Question: Is there such a thing as a pre-nuptial agreement for before you buy a property together? My partner and I have had disasterous previous relationships that have effected us financially so this time before we buy a house together we want to make sure we have paperwork/contract that makes it clear what we bring into the relationship we take out and then split 50/50 if things didn't work out. Like a pre-nuptial but we are not married? Can anyone advise please?

Answer: Both of you really should have your own attorneys for this. If an attorney tells you that he or she can do it for both of you... find another attorney. You also need to make sure Indiana allows postnups (they probably do). This is something very serious. You shouldn't think in terms of "cheaply", you should think about it in terms of "making sure it's done right". If you make a mistake doing it yourself, you're probably going to be bound by that mistake, but... if your attorney makes the mistake... at least you have a recourse (malpractice).
Question: How do I go about getting a post nuptial agreement with my husband? I don't feel like having to pay a lawyer or anything. I just want to know if we write up an agreement and both sign it, then have it signed by a witness, and then get it notarized, while that be sufficient? We live in Texas.
Answer: It would probably hold up in most courts, unless anything written in there somehow and agreed to is illegal and you don't know it.
The problem with not using an attorney is that, if this agreement ever needs to be brought up, chances are there are problems of some sort and whoever is most pissed off will run to an attorney to see how it can be challenged. And I'd guarantee it will be challangeable somehow.

The divorce courts have the last word in the division of all matrimonial property and would ignore any pre-nuptial agreement if they thought that it was in any way unreasonable to either of the parties involved, particularly regarding to the maintenance and housing of children. For example, regardless of whose name a couple’s property is in, a court may order it to be transferred to the other. This applies to all property that is owned seperately or jointly. There is no statutory provision for such agreements at all.

Answer: No, you mean a pre-nuptial agreement. If you do a post-nuptual agreement, that means AFTER you are married, whereas "PRE" means the agreement you reach before you are married.

A prenup ensures both parties know exactly where they stand, which is a good way to start a marriage. People will argue that asking for a prenup indicates you don't trust the person you are going to marry. Since (in the USA) half the marriages end in divorce, its practical to be prepared. If anything, they can be a tool to help you better understand the person you are going to marry and the state of matrimony.

Answer: Check with your parish priest to see their policy on allowing visiting priests - they may have to concelebrate. When we got married, we had two additional priests along with the home parish one.

Answer: Yes. We have a requirement of a Kethuba which is a pre-nup. It states the basic conditions for any divorce settlement. While one is free to mention any amount in this document, the European Jews set a minimum amount of 200 Reichsthallers as a settlement amount in the middle ages. The settlement amount is one of 10 requirements a husband has towards his wife in Judaism.

Answer: The "forever" is unrealistic, and it sounds like those that refuse to sign do have a fear of ending up with nothing if the relationship does end.
Make sure the agreement is fair and doesn't leave her with nothing. Assets gained as a couple should be split...her personal accounts should remain so. If the agreement is all about you and what she won't get if the marriage ends, then it does come across as rather cold and as if you expect things to end and fear she'll try to take you to the cleaners (not exactly something flattering to imply about the woman you're considering marrying).

Answer: ANY legal agreement must be entered by ALL parties being in sound mental health (and not under duress).
If that condition was provably not observed, the agreement is null and void.
