Question: What happens if you leave to serve in the peace corps while in the middle of the foreign service process?
Essentially, I'm asking will I be able to stall my foreign service process while I serve in the Peace Corps? Or will I have to completely suspend the foreign service process that I've already started and start from scratch when I get back in 27 months from serving in the Peace Corps.
I heard a rumor that the Foreign Service will let people leave for Peace Corps service during the middle of their application and then start back right where they were in the process, without penalty, when they get back. Thoughts?
Answer: The Peace Corp has been initiated since 1963 during JFKs administration. You can not be deployed OS as a PC officer without a clearance from the US fed government on all foreign services matters. If you're implying whether you have a cross-agency role as well as being deployed officially as a PC officer well then this is based on the 'strictest of confidence' parameters, obviously!
What did you want to hear? Whether CIA agents are deployed as Peace Corp officers? Its much of a muchness when it comes to labels right?

Answer: The Mass.
But the Mass really begins when the priest celebrating that Mass enters the church and leaves the church.

Am I correct in believing that once you are in The Federal Court of Australia's Precinct, the Court protects you against the service of other Court matters?? I have to go to Court again and I believe that a process server will attempt to serve papers in a related matter whilst I am answering the request of teh court to attend.
Answer: Probably not. In the US, they can serve you anywhere they find you, including a courthouse. What would make a courthouse exempt? If not inside the building, they could serve you in the parking lot.
Question: What happens when a service of process is not good? If service of process is not good, what happens next? Does the defendant have to appear in court? Does the plaintiff have to serve again.

Question: What does Service of Process by Publication mean? My text book does explain what Service of Process by Publicaiton is. I have not had much luck finding information through google or wikipedia.

Answer: a lawsuit has been filed by plaintiff. due process rights (right to notice and opportunity to be heard--tell your side of things--require that a defendant be given notice of the lawsuit. the most desirable method of service i that a sheriff or other duly authorized person, give notice of the lawsuit by giving a copy of the lawsuit to the defendant by handing him a copy in person. sometimes the person sued cannot be found to personally serve the papers, either because the person is actively evading service, or simply uses no known legal address. in some cases, such as a person who wants a divorce or to obtain judgment for money owed, may proceed with the lawsuit using alternative service methods of service with the court's prior approval. one method of alternative service is to publish notice of the lawsuit in a local paper where the defendant/respondent is last known to live. if you look in the classified section of most newspapers, you will find a section where such notices are printed.

It says Field Office Processing Dates for CALIFORNIA SERVICE CENTER as of: June 30, 2009 and today is September 13th, 2009. So as of June 30th the processing file was January 18th, 2006. Answer: Just to confirm the other answers...yes, in CA, you can serve as your own agent for service of process. From the CA Secretary of State website at http://www.sos.ca.gov/business/llc/llc_f… "An agent is an individual (manager, member or any other person, whether or not affiliated with the company) who resides in California or a corporation designated by the limited liability company to accept service of process if the company is sued. The agent must agree to accept service of process on behalf of the company prior to designation."
Also, view the instructions for items 3&4 on the CA LLC form at http://www.sos.ca.gov/business/llc/forms… . But, note that your LLC can not be its own agent...it must be you (if you reside in CA) as an individual or another corporation (if register with the CA SOS).

Question: How would the military process "Don't Ask Don't tell" violaters back in the service? If the Senate repeals DADT next month. How would the service process people that were kicked out because of DADT back in the service, if they choose get back in? It is interesting because when they got kicked out they usually receive an honorable discharge with an RE-4 code, when they are discharged, which means while they got an honorable that makes then veteran like everybody else, the RE-4 prevents them getting back into any branch of the service. If the Senate repeals DADT, the problem with them getting back in would not be because there gay, but rather because of the RE-4 code. The military is not allowed to process RE-4 codes back in period, even if the RE-4 code was unjust because the old DADT policy. They would have go to the departement military records corrections in D.C. to get the RE-4 code changed, so a gay veteran trying to get back in would have to go through all those hoops just to get back in, which could take to 2 years for a decision. Please any prior service or current military please tell what think. Thank You!
Answer: they won't. All five Branches are overmanned and regardless of why they got out, it is nearly impossibel to get back in.. even if you have an RE 1 code.
also it is EXTREMLY doubtful the Military would ever retroactively change RE codes. don't forget.. codes are givcenm based on the regs AT THAT TIME. just because they change DOES NOT MEAN you are eligible for or will get an upgrade.

Answer: This question is not very direct and it is hard to answer. Are you an ISO of a company? If so many people start off with a 50/50 residual and the company may move them up as there portfolio grows. If you are just an affiliate, they usually earn anywhere from 5% to 20% of the residual. If you are just a salesmen then you usually receive anywhere form 50% to 100% of the commission after you pay off all the costs. Question: Who will be the "Agent for service of process"? I'm suing this corporation and listed name of the company along with the director's name as the plaintiff. The director is stating that he is NOT the "agent for service of process" and does not need to appear in court.

Answer: You need an attorney.
If you are suing a company, you are the plaintiff. You name the company as defendant.
The director or other officer of a corporation is usually not the registered agent of the corporation. You can find out who the registered agent is by reviewing the corporate documents at the office of Secretary of State in the state in which the corporation filed corporation documents.
I doubt that the court staff can assist you on this problem.
If you have not provided proof of service on the corporation before the court date, you will not be able to win the lawsuit.
Get the advice of your attorney before you go any further with this. If you do not consult an attorney, you are not serious about winning. This is not TV, this is real life.
If you do not have an attorney, use the lawyer referral service at your state's bar association website.
Question: Should service of process protect privacy? I used to work for a law firm; we always gave the process servers paperwork to be served in a sealed envelope to protect the privacy of individuals.
This doesn't happen now. Is service of process somehow exempt from providing a reasonable right to privacy? My neighbor was just served yesterday, although only his sister was home at the time. Apparently it was to advise him of a judgment, and an attached affidavit showed his name, (unlisted) phone number, and social security number. None of this was in an envelope, but available for anyone to see.
With identity theft becoming such a common problem, this certainly isn't a wise move. I can't see that it is ethical, but is this method of service really legal and approved?

Answer: In many states service is ineffective if it is in an envelope.
Question: How long is the MEPS process for prior service? I am guessing I will be doing the same thing I did a few years ago, but do they do EVERYTHING? I guess what I really want to know is if it is just as long of a process for prior service members, is it a whole day thing? Just a few hours?? Thanks!
Answer: When i went to MEPS in 07 there were 2 prior service enlisting again and they had to do it all over again. Long day
Question: Anyone familiar with NYC's Civil Service Exams process? I recently took a civil service exam for the city of New York. During the exam, we were asked if we would like to be considered for the "selective certification" process (this is when your application gets a higher priority if you speak a foreign language). I checked "yes" on the box but now I'm not so sure I speak enough Spanish to pass the certification. Is anyone familair with this certification process? I was wondering exactly how they test you (is it a written and/or oral exam??). And if you do not pass the certification are you automatically no longer considered for the position?? Any insight would be greatly appreciated!

Answer: The application is rather simple and easily completed but the inspectors are lazy and incompetent. Earlier this year we applied for water service and were told an inspection needed to be done first for availability. Upon return for the meter installation date we were told there wasn't a main line to provide service. Being american and knowing neighbors on two sides of our property had water I began complaining immediately and asking for higher authorities. After naming one of my ninongs, the barangay captain, a more qualified inspection was performed and meter installed 2 days later.

It's funny because each department has a general counsel's office to accept the thousands of lawsuits each department gets each year.
Just find the department at us.gov and type general counsel in the search field. This will give you the general contact information. Contact them and see if they have a field office located in the federal judicial district where you can serve them. They are very helpful in this regard. Otherwise you can serve them at the main office and send notice to the district court. Don't think the general council would file a 12 b (5) motion (insufficiency of service of process) if he got the papers himself.
