Question: How does a State Bar investigator view a claim of legal malpractice? I want to present a legal malpractice claim to the State Bar regarding a personal injury (non-auto) claim. I plan to type my papers and provide the exhibts including all correspondance with my attorney. When the State Bar investigator gets the papers, what does he or she look for? What steps do they take? How does it work?
Answer: How does a State Bar investigator view a claim of legal malpractice?
Seriously.
Question: How much will I need to pay in legal malpractice insurance? I'm a recent law grad sitting for the bar in July. I'm trying to shop around for a quote for legal malpractice, but don't want to go through the time of getting a full quote (especially since I'm not licensed yet).
I'd be looking for coverage for a solo practitioner, general practice, recent grad. Does anyone have any clue what that would run me, either from personal experience or whatever?
Answer: Depends on what state you're in, and your limits, but the cheapest way to do it, is adding the professional liability onto a BOP policy that also covers your "stuff" and general liability - the whole shebang should run you $1000, depending on which state you are in.

Question: I filed a Legal Malpractice, because I could not get an attorney in Fresno, CA. How can I get advice? I was told by 3 attorneys that I should file a Malpractice against an attorney, but none would handle it. I tried Attorney Referrals, and Prepaid Legal Services, but their closest one is over 300 miles away. Apparently he has no malpractice insurance, and has put all his assets in his spouse's name, so there is no money in it for them.
Does anyone know where I can get information to help me handle my own case. I'm willing to pay.
I would appreciate any advice.
Answer: I would first file a complaint with the California Bar. If your complaint has any grounds, the Bar will take disciplinary action against this attorney, and may even order him to make restitution to you, depending on the facts of the case.
While a complaint may not help you monetarily, it will eventually help you should you decide to file a lawsuit.
Question: how can i report legal malpractice in california? how can i report my attorney without hiring a legal malpractice lawyer? and how can this affect my current case?
Answer: First, if you are unhappy with your legal representation, you should find new legal representation. I don't understand why would complain about your attorney, yet you still haven't fired him or her.
Second, you can file a complaint with the State Bar of California if you are believe your attorney has violated an ethical standard imposed upon attorneys licensed in California. Keep in mind that the State Bar of California cannot do anything if you are simply unhappy with your attorney or if you had a disagreement with your attorney. A violation of the Rules of Professional Conduct and/or the State Bar Act is required.
The State Bar of California provides a complaint form you can use. They also provide a toll-free number you can use to ask more questions. A link to the complaint form, the toll-free phone number, and other information regarding the complaint process can be found at the link below.

Question: What is legal (regarding lawyers) malpractice? Does NM protect its' citizens from legal malpractice? What if the malpractice is the other party's counsel, but their violations hurt you and your family?
Answer: That's not malpractice that's just a law suit. You can't make a claim for malpractice against someone who you didn't hire.
But depending on what the violation is and how it affected you will depend on what kind of actions you can take.
Question: Do lawyers that specialize in a legal malpractice work on a contingency basis? If Yes, how do you find them?
Answer: although Jay makes some great points about this process and covers it pretty well beware.............
almost all attorneys who work on a contingency basis due so for their "fee" only and regardless of win or lose you are still charged ALL out of pocket expenses. these expenses win or lose can add up rather quickly and can include but are not limited to.....
copy fees, phone expenses, travel & meals while traveling, court filing fees, serving fees, mediation fees, deposition fees, transcription fees etcetera...etcetera...etcetera.
if you seek legal counsel read the contract carefully and be aware of what you will owe out of your pocket as well as out of any settlement.
attorneys rarely work for free and they do not always believe you will win before they take your case, they simply have to believe they won't lose any money doing so....

Question: Alabama - Are there ANY legal malpractice attorneys "for the plaintiff" anywhere licensed in Alabama? I have been in search of an attorney that handles legal malpractice cases in Alabama. Even if they practice out of state and licensed in Alabama. Since this is a "high-profile" with multiple charges case it seems no one wants to take it. As of now I am sending all the info to the attorney generals office, local and state. They have already told me I have grounds to file suit and also for civil and criminal charges. The lawyer referral services have sent me to attorneys that are not willing to take this case. Anyone have any ideas or referrals? I would appreciate any help. I have already been through all the resources available on the internet (I think?) The local and state bar, you name it... If you are an attorney I would not take it as a "solicitation" if you would contact me via reply post.
Answer: Professional ethics guidelines preclude me from saying who you should contact with a situation like this on a public message board. However, I can without compunction tell you that if you are ever in need of a legal referral or legal counseling the American Bar Association has a locator and referral service which you can find at this site:
http://www.abanet.org/lawyerlocator/sear…
This site can be extremely helpful especially if you choose the option to search for ABA certified(i.e. professionally certified lawyers from ABA approved law schools). Good luck
Question: I can't find an attorney who is willing to take a legal malpractice case, called over 25 & NC Lawyer Ref.? I have called the NC Lawyers Ref. and the State Bar. No one will take this case--stating they (lawyers) will not file a suit against another attorney out of professional courtesy. Who or where do I go from here?
Answer: There is usually no shortage of lawyers willing to take such cases. Maybe you have a poor case.
Question: Do I have a legal malpractice case? With the help of the same lawyer I bought and sold a business. I have been sued for, breach of fiduciary duty , conversion and fraudulant transfer of funds. I have talked to a few lawyers briefly about it and none have taken the case, one even said the liability would be to high. I am out 200 thou. I thought lawyers had a to provide a certian standard of care. I don't think I could have gotten myself sued this bad if I had represented myself. If anyone out there can help I would love to hear your idea's!
Answer: The only thing I can tell you is contact the bar association and try to get a lawyer to sue the prior lawyer.
