The Court DECIDES which cases on the DOCKET to hear. All Cases are given numbers and put on the Court Docket. A DOCKET are all the CASES to be Heard by the Supreme Court or any Court for that matter.
In Higher Courts of the State or in the Supreme Court for the State or the US, there are different categories of the Cases on the Docket to be heard. Certain Categories have precedence over others.
The 2nd url I have given under Source is very good. It gives examples of cases in States that are heard and why that particular Case on the Docket was chosen to be heard. Say a Court Docket had a thousand cases to be heard. It would have to be decided how many in each category would be heard and in what order. Since there are so many cases to be heard, sometimes it can be months or a couple years before a case that is on the docket comes up to be heard.
Question: is it legal to pen someones name onto a court docket minutes before a hearing? i was summoned to court in texas, the case read dfps vs. my ex-wife. minutes before the hearing began the atty for the dfps penned my name in blue ink to the docket. i had no time to get an atty as I was only being summoned to testify. is this legal. If your a lawyer your advise would be greatly appreciated. if not if you have knowledge of a case please send me the case name so i can research what the outcome was. thank you all.
Answer: In order to be made a party to a case (as a defendant) you have to be properly served with notice and the complaint under your state's rules. Simply putting someone's name on a docket is not proper service. A person authorized to serve complaints needs to hand you the complaint, or leave it at your last known address. If that hasn't happened, you aren't a party to the case yet.
It's possible, however, that what you thought was a summons to testify was actually a summons stating that you were a defendant in the case. Read that document very carefully.
You don't say anything about what happened in court that day. If there is some order or judgment in place, or you are now being sued for a substantial sum of money, you should probably get a lawyer ASAP.
