A legal notice that informs an individual that someone has brought a lawsuit against him or her. It includes the reasons for the suit, who the judge is and how long you have to answer the complaint. You can only get this from your local court.

Answer: It will go on his record, not yours, it won't raise your insurance or his since it's not a moving violation of any kind. It's basically a nothing ticket..............it wouldn't really even show on his record since they can't attach it to anyone's driving record since they wouldn't be able to prove who drove the truck. It's a simple ticket and 29 bucks is cheap compared to some places.
Question: What is the difference between a summons and a ticket? I got 2 summons: one for overdue inspection and the other for a suspended registration that I had no idea about. Answer: A summons means you must appear in court on the date specified on it and a ticket means you can pay the fine without going to court, in your case the officer was correct just take the proof to the judge and you should not even be fined.~
Question: What is the procedure for serving a summons? When someone comes to your home to serve a summons, do you actually have to accept it into your hand, or can they just leave it on your doorstep? THis is what happened to a friend; the summons was for her boyfriend and she refused to accept it. The server said since she was over 18 she had to accept it and left it on the doorstep. Is this considered "served" even though the person refused it? Or because they talked, is it considered served?
Answer: In Illinois and most states that is proper service. The moment a human opened the door and the process server went to give it into her hand, it was served.
Had a case were the person opened the door and refused to take the summons. Summons fell on porch and person left it there. Was able to go into court show that this person was aware of the summons, but left it on the porch. Judgment for my client.
The really bad thing about NOT accepting the summons is that the trial will go on WITHOUT the person being there. And in that case, since the person does not appear to defend them-self the side who served the summons wins. The only way to protest how the summons was served is to go into the court on the date specified on the summons and present your case, along with your complaint about the service of the summons. If the person does not show up, the court will never know that the summons had a problem.
Lots of people in the US are ignoring summons by creditors and mortgage lenders in the WRONG belief that if they ignore the summons the case goes away. It does not, the case continues and the other side gets to win 100% of the time.

Answer: You need a third party to do it, but it can be a friend or relative.

Answer: Just give it to him. It doesn't matter of they know about it or see you. As long as it's delivered to him then he's been served.
Question: My brother was served a summons for Capital One debt. What happens during the waiting period? He was served a summons from Capital One's Attorney. He wrote a letter for validation of the debt and sent it Certified Mail which they had received on 12/23. Does he just wait to see what their response is? If he should do anything, does filing for motion for disclosure or a Sworn Denial come into play anywhere in this situation? When should he file for this? Answer: The time he should have disputed the case, or asked for validation, was BEFORE they started the process to take him to court.
Once it gets to this point, it will be up to a judge what happens. He can go to court and plead his case. The judge will listen to both sides, and then determine a judgment (in all likely hood it will be in Capital ones favor. No one forced your brother to take out a credit card or to even use it.) Your brother will have to appear in court. He will have to pay capital one.
(if he has any sense he can call capital one and try and make a settlement offer. However they will probably require this to be paid in a lump sum, as he has a history of non payment)

Answer: A warrant can be issued compelling her testimony. She can be charged with contempt of court or maybe obstruction of justice. She should have gone, said I do not recall, and been done with it.

Answer: Laws on how a summons can be served and who can serve a summons vary from state to state. A response to summons is ALWAYS required. Otherwise, the plaintiff will win by default.
If the defendant can prove that the summons was not properly served according to the laws in his state, he might be able to have the plaintiff's default judgment overturned.

Answer: If the collector sued and won a judgment, they can then garnish wages. If the garnishment order goes to the wrong employer, that employer will return it to the court indicating you don't work there. It sounds like someone made an error in the paperwork.
Judgments fall under state law and the Fair Debt Collection Practice Act has nothing to do with it.
You may find yourself served with a subpeona requiring you to appear in court and fill out paperwork on your employment and assets. Be sure to show up and comply. Failure to appear could result in your arrest.

Answer: One of the questions on the application form for a Working Holiday visa is "Have you ever... been charged with any offence that is currently awaiting legal action?" and if he answered Yes, he had to provide full details - if he did so and was granted his visa, he should be OK. If he answered No, then he lied on his application and will be subject to visa cancellation if it shows up in the immigration computers.

Answer: You read the summons and it will tell you when your court date is. Sounds like you're looking at accomplice liability. Your penalties depend upon the state. Many states will put you in an informal type of probation where if you stay out of trouble, the case is dismissed. It's your get out of jail free card. If you're really scared, be smart and shell out the $1000-$1500 for a lawyer. Your girlfriend is foolish. Break up with her after this case is over. If you're going to be charged with something, make sure it's not for a donut sign, and a salt/pepper shaker.

Answer: You don't need a legal adviser. You can do this yourself. As someone else stated, don't plead guilty if the officer is not in court, instead request that the charges be dropped. If the officer is in court and you are guilty, you might as well admit it. You will be fined. Be very polite, respectful and humble when you are in court. You will be fine. Good luck.

Answer: Whatever agreement you currently have will stand until you go back to court. If he's allowed visitation currently he will continue with it unless he's been ordered not to. But if there is no agreement between you and he shows up unannounced you don't need to let him see the child. If this happens tell your lawyer.
