Desertion
One of several grounds for a fault divorce. Most states require the plaintiff to prove several of the following factors: 1) the defendant left the marital home for over one year; 2) the parties failed to agree to such departure; 3) the party who left failed to pay support; and 4) the reason for the departure was not caused by the plaintiff. Ask you lawyer which factors apply in your state. This claim is cumbersome and may not be worth the trouble.

Question: Can I claim a vehicle title if the owner is wanted for desertion? A Marine in my unit went UA/Awol and has been gone for more than the 30 days. He is now delcared a deserter. His vehicle was left behind and he has no intention of returning to base to claim anything he has left behind. I'm trying to get an answer to whether or not I can claim this vehicle?
Answer: Not without his signature on the title. I would take the matter up with your commanding officer and submit an affidavit as to why you feel entitled to the Marines personal property. If you have any documentation as to his desire to transfer ownership to you for example. A bill of sale, a will, anything. Without it, you've got no chance. The Corps will confiscate the vehicle of the accused and dispose of it according to regulations regarding personal property abandoned on Government property.

Question: How do soldiers who get jailed for desertion get treated? The guy on the news got 9 months yesterday in MCTC Colchester. Why do they keep him in the army after what happened. Should he not be in normal jail instead of army jail? Will it be tougher there for him compared to other people doing time?
Answer: The answer is that he will move to "D" Discharge wing of MCTC, which means that as well as serving his sentence he will also be re-settled as a civilian and receive training to find a job. He has to serve a sentence in a military prison as it is a military offence. Under the Armed forces act you can be sentenced up to 2 years at Colchester, for serious offences such as murder, rape and arson etc you will be moved to a civilian jail. As for how he is treated it will be no different to any other SUS (soldier under sentence)
Question: Can you work for the Fed or state if you're convicted felon from the military charged with desertion? Are there any wavers when applying for government jobs when you're a convicted felon?

All convicted felons are barred from possessing firearms, which means that you can't serve in any armed capacity.

Question: what are the laws of child desertion in iowa? My ex husband has not seen our children since the beginning of this year, he is supposed to see them every other weekend. He doesnt call them or have any contact at all. I do recieve child support only because it is garnished from him. I have no way of contacting him if need be and I was issued a no trespass order from the police due to him. So I am sitting here with my hands tied. I do take them where we are to meet for his weekend visits and he doesnt show. How long do I have to endure this from him? I dont have the money to take this to court but I dont want to be at fault. My question I guess is what ground do I stand on and what is the law of desertion in Iowa. I have looked to no avail on the web and I am very concerned with this. I believe this falls in the desertion catagory, however, I am not a legal representative. Please help. My kids dont even want to communicate with him or see him at this point(their choice)
Answer: Are you remarried, and have been for at least one year? If so, you MIGHT be able to have his parental rights ended if your new husband is willing to adopt the children. This is only a maybe, and only if your ex is willing to sign away his rights. You would, of course, no longer get child support from him.
The big problem with getting his rights severed is that, although he hasn't seen the children for several months, it needs to be at least a year of no contact. Another problem is that the courts consider his paying child support contact, even though the only reason he does so is because of the garnishment.
I'm sorry that your children have to go through this. I bet it breaks their hearts to get ready to go see their father and then he doesn't show up. Just make sure your kids know that it's not their fault that he doesn't show, and that he's the one with the problem, not them. I would suggest showing up with the kids at the location for the visitation exchange, but not letting the kids know that their father is supposed to pick them up. Wait 5-10 minutes, and when he doesn't show, go on with your plans for the weekend.
And remember, you've got the best end of the deal. You get to spend more time with your kids.

Question: What are the definitions for treason and desertion? What are the definitions for treason and desertion in relation to the military?
What are the same definitions for society?
Answer: in time of war, or other places where the national security is at risk, it would be aiding and abetting of actions that would benefit the enemy(s) desertion is leaving your post or command responsiblities with no intention to return. in the general society the answers are pretty much the same and would include such things as divulging corporate secrets ot the company competitors for financial gain or reward. the same is true of plagerism, the taking of someone elses work and claiming it to be your own original work, such as this answer in applying it to a school home work assignment

Question: What is the Punishment for Desertion in the Australian and British Armies?
Answer: The Royal Australian Corps of Military Police will pick you up.
From there, it's up to your CO - chances are you'll be subjected to a military trial. You may receive a discharge for bad conduct (as we do not like hanging onto soldiers who are a liability), or may end up spending time at the military prison (also run by the RACMP - angry guys with red berets) if they think you're salvagable.

Question: Is it possible to return to the army after an awol or desertion discharge?
it was over 5 yrs there was no war yet
i was allready chaptered and was told by the counslers that after two years i may be eliiglble for reinstatement
Answer: The best way to find out is to look at your "RE code" on your seperation document (DD-214). If you have a 1 or 2 it won't be a problem but I'm sure you probably have a 4 which means you are most likely not reenlistable into any aremed forces. Your best bet is to bring your DD-214 to a recruiter and ask them.. The Army and Marines need everyone they can get right now.
Question: military desertion rate is highest since the 1980's, even with a volunteer force. what is the cause? many people on this forum have talked about the military's commitment to it's mission. many conservatives have used this rationale to conclude that our military is behind it's leaders. i think that the desertion rate may be an indicator of a growing disenchantment with the administration's unyielding plans. perhaps, this is just the tip of the iceberg.
Answer: Just maybe prople are beginning to realize WE ARE NOT IN A WAR. The United States invaded a soverign nation.
Question: MY desertion about water resouer and desalination technology can you gave me information about exprimant? can you help me for what expriment can i do it in this final desertation
Answer: Please ignore the person who criticised your spelling. I understand that not everyone asking questions here has English as a first language.
I am assuming your dissertation will be on water resources and desalination technology. I am not sure what type of experiment can be done on a small scale. What does come to mind is that there are a number of ways of getting clean water out of contaminated water, distillation, reverse osmosis, filtration. They usually require some power so you could investigate what is the lowest power method for different quantities of output or different types of contamination. What is acceptable for different uses? For instance partially desalinated water may be acceptable for some food crops but unacceptable for drinking.

Question: Which branch has the highest desertion rate? And how many actually get caught?

Question: does desertion or awol ever show up in background checks? known people who went their whole lives and never had a problem getting work, financing, credit - anything..though the military told them they would never be able to even get a job.
and one of them is a Firefighter
I should have mentioned that though they may have deserted or gone AWOL, they got it sorted out and do not have any warrants. But as far as their military records go they probably have all that info.
Answer: Yes it will show up. The military will notify all agencies to track them down. Just like a criminal. The government will always put an award out for your arrest to family, friends and fellow military persons. A background check as well as credit check will definitely show this as long as they are convicted of the crime. Just like any other crime it may or may not effect your ability to get hired. I am a Firefighter/Paramedic with vet status. Our dept. hasn't hired anyone in 10 years who wasn't in the military. Your friend must have been honorably discharged.
