Answer: The US Immigration authorities will not accept any such affidavit which is not properly apostillised by the Ministry of External Affairs of India, New Delhi after authenticated by the Home Department/General Administration Department of the State from where it has been issued, secondly to get affidavit as proof or in place of actual birth certificate may not be acceptable by the US authorities. The birth certificate of the applicant should be one with his or her name mentioned on it & that too has to be Apostillised in the manner as mentioned above. To get copy of the proper birth certificate contact the Municipality of the District where the birth took place & was recorded. Otherwise with all the affidavit business you are preparing your papers/documents for US green-card, your case will be rejected for these very 'insufficient/incorrect documents' basis. Answer: No. It is not at all necessary to submit any such declaration or understanding. You can not get SBI staff rules and regulations unless you are a staff member of SBI.

Answer: In "British" law - meaning also most countries where it is still the basis for the rest of the laws - an affidavit for an illiterate person is taken directly from what they have said. It is 'transcribed' onto the paper and read to the person, page by page. The lawyer should have at least one - normally two - other people present with him/her and the person making the affidavit. As each page is read (the proper way to do it), or at the end (the not correct, but usual way to do it), the 'deponent' makes his/her mark/makes a thumbprint/signs their initials, as do the lawyer and the witnesses, on every page except the last. On the last page are the 'attestation' clauses. One says, "I, X, make this statement and have it read to me and swear it is true" - or whatever. The lawyer then witnesses the affidavit, with a clause that s/he read it to the deponent in the presence of two witnessses. The witnesses then sign - usually putting occupation and address (town, not necessarily street name and number), above or below similar clauses confirming they heard the affidavit read to the deponent and s/he agreeing to its contents and witnessed him/her 'marking'/signing it. That's enough for any Court. But they do require in most countries a lawyer or designated person be the 'main' witness, not just your next door neighbour. It's the same for wills of illiterate people.

You can get some free help that way because of the volume of business the agent gives to them. You need to figure out if the house was a life estate or joint tenancy or what have you.
