If there is a paternity issue in a family law case that generally means there is some question concerning who the biological father is. Usually people need to disestablish paternity of one man and establish paternity of another man. For instance, the law presumes that the husband is the father. Therefore, if a child is born to a married woman, her husband is legally the father - even if it was absolutely impossible, i.e. the husband was incarcerated and they hadn't seen each other for 10 years. In these situations, the husband is usually disestablished as part of the divorce case, and the biological father is established. Questions of paternity come up in many other situations. If this is an issue in your case, you are urged to consult a lawyer or call the Family Law Helpline.
Question: paternity!!!? Is thier a website that i can go to to find out paternity suits that were filed. I know in Ct you can see public records online, but im not sure about the other states preferably Fl. Anyone know a website???

Answer: Google the county in which the suit was filed. Such as _____ county clerk of couts. Fill in the county where the blank is. Hope this helps. More than likely you won't get to see any documents, but yiu can definetly see if a suit has been filed
Question: Paternity ? On my summons it states that paternity will be determined judicially. Does that mean a paternity test? Or because he signed an Acknowledgement of Paternity paper he is already legaly the father? He is contesting he is the father but his 60 days to recant the paper is over.
Answer: Because he signed the Acknowledgement of Paternity and allowed the 60 days to lapse, he is basically up the creek. However, if you were able to get a DNA sample from the child and it did not match with the father, then he could petition the courts on the basis of the DNA.
Question: What happens during a paternity court hearing? I have to go to a paternity court hearing regarding my baby's father. Does anyone know what I should expect? I know he will probably request a paternity test. But what all happens. Any and all comments are accepted. It is just sad that I have to go to this step, but they baby's father wont help with anything. So I have to get him on the paperwork for support.
Answer: First, the judge will make sure that all involved parties are present. I am assuming that child support is involved, so they will most likely have a representative there. If you are to give testimony, then you will be sworn in.
In my experience, the judge will ask the potential father if he wishes to acknowledge paternity. If he says yes, it's pretty much over. He will sign an acknowledgment of paternity, and the judge will most likely rule on child support at the same time, if he has correct employment information.
If he says no, then the judge will most likely order a paternity test and the case will be continued until the results are available.
Question: How do I get a paternity test when the father is in prison? My father is in prison here in Texas and a few years ago he told me he had another child before me (a daughter) and she doesn't know about him. Well i contacted her mother and she is not sure that my dad is the father. I think my dad will be willing to cooperate. So how would I get a paternity test done? Oh and remember this is all in Texas.
Answer: If you cannot get a paternity test performed on your father, another option is to do a siblingship test. This test will tell you if you and this girl share the same father.
For a siblingship test, all you would need are samples from you and the girl you think may be your half-sister, though if you can include samples from your mother and the girl's mother, it will make your results that much stronger.
Results from a siblingship test are typically ready 5 days from the time the lab receives the samples.
Question: How dose a court order paternity test work when my ex husband and i live in different states? I live in Mass and he lives in Maine he got a court order to establish paternity for my child would I have to go to Maine with the baby to get the dna test? That would suck cause I don't ever want to see him again....
Answer: You should be able to take your baby locally and let them have DNA, then the court will send it to where he lives to put with his for the test.
Question: Is it possible to determine paternity by only knowing what blood type a father and daughter are? IE, There is an accident--the father has a rare blood type and the hospital needs donors. The hospital asks his daughter to give blood. The lab determines her blood type is different. Is it possible to know she is not his biological daughter simply because she does not share his rare blood type--or that her blood type is not compatible with his? Or, does another form of blood test need to be done to prove paternity conclusively?
Answer: Not really. You might be able to exclude someone from paternity but you could not prove that a person with a blood type is your parent.
Blood types are alleles. So you need to see how blood types could be split between the two parents.
O is not A or B AB is A and B.
So your if you are AB and your mother is A and your Father is A --- something is wrong. If Dad is A and you are O that proves nothing since his pair is AO Mom could b AO and you just lucked out with OO. See below

Answer: buccal testing (cheek sample), Thats where they use the q-tip and rub it inside your mouth to get some cells from your cheek.
Question: How do I go about establishing paternity? I live in the state of Missouri and I am to the second trimester of pregnancy. The father of the child and I were living together until one day I saw this note and all his belongs were gone, saying I have to go, I'm sorry. I was wondering how I would go about establishing paternity when the time comes?
Answer: There isn't anything you can do about it now. You have to wait until the baby is born to have a dna test done on the child (don't let anyone bully you into it now as it wouldn't be safe). And since he isn't around, don't let him demand to be there for the baby's birth. He lost that privilege when he left you.
Once your child is born, you need to go to the court house and file for child support. You can do this without a lawyer if you can't afford one. Then the court will order the alleged father to appear for a dna blood test. You too will have to appear to be tested (to make sure that the baby you present is your's) and your baby too.
If and when he is confirmed as the child's father, child support will commence AND he will be permitted to request visitation. If you don't want him to take the baby for overnight visitation (a bad idea when the father abandoned you), make sure you are BREASTFEEDING. You are also justified in asking for parenting classes for him as well as supervised visitation as he abandoned you while you were pregnant with his child and he may hurt your child if he doesn't want to pay child support.
Personally, for that reason alone (the last one in the previous paragraph), I would not declare him to be the child's father and I would not go through with establishing paternity. Making a man "man up" and be the "daddy" can be a risky business when the man is forced to support a child he doesn't want. Too many of those men then go on to injure or even kill the child. It just isn't worth it in MY humble opinion. If I were you, I would place the child for adoption or keep the child, and then stay away from the "alleged" father.

Answer: An amnio can be done to collect DNA, although it carries risk to the baby. Most often a DNA paternity test is done after the baby is born.
Of course, using math to figure out when the mother conceived can be helpful as well. But, if it is that close, a DNA test will need to be done.
Question: Is there such thing as getting a paternity test during the 2nd trimester? I am currently 22 weeks. And I need a paternity test immediately. It is an emergency. And I'm wondering if it's possible. Or if doctors just won't do it at this point because of the dangers.
Answer: You can do it BUT it can cause a miscarriage. Doctors do not recommend it.
Question: How do do-it-yourself paternity tests work? I've been reading up on paternity tests on the internet, and I saw a lot of ads for do-it-yourself paternity tests. How do they work? Do they send you a kit or something to collect samples with? Do they need a sample from you and the child, but not your partner? And how are they sure nothing happens to the samples along the way?
Answer: They do send you a kit with pretty simple instructions. You get a swab for the child and a swab for the alleged father. You rub them on the inside of the cheek and put them in a tube. You fill out a form, label the tubes and drop them in the mail. You get the results back in the mail. There is no need to test the mother because there is rarely any doubt she is the mother.
The part about making sure nothing happens to it... well the do it yourself kits do not have what is known as a "chain of custody" process so the results will not hold up in court. The only exception is that the results may be acceptable as evidence of a reasonable suspicion to have a judge order official DNA testing to disestablish paternity. If the do it yourself test results come back as a match then there is probably very little chance anything happened to the samples along the way. There is always a possibility something went amiss if the results come back excluding the father but there really wouldn't be any way to tell without another test. The reliability and security of the testing has always been good from what I have seen but I suppose it is possible for a mix up.
If you want results that stand up in court you will need to get the test done by someone else and you will have to make sure you get what is called a "chain of custody" test. These are usually a little more expensive.

Answer: If it is not court ordered and properly served he does not have to show up, BUT in some states, state agencies may be able to make him start paying child support if he refuses. Some states just have some screwed up laws and assign to much authority to agencies.
He should go if he wants to be a part of his child's life. He should just make sure that it is an accredited lab and that the proper chain of custody is followed.
And tell your brother to stop having sex if he isn't ready for kids.
Question: How do I go about getting a paternity test? I have serious reasons to believe the baby may not be mine. Everyone else sees it too and says I should have a paternity test. I mean everyone. Realistically there's a 50/50 shot, but I need to know if I should go for joint custody or wash my hands of the whole mess. I haven't signed anything but I believe she has listed me as the father. I haven't talked to her in several months but I know she is going to sue me for child support. If the baby is mine I will do what I have to do, but if not, I don't want to be responsible.

Answer: You will have to request a blood test. When she sues you, you will be assigned a public defender. Then request the test.

Answer: i dont think there are exceptions to the rule whichever way the baby was delivered. if your wife has been discharged then she is seen as fit to be able to look after her baby ( with the help of painkillers !!! ) all you can do is see if you can wing it and get an extra week from the raf compassionate leave or something but it wont be paternity leave so you might not get paid for it. ask the midwife or try the surestart website for new parents i cant promise you will get answer you need though. congratulations on your baby - happy days !!!
Question: How do you feel about mothers that want paternity testing done before the baby is born? I'm seeing these types of questions pop up more frequently. There are also numerous scams out there that can really rob people (taking the moms and alleged father's blood to find out paternity) FALSE.

Answer: If a guy was on here saying he had two women prego at the same time would you call him a skank or nasty? Probably not. If a guy said he'd had sex with two girls in one day he's a Playa.
Anyway, after the baby is born it's just a cheek swab. No more complicated than that. Also, really what sperm won the race isn't nearly as important as which guy is gonna man up. KWIM?
Question: How can the father and baby have a paternity tests and the results are inconclusive? The father of my daughter took a dna paternity test without me and the results were inconclusive. Now the lab has requested my boyfriend's father to come in and give a dna sample to clear this up.
The lab said that there was no problems with the sample. They said that the results were less than 85% and therefore need the paternal grandfather to come in for further testing. They also said that they looked at 15 different areas and tested the 15 areas 3 times and yielded the same response.
Answer: It may not have been a good enough sample, or his dna may be to close to hers to decide if he is the father so by having his father come in you will find the genes that actually came from him.
