Question: How do you change your wage assignment to a different job? say they take money out of your check for child support from what if read about it, its called wage assignment. Answer: The child support division of the District Attorney's office handles wage assignments. You would need to see them and request this change. The office in my area accepts walk-ins.
This doesn't guarantee that they'd do this for you, however. It seems to me that if you work two jobs, it doesn't matter which paycheck is garnished.

Answer: If you have defaulted on a payday loan, they will sue you, garnish your wages, and or bank account if they succeed in getting a judgement against you.

Answer: Money from Social security cannot be garnished if that is the only source of income the person has.If you can prove he has other income,you may be able to garnish that.How is able to be self employed and still get disability?Sounds like he is hiding something from SS.As far as his disability,he will get no where near $2000.00 a month.

Answer: I believe that is to determine how much you make so they will know how much they can garnish if they should take you to court. Your creditors will look at everything before taking you to court to see if it's worth it and if they will get there money back.

Answer: Some debts are such that they can come after a spouse if the other cannot pay.
If they incurred this debt after they were married, SHE is in all likelihood on the hook for that debt. The only thing she may be able to adjust is the amount. Tell her NOT to blow off any hearing, and lay all her cards on the table. The courts will work with her...

Answer: Pros---you pay your child support on time without any late fees--you dont have to worry about writing a check and its all done without having to face the other parent.
Cons--if your and independant contractor your pay may change and may not be on a regular schedule--may forget to pay or just feel like not paying. This can add up with penalties. Some employers give you a limit on wage garnishments.So if you owe Child suport and taxes to the government that could be 2 strikes---you should speak to human resources and find out if its frowned upon.
when someone is ordered to pay child support its up to them to pay it. The District attorney is a resource to aid in getting child support. Depends on the state laws.

Answer: It depends on how fast child support contacts the employer with the court ordered support paperwork and how fast his jobs human resources responds to that order. Usually a month or so if they get on it right away, I would keep calling child support to see if the order was actually sent to his job....

Answer: Contact the court clerk in your area and ask if there is anything filed in your name.
If you find that there is a judgment then go to the court clerk and get a copy of the recorded judgment. Look over the service papers to see how it was they claimed you were served.
If you find they had "sewer served" you then take a copy of that judgment and speak to a lawyer about having the judgment vacated for improper service.
If there is no judgment then file a complaint with your Attorney General, the BBB, etc., and include the copy of that wage assignment email in with your complaint.
Question: What if there were a rule that the government would guaranteed a minimum wage job for all unemployed? What I mean is, that you would be able to sign up at a place and then you'd be given an assignment, like cleaning up the Downtown streets or wiping the stop signs clean or washing the sidewalks.
In other words, the government would pay every single person that walked thorugh this office, the minimum wage and then made the person do something that needs to be done for that money.

Fifteen years later, he's married, has four children. a good income, a five bedroom house, and an overall good life.
On day, while cashing a check, he learns his accounts have been frozen. Later that day, he gets served with paternity papers saying he has a child by the woman he dated in college and owes $85,000 in retroactive child support.
After losing his appeals, they take everything he has of value, including the family home and his retirement fund. Plus, 55% of his gross income is attached. He has to move his family into a two bedroom apartment, with his wife getting a job to help pay the rent.
Question: Would a court order different employment? My ex works as a bartender/waiter. He is currently about $20,000 behind in child support, medical/dental bills etc. Because he is paid mostly in tips and there isn't enough in his paycheck to cover his obligation, a wage assignment can't be placed into effect. Would a court ever order that he get a job where the state can attach his wages?
Answer: If he gets paid in tips then he is suppose to report it and use that/last tax year income as the base salary. There is no such thing as non wage assignment occupations for child support. You need to get a lawyer who will uncover his salary, bank accounts, non cash transactions, leases, real estate property, cars etc. and get the wage assignment or make him pay out of pocket. Point is if he had his own business, you can't make him get a job instead. You want to sue him and not get him certain jobs deemed easier for legal collections.

Answer: Huh? If I understand your question correctly. You were given an assignment lets say at $10.00 an hour. Then you didn't complete the assignment for whatever reason and they say you are only going to receive $7.00 an hour. No. They cannot do that and IT IS NOT legal. There have been a number of cases such as your situation. You need to contact the Better Business Bureau, Consumer Affairs, and of course your state Department of labor at 1-866-4US-WAGE.

It is not specified from whose salary the assignment will come.
The role Tom plays in the sentence is due mainly to the sentence's poor construction. It is nearly ambivalent but falls just to the side of Tom executing the demand, not executing the assignment. That fall is assisted greatly by "executed" being a very active verb and being more suited to "demand" than to "assignment." If there had been a comma following "Tom" though, it would not be ambivalent, but rather would definitively link "Tom" to the assignment.
***My wording above concerning Amy just brings her role to the real world in which she as the actor, or point of contact, for the provider of the salary would be under no requirement at all to perform the assignment. Except under a court order, or a contractural agreement to honor proper looking assignments, no employer is required to perform them. The wording was not meant to in any way suggest some other role than actor upon the demand.
Question: Payday loan wage garnish legal issue? I live in Illinois and took out a payday loan. I signed a voluntary wage assignment. I revoked a wage assignment last month (In Illinois, we can cancel it at anytime). Last week they sent me a letter that they will garnish my wage unless i pay up or send them a revoke letter. This pissed me off because i already sent them one. I sent them another one right away and all attached the notice of defense (certified mail). Today I got a letter from them stating that if i don't pay up they will tell my employer to garnish my wage. I talk to my employer and they said that if they it, the payroll office must comply and that I will have to take the payday loan company to court if i want the money back.
Can I sue the payday loan company if they ignore my revoke letter and still proceed with garnish my wage? I'm going through bankruptcy right now and they are fully aware of them but they are trying to break the law to get their money back.
Answer: A company cannot simply garnish your wages. Garnishment requires that they sue you, win, get a judgment, and then get a court to order a garnishment. If you are currently in bankruptcy (I assume that you did include the loan in your bankruptcy?) then they will not get that.
If you signed a voluntary wage assignment but have since entered bankruptcy then that too is invalid - you MAY NOT pay any creditor preferentially without the approval of the bankruptcy court.
I would advise you to have your bankruptcy lawyer write a letter to your employer. It is even possible that THEY could find themselves liable if they wrongfully honor the garnishment request.

Answer: The first "Minimum Wage" was established in 1938 at $0.25 an hour.
Not sure what "Average hourly wages" were however I know my Grandfather was making 40 cents an hour at his job in 1931 and worked 60 hours a week; from his diary he seemed to think that was pretty decent wages. He was working in a market in Louisville Kentucky at the time and selling bibles door to door on his days off.
((i double checked his diary and found my memory was way off. he said "40 cents" an hour; not 10 as I originally wrote))
