Levy
The seizure, and possible subsequent sale, of assets, including personal property, to satisfy a child support debt.
Question: What does it mean if someone has a levy on your paycheck? My husband was served a notice today saying there was a levy put on his paycheck for 50.00.Will they take all 50 out at once or in increments? How soon after you're served do they start the levy?
No He owes..54.16
Answer: Well, first of all I really doubt that anyone would go through the trouble of getting a levy for only $50. I think you have misread the notice...more likely is that it $50 per pay period.
But, to answer your questions. They will take it out all at once...and if they have sent the notice to your husband they have probably sent it to his employer. This means the very next pay check and every one after that until the debt is paid.
The reason I think you misread the notice is that it would cost more than $50 to get a levy on a paycheck.
I hope this helps.
Question: How is it that a levy can be put on an automobile? I know of someone who had been foreclosed on and later someone that was a holder of a second deed of trust on the property put a levy on the persons truck because when the house was foreclosed on they (the holder of 2nd D.O.T) didn't get paid so they put a levy on that persons truck to force them to pay the amount on the deed of trust. Is that even legal?
Answer: Depends on the state. Some states allow for deficiency judgments after non-judicial foreclosure. If the proceeds from a foreclosure sale are not enough to pay off all the lienholders, they can pursue a deficiency judgment. It needs to be done by due process and the states that allow it have specific timeframes that the lenders must take action in or lose their rights to pursue the deficiency judgment.
Question: How long does it take for the levy to clear from my CD account? The IRS put a levy on hold in January and even though I already arranged for payment it shows in my CD account. My CD matured and so I am unable to withdraw the money because of the hold. The IRS is now closed. How long does it take for all this to clear so that I can get my money?
Answer: If you have entered into an installment agreement with IRS, it should have released the levy. Give them a call and request that the release be sent.
Question: What do you put in a newspaper to thank voters if the tax levy you have been working on looses? I am working on a campaign in favor of passing a tax levy for a health department. I need to find a way to thank voters in the newspaper in case we loose. What should I say?
Answer: I would just thank the public as a whole for listening and considering the issue at hand.
Question: The IRS sent a wage levy to my job, is it too late to make payment arrangements? I can't afford to pay the levy as I will lose my car and apartment because I won't be able to pay rent or car payment. Is there a way to make arrangements to pay $100 a pay period or is it too late now that the levy has been issued. If so, what do I do? The first deduction is scheduled to come out my paycheck on May 25th.
Answer: Call the IRS and ask.
Question: How canI prevent a levy being attached to my checking account that holds only SSI?SS benefit money? I live on SSI and have credit card debt I'm now unable to pay. Legally I know they can't garnish this benefit money. I have been told they can put a levy on my checking account and freeze it. How can I protect myself from this happening? Where and how do I file for a injunction to prevent my bank fom allowing them to freeze my account ?
Forgot to mention I am in Florida.
Answer: You would have to not deposit the check, but cash it...
Anything in the bank is subject to seizure, SSI funds or not...
Why not do the right thing and get a job to pay off the debts you are absconding on???...
Question: what action should I take on a wrongful levy? I have just been informed by my bank that I've had a levy placed on my account by the Department of Child Support Services. I have been paying on-time (have payment history proof) for years with no non-compliance of the court order. My bank also imposed a $100 fee for the levy. They can not do this right? This is creating a financial hardship for my family.
Answer: It sounds like a mistake so as long as it is provable it should be easely correctable. The first step would be to go see the person at Child Support Services who is handling your case and explain what's going on.
Question: What do you think of the Mike levy incident? Do you think fans and the wrestlers were to harsh on the kid?
If you havent seen it yet. Just google it.
BQ: Was Mike Levy incident worse than the Mass transit incident?
Answer: I thought it was disgusting. Ian Rotten, Mickie Knuckles, Tank and all others involved in the humiliation of this poor kid should be ashamed of themselves. Mickie destroyed Levy. Knuckles really kicked his butt. From stiff headbutts and legit punches to smashing him with huge light tubes, I felt really sorry for Mike Levy.
And then Tank (who is around 400 lb) and Devon Moore come out and attack Mike Levy. Moore "curbstomps" him off the top turnbuckle onto a ladder. Then Tank does the same. I almost felt like breaking down in tears after watching this. And I'm being deadly serious. Devon Moore then gives Mike a HUGE, stiff-looking superkick.
Ian Rotten's son stars whacking Levy with a kendo stick. Way to add insult to injury. Then Rotten comes out and beats him down and starts screaming at Mike for giving Mickie a "gooseegg" which might her chances of a contract with TNA (in fact, Knuckles got the massive bump from headbutting him so hard). Mad Man Pondo comes and gives Levy a wicked suplex on the concrete.
They all leave but not before Rollin' Hard (another wrestler) gives Mike an embarrasing wedgie.
The most disgusting act I've ever seen in Pro Wrestling.
BQ: It was miles worse. At least, New Jack didn't even intend to hurt the kid, who lied about his age to get into the match in the first place. Mike Levy wanted to wrestle but was humiliated by sick, sick people!
Question: How do I find out where a company banks so I can place a levy on their account? I have won a lawsuit against a company and cannot collect the money. How can I find out where they do their banking so I can place a levy against their account ?
Answer: PI will do, or approach the courts.
Question: How can Jupiters cloud be scared from the schumacher levy 9 impact? Hey
We all know that Jupiter is almost entirely made of gas but when the schumacher levy 9 comet impacted Jupiter it left a giant impact scar on Jupiter's cloud but how can a impact scar be shown on a cloud layer because clouds would just reform and all the debris would be blown away in Jupiter's massive wind stream, so whats going on?
Answer: Comet Shoemaker-Levy 9 caused a series of massive explosions in Jupiter's atmosphere. These stirred up the gases in its atmosphere to an extreme extent, bringing darker material up from lower levels to the surface layers of clouds. It took several months before the strong forces in Jupiter's atmosphere were able to return things to their normal state.
Question: Is it an ethics violation for a school board member to actively campaign against a school levy? A local school board member voted against placing a school levy on the ballot and then actively campaigned against it. Does he have a duty to publicly support the school distict and the school board of which he is a member?
Answer: No. He does have a duty to act in the best interest of his constituents.
Question: How are home owners "threatened" over proposed school levy? Our city is gearing up debate over a proposed school levy. The school district is preparing the not uncommon tactics of threatening to cut busing, sports and other activities.
A recent editorialist wrote that she is not against the kids. Rather, she is against home owners being threatened. Of course, she referred to the threats to discontinue services.
Aren't there more direct and overt threats leveled at home owners when we're talking about property taxes? Please say what other threats are involved. Comment on their nature. To which threats should home owners be most concerned?
Answer: The way I look at it is:
The school's JOB is to provide EDUCATION...not busing, extracurriculars, or great wages for middle management and administrative folks.
Typically, if the students in a district are doing well, I'm more inclined to look favorably upon renewing levy funding or expanding it for a new building, etc. But if the scores are bad, I see that as throwing good money after bad unless it comes AFTER a regime change on the school board...superintendent etc.
A "threat" to kill sports or busing is only a threat if your belief about what school should be is misguided IMHO.
Question: Will a tax levy keep me from getting a passport? I work for the rail-road, and am going to school and getting promoted. The job is in mexico. The IRS has a tax levy or garnish on my wages now, and im scared to apply for my passport or waste the money incase i get denied.
Answer: The garnishment should not cause you to be denied.

Question: Have you ever had a levy on your bank account? I have a levy on my bank account from a credit card debt, I just found out today so I will not be able to call about it till tomorrow on my lunch break. If I call them and set up a payment plan will the take off the levy? If they do how long will it take to get my account back to normal, the same day or later? Thank you in advance.
Answer: I will answer from a lenders position. Why should they release levy just for promises. Not to be rude, but you most likely have promised payments to them in the past and didn't deliver. I personally don't think they will release the levy.
Question: We recd a Notice of Levy from the IRS today? My husband and I received a Notice of Levy from the IRS today (02/20; Notice dated 02/09) in the amount of $4547.65 for 2004/2005 taxes. We have a federal refund coming in the amount of $2200.00 which I assume will be applied to our back taxes. We basically live paycheck to paycheck and have two small children. How can we stop the levy of our banking/checking account?
Answer: call the irs and ask them to set up up payment plan with you and they should do this for you i know of someone that owed back taxes and they went in and talk to them face to face and they set up a payment plan but please still up on this because they will stop the payment plan and all taxes will come due at once
Question: Does there have to be a certain amount of money in the bank in order to place a levy on it? There was a levy placed on my bank account and the bank charged a $75.00 processing fee. What would happen if there was not enough funds to cover the levy and the bank-processing fees?
Answer: Your account will go negative (overdrawn). The bank will charge a fee for this and then may keep on charging until you bring the account current.
Please be aware that if the bank closes the account, then you will not be able to open another account due to ChekSystems. So you need to open another checking accont now, before you will be unable to because of the negative credit with ChekSystems.
Be aware that moving money out of an account to avoid paying a levy can be considered fraudulent conveyance and this is a crime.
If you owe a ot of money, seek out the counsel of a BK attorney and a CPA.
Question: Any ideas for decorating a car to support a levy for school its a contest? Do you have any ideas on like things to paint on the car or put on a car or truck i have both...its for a levy we are trying to get passed we are having a contest seeing who can decorate their car/truck the best??

Question: If Salary Employee has State Levy's making pay less than minimum wage is it ok to pay less then minimum wage? Our employee has been out on STD and we need to get all his standard deductions (medical/dental/fsa) as well as child support and 3 state tax levy's that take 10% of his gross income. When you calculate his check it is less than minimum wage is it ok to pay him less than minimum wage? He works on a government contract through a private contractor.
Answer: The minimum wage is for gross pay, before all the deductions. That must be at least minimum wage. NET pay may be less than minimum, and is for millions of people making minimum wage or close to it.
Question: How Can I stop a bank levy on my account? I was a co-signer for a relative to get an apartment, they got evicted, I was never notified by the Apt. owner or them that anything had occurred until I received a notice of levy from my bank AFTER I went to the bank one day to withdraw some money. I was never properly served. What legal recourse do I have?
Answer: You need to see an attorney. The landlord must have sued both the tenant and you, but the case has already been settled and, if the levy is about to happen, the appeal time has run its course.
Your option now is to file a motion to set aside the verdict. For that you are going to need legal advice because you are moving beyond the small claims venue that the landlord prob. used.
Bottom line tho... if your relative bailed on the rent and you co-signed you prob. owe the money. Even if you set aside the verdict and start over, you will STILL owe the money, right?
You will have to sue your relative for the money.. obtain a judgement and then wait (in line it sounds like) to collect it.
sorry... consider this as one of life's semi-expensive lessons.
