A responsive pleading that answers allegations made in the complaint. A counterclaim sets forth the defendant?s allegations against the plaintiff, as if the defendant were asking for a divorce in the first instance. The defendant is sometimes called the ?plaintiff-in-counterclaim? since he makes his initial claim in this pleading. Question: How do I contest absolute divorce papers? My ex had me served a Complaint for Absolute Divorce in Wake Co, NC. She did not put anything about debts, etc. How do I contest the divorce so that we go to court? She has not helped me at all financially with our debts, I have custody of our kids, and need to know how to do this without a lawyer. Do I just file an answer and counterclaim formatted like a complaint/petition? Or is there an actual form I need? I know everyone says I need a lawyer, and I agree and wish I could afford one. Unfortunetly I can't though. I have three children, work my a$$ off, don't receive child support, and don't have any help from ex on my over $500 in credit card bills I have every month. So, yes, I know..... I wish I did have a lawyer, but I don't! Any legal aide has been NO help! Why else would I be asking STRANGERS on yahoo for legal advice?!

Answer: lawyer is an necessary evil in this case. in my divorce,as much as i paid my lawyer,he did save me more money than i paid him. if you don't know answers for your questions,why would you want to do it w/o help?
