto the reservations. You have the Sioux site above, here are some others.
Question: History report on the Navajos Indian tribe? I am doing a history report on the Navajos Indian tribe. I need to know a website where I can get a lot of facts on there culture, daily life, and customs.
Answer: wikipedia.com
Question: What indian tribe will take a mixed low blood quantum? My daughter is part Little Shell Chippewa (non federally recognized), but not enough to be enrolled. Her father was enrolled. We recently found out that she is also a descendant of the White Earth Ojibwe in MN. I am trying to get her into a tribe, but am having trouble finding one that will take her. Anybody know who would?
Answer: Enrollment is based on ancestry. If she is not related to someone in the tribe, they will not accept her.
Question: i heard that aztec calendar is based on mayan, mayan is based on an even older indian tribe. whats tribe name? what indian tribe's calendar is the mayan calendar derived from. i hear that little is known about this group of indians. but whats their name.
Answer: The calendar is derived from the Olmec calender. The Olmec were a civilization who inhabited South-Central Mexico from ~1400 BC to 400 BC, and were the progenitors of several Aztec and Mayan practices, such as the ball games and bloodletting.
Question: I want to get out of paying taxes by joining an Indian Tribe. How do I go about this? I have no Indian blood at all, but I have heard that on occasion, they take on new members. Anyone know the procedure?
Answer: I'm full blood Native American and I pay my taxes just like everyone else does. You have your information wrong.
Question: how much does a member of an indian tribe receive in tribal funds per month? i have recently found out that i am a member of the pokegan potawatomi tribe and members said that i should get tribal monies from the tribe. i dont think i want to do this but im curious bout how much they get per month. or how does that work?
Answer: I'm sorry, but I am confused...
You recently found out that you are a MEMBER? As in an "enrolled member", or are you using the term loosely- like you are a "descendant of a member" and are not actually enrolled?
And I'm assuming that you are referring to the Pokagon Band- not the Pokegan?
The majority of Tribal Nations do not have percap distribution. Of those that do, distribution is decided by the tribe itself- there is no standard.
If you are enrolled, you might want to contact the enrollment office and update your address. If you're not enrolled, your decision to enroll should not be contingent on how much you could profit.
Question: I am adopted. How can I find what indian tribe my mother was enrolled in? I know that I am 1/8. My adoptive mother remembers it in the paperwork that my Grandmother was half. Also it said in my birth mother's obituary that she was a native american. So she must have been enrolled in a tribe? My adoptive parents are not helping me with school at all and I really want to be able to go. I requested paperwork from the judge but he only sent me the legalization papers which had nothing about my heritage...help!
Answer: It is not your heritage but your CITIZENSHIP that qualifies you for opportunities reserved for American Indians: You must be an enrolled member/citizen of a US Federally Recognized Tribe to qualify. If your biological mother was enrolled, she would qualify. If you are not enrolled, you would not qualify. Even if you did become enrolled, it does not mean that you will get to go to college for free. Native people have to pay for college too.
Question: How can I join an Indian Tribe? I am 1/16 Cherokee Indian.
1.)
Can you find out what races your are by a blood test for legal proof?
2.)
How can I get my legal documents saying which of my ancestors were Indian and how I'm connected to them?
I don't see how because I would obviously be insulting myself?
Answer: For legal proof you need to research your family history, looking at and providing copies of your research documents...this site may help you get started http://www.indian-affairs.org/resources/aaia_research_ancestry.htm
Question: can someone interpret this for me.? Article 18
Preliminary rulings regarding admissibility
1. When a situation has been referred to the Court pursuant to article 13 (a) and the
Prosecutor has determined that there would be a reasonable basis to commence an
investigation, or the Prosecutor initiates an investigation pursuant to articles 13 (c)
and 15, the Prosecutor shall notify all States Parties and those States which, taking
into account the information available, would normally exercise jurisdiction over
the crimes concerned. The Prosecutor may notify such States on a confidential
basis and, where the Prosecutor believes it necessary to protect persons, prevent
destruction of evidence or prevent the absconding of persons, may limit the scope
of the information provided to States
Answer: Article 13 when breached, and evidence exists that the prosecution deems worthy of looking at should tell any state that is involved unless telling would cause people being hurt, destroying the evidence or running from the crime. In this case only limited information will be released concerning the investigation.
Seems like it limits the information made available about investigations involving crooked law officials and makers.

Question: Generic insight needed...about leaving the country with my child..can someone plese give me some insight? have a 3 yr old son from a previous marriage. I have court-ordered sole custody due to his father's disability (severely disabled due to accident two years ago, can not take care of himself) he has every other weekend w/supervision from the grandmother. I have recently married (call him JD) JD has sole custody of two daughters. We have lived together for a year. JD got orders to a overseas and of course, we all want to go. (3-4 year leave) I have offered to come back to the summer with all the children so they can see their parents here. The grandmother mentioned above, as guardian of my ex, has initiated an order to prevent me from not only leaving the country but leaving the jurisdiction without her or the courts consent. I know it is totally possible that a judge might look at me and tell me that I have to allow my son to see his father as usual, which means I won't be able to go with my husband. I think if she was un-biased guardian appointed by court, I wouldnt have this problem.
Answer: It all depends on the prior court decisions. If you have full custody most likely you can go as you please. However; if the court ordered visitation, you may be restricted. If you are allowing visitation and it is not court ordered, you are free to go. It just depends on what the papers say. Talk to your attorney.
Question: Where was "the palestinian people" in 1948-1967? The incredibly "heroic" and as ancient as the Australopiteks, "palestinian people" appeared on the front pages of the world media for the first time in September of 1967, after Israel for the second time beat the sh** out of the combined Arab forces of Egypt, Syria and Jordan.
You may check it for yourself if you don´t believe me, but I warn you that it will be a loss of time.
As is well-known to anyone(except some 300 millions of ignorant Arabs) , in 1948 -1967 Gaza was under the Egyptian jurisdiction , and what some call "The West bank"(and what is actually the historic Jewish territory of Judah and Samaria) was under the Jordanian one.
And nobody ever heard about "the palestinian people" until 1967, when Israel got these territories back in the result of the Arab-initiated Six-Days war.
So, those who lived in the West Bank and Gaza went to sleep one warm September night as simple Arabs - and woke up in the morning as the "heroic Palestinians"?
terri, in this short time I am here i´ve been reported so many times that one time more or less means nothing. By the way, how do you know that I´ve been reported? This forum is full of tricks!First, i found out that there is a quota to the mails. Then it turned out that any question and answer can be deleted just because someone says he is "offended", and now looks like any poster can tell, if someone´s question is reported(i mean, any poster except me).
Medina, we were not sleeping. We were siting and waiting , hoping you will at least make some good use out of the land you stole from us. But when we saw that you are converting it in the desert, we decided to take it back.
Of course 2000 years is a lot. But we know that you Arabs are slow, so we were givng you a chance, adapting to your speed level. (:
Answer: Yep, It's only until Arafat declared: "I'm a Palestinian" that the word was coined to denote - Arabs living in Israel (territories held by Egypt and Jordan).
But Now, you can find so much propaganda on the internet - that yes it seems like new Palestinians are descendants of "Australopithecus Palestanus" LOL and preceded Jews by thousand of years.
Question: do you know who to call if your wallet is stolen? Read this and make a copy for your files in case you need to refer to it someday. Maybe we should all take some of his advice! A corporate attorney sent the following out to the employees in his company.
1. Do not sign the back of your credit cards. Instead, put 'PHOTO ID REQUIRED'.
2. When you are writing checks to pay on your credit card accounts, DO NOT put the complete account number on the 'For' line. Instead, just put the last four numbers. The credit card company knows the rest of the number, and anyone who might be handling your check as it passes through all the check processing channels won't have access to it.
3. Put your work phone # on your checks instead of your home phone. If you have a PO Box use that instead of your home address. If you do not have a PO Box, use your work address. Never have your SS# printed on your checks. (DUH!) You can add it if it is necessary. But if you have it printed, anyone can get it.
4. Place the contents of your wallet on a photocopy machine. Do both sides of each license, credit card, etc. You will know what you had in your wallet and all of the account numbers and phone numbers to call and cancel. Keep the photocopy in a safe place.
I also carry a photocopy of my passport when I travel either here or abroad. We've all heard horror stories about fraud that's committed on us in stealing a name, address, Social Security number, credit cards.
Unfortunately, I, an attorney, have first-hand knowledge because my wallet was stolen last month. Within a week, the thieve(s) ordered an expensive monthly cell phone package, applied for a VISA credit card, had a credit line approved to buy a Gateway computer, received a PIN number from DMV to change my driving record information online, and more.
But here's some critical information to limit the damage in case this happens to you or someone you know:
5. We have been told we should cancel our credit cards immediately. But the key is having the toll-free numbers and your card numbers handy so you know whom to call. Keep those where you can find them.
6. File a police report immediately in the jurisdiction where your credit cards, etc., were stolen. This proves to credit providers you were diligent, and this is a first step toward an investigation (if there ever is one).
But here's what is perhaps most important of all: (I never even thought to do this.)
7. Call the 3 national credit reporting organizations immediately to place a fraud alert on your name and also call the Social Security fraud line number. I had never heard of doing that until advised by a bank that called to tell me an application for credit was made over the internet in my name.
The alert means any company that checks your credit knows your information was stolen, and they have to contact you by phone to authorize new credit.
By the time I was advised to do this, almost two weeks after the theft, all the damage had been done. There are records of all the credit checks initiated by the thieves' purchases, none of which I knew about before placing the alert. Since then, no additional damage has been done, and the thieves threw my wallet away this weekend (someone turned it in). It seems to have stopped them dead in their tracks.
Now, here are the numbers you always need to contact about your wallet, if it has been stolen:
1.) Equifax: 1-800-525-6285
2.) Experian (formerly TRW): 1-888-397-3742
3.) Trans Union: 1-800-680 7289
4.) Social Security Administration (fraud line): 1- 800-269-0271
Answer: Hey Barbara, thank you so much for this information. I am going to print a copy of this and keep it in a handy place for further reference.
Question: What do you think of Sheriff Joe? Print Article Email Article Most Popular Change Type Size Crime sweep proceeding despite feud

A day after a conflict between the Maricopa County Sheriff's Office and Phoenix Mayor Phil Gordon spilled over into a verbal sparring match, Sheriff Joe Arpaio is deploying 200 members of his civilian posse and deputies to saturate two areas in north and central Phoenix where day laborers congregate.
Arpaio claims the effort came as a result of business operators complaining to his office about laborers loitering, littering and committing petty thefts in an area between Bell and Thomas roads and 25th and 36th streets.
The operation was scheduled to begin at 4 p.m. today.
Gordon said on Thursday that he wanted Arpaio to work with the Phoenix Police Department instead of planning enforcement efforts without their knowledge.
Arpaio shot back that Phoenix Police were well aware of his "crime-suppression efforts" and that the department didn't have the manpower to commit to such an operation on its own. Arpaio's office initiated similar sweeps last year at a furniture store near 36th Street and Thomas Road, efforts that drew protests by immigrant-rights advocates and counterprotests by foes of illegal immigration.
Phoenix Police learned about the Sheriff's department's Good Friday operation because of its sheer magnitude, said Sgt. Joel Tranter, a department spokesman.
"It's not like we're not aware of it because it was highly publicized," Tranter said. "He has concurrent jurisdiction anywhere in the county and the sheriff can apply resources as he sees fit."
The Sheriff's publicity machine also caught the eye of immigrant-rights groups that vowed to monitor the operation, keeping a close eye on deputies and posse members in case their actions veer toward racial profiling.
As he has done in the past, Arpaio vowed that his critics won't deter his efforts to go after Valley residents who might be in the country illegally, whether that criticism comes from citizens or elected officials.
"I don't know why he's taking shots at me," Arpaio said about Gordon. "Well, I do know why, because he doesn't like me enforcing the illegal immigrants. He doesn't have 200 people that he could send to do a crime suppression program. He ought to be thanking me."
Too bad HE isn't running for President!
Answer: i'm in phoenix & i'll tell you what we think of him - he's an A$$HOLE.
Question: Why do people south of the border feel they were the first to inhabit the south west? Why do they forget that the land was occupied by American Indians?
Why do illegal aliens feel this is their land to come back to and make bogus claims of it belonging to them?
XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX
As we have seen American Indians were the first people and first westerners of the American West. When Europeans came to what they called the ‘New World’, they saw it as their right or ‘Manifest Destiny’, conquer the land and disposes the American Indian. To help justify conquest, Europeans perceived indigenous peoples, including American Indians and their culture unequal (even non-human), and unworthy; often mentally rendering them invisible. American Indian discovery of America was also ignored so as to put into effect the ‘Doctrine of Discovery’. Thus you will see false statements like ‘Columbus discovered America’, even though it is not clear he new where he was. So as immigrants, some by choice and others forced, made their way to America and the American West, the American Indians were a barrier to be removed or simply invisible, especially if already removed to reservations. These immigrants were from Europe, Africa, Asia and Pacific Islands. Most policy and influence came from Europeans and a dominant English influence. American language, measurement, science, technology were derived from English influences. Most Western States were surveyed with an English system while only Texas and Louisiana retained French or Spanish survey systems. However, the natural environment was often the greatest barrier to settlement in the American West as we have noted with Prescott’s thesis.
The Spanish, English, French and Russians were the first foreigners to invade the American West and they came from all directions. Early probes were for quick discovery of fame and wealth. Often navigation and mapping was all that was accomplished. Some took the wealth and left, while others stayed to settle.
The Spanish were the first to expand into ‘New Spain’ from Mexico to the Southwest (New Mexico) and Lower (Baja) and Alta California as early as 1519. The Spanish initiated the ideas of ‘Manifest Destiny’ and ‘Doctrine of Discovery’, since they felt that their god had given them dominion over all living things, including newly discovered infidels. The ‘New World’ was given by the Spanish Pope Alexander VI to the Crown of Castile in 1493. Spanish conquest and colonization was under the jurisdiction of the Council of the Indies.
Answer: because they do not know any better. They think everything belongs to them in this country and always have. They have no rights to be here and should be deported. I did not do my time protecting and serving this country for the likes of these people to invade it from the inside.

Answer: Good Ideas.
One big flaw...If the user of the stolden ID looks like you & they have your credit card & ID, then writing "PHOTO ID REQUIRED" won't do any good. There is a BIG NETWORK/Theft RING that does nothing but matching the stolen ID's to the person in need of that ID (usually an illegal or Felon), for purposes of fraud for employment, government benefits, & to show authorities. Some are even arrested & serve jail time with your name & SS#! The only way to ID yourself as the person who did NOT commit the crime is with your FINGERPRINTS!
Everyone who has lost or "misplaced" their ID, or suspects foul play, should ask the Social Security Office for a PRINTOUT to see if anyone is using your SS# for purposes of employment. Some employers don't know the hired help is using a stolden ID & #!

Question: What do you think Immigration attorney Lilia Velasquez outraged police arrested illegals after nearly hittin? What do you think Immigration attorney Lilia Velasquez outraged police arrested illegals after nearly hitting a deputy's police cruiser ?
According to the San Diego County Sheriff's Department, the incident happened last Friday when 28-year-old driver Minerva Santos made a left-hand turn in front of a Sheriff's deputy, almost hitting the deputy's police cruiser. Santos also had a 9-year-old in the car with her at the time and another adult female.
"[The deputy] initiated an enforcement stop and contacted the driver who was unlicensed," commented Sheriff's Lt. Michael Cea. "It turns out, she was also an undocumented immigrant."
The Border Patrol was called in to assist, which Cea noted is within the jurisdiction of the law.
The Sheriff's Department policy notes, "when a person is contacted and is found to be in this country without proper documentation, he or she may be briefly detained for federal authorities."
Immigration attorney Lilia Velasquez stated she was outraged when she discovered what had happened. Velasquez claims the deputy may have been acting under the law, but she could have done so in a more humane way.
"When I heard in fact that a 9-year-old was in the vehicle with the two adults and she was also taken into custody and also patted down, I became very upset," said Velasquez.
Santos' other daughters, Esther, 10, and Elizabeth, 12, are staying with a family friend while their mother, grandmother and sister are in Tijuana.
Another individual familiar with the family's plight told a local media outlet that she received a call from Santos while the incident was unfolding last Friday.
According to Raquel Barrios, she is aware the family was in violation of the law by not having the proper documentation, but she noted, "Only someone who has children and a family can understand [that] we all need to eat."
While Raquel Barrios and Lilia Velasquez may have been upset how things went down, the bottom line is the three individuals were in the country illegally, according to all indications from law enforcement.
If you are here in the U.S. illegally, then you should not be outraged when you are caught here illegally and sent back home.

Answer: Brilliant move by San Diego Cops!
They knew if they went to the higher ups within their organization, the Mayor and the politicians would have prevented them from IDing the aliens
But call in Border Patrol, and they have nearly unlimited authority on alien matters.
I hope they are rotting in Tijuana
Question: What are your thoughts on the two dilemmas of social poilcy: The compassion vs. control dilemma? Child abuse has emerged in the last fifteen years as a visible and important social problem.
The two dilemmas of social policy alluded to above are defined as:
1. family autonomy
vs.
2. coercive intervention
(compassion vs. control). and professional response.
Theoretical Confusion and cClinical Inadequacy
We propose that these consequences result, in part, from medical and legal ambiguity concerning child abuse and from two fundamental, and in some ways irreconcilable, dilemmas about social policy and the human and technical response toward families in crisis. We call these dilemmas family autonomy versus coercive intervention and compassion versus control.
How children's rights-as opposed to parents' rights-may be defined and protected is currently the subject of vigorous, and occasionally rancorous, debate.
The family autonomy vs. coercive intervention dilemma defines the conflict central to our ambiguity about whether society should intervene in situations of risk to children. The traditional autonomy of the family in rearing its offspring was cited by the majority of the U.S. Supreme Court in its ruling against the severely beaten appellants in the controversial "corporal punishment" case (Ingraham vs. Wright et al).25 The schools, serving in loco parentis, are not, in effect, constrained constitutionally from any punishment, however cruel.
Yet in California, a physician seeing buttock bruises of the kind legally inflicted by the teacher in the Miami public schools risks malpractice action if he fails to report his observations as symptoms of child abuse (Landeros vs. Flood).32 He and his hospital are potentially liable for the cost of the child's subsequent injury and handicap if they do not initiate protective measures.
This dilemma is highlighted by the recently promulgated draft statute of the American Bar Association's Juvenile Justice Standards Project, which, citing the low prevailing quality of protective child welfare services in the U.S., would sharply restrict access to such services.28 The Commission would, for example, make the reporting of child neglect discretionary rather than mandatory, and would narrowly define the bases for court jurisdiction to situations where there is clear harm to a child.
Our interpretation of this standard is that it would make matters worse, not better, for children and their families.8 So long as we are deeply conflicted about the relation of children to the state as well as to the family, and whether children have rights independent of their parents', we shall never be able to articulate with clarity how to enforce them.
What's your view?
Answer: it is interesting that you post in women's studies as that a marker of social progress is in fact how free women are.
i believe that with women's rights will come child's rights as that from history you may see that women used to be under the man(of the household) domain children will take off this yoke too.
for good or bad i think that "violence" will be continued to be shunned.
