Privilege
Refers to evidence based on private communications made within legally recognized ?confidential relationships,? such as marriage, attorney-client, patient-psychiatrist, and priest-penitent. It also includes the privilege against ?self incrimination? which can be asserted by a party accused of adultery where adultery is considered a crime. Under the rules of evidence, matters are excluded, no matter how relevant to the case, if obtained through these confidential relationships. The rules are technical and vary state to state. Consult your lawyer.
Question: can mother move out of Missouri if she has primary and physical custody? My husband only has visitation rights with his 11 yr old daughter according to court he gets her every sunday and every other friday and saturday and gets her 2 weeks in june and july and one week in august and pays child support except for june july and august. So heres the deal back in 2004 we had her held in contempt for violating the visitation rights and she agreed to let my husband have her for 50% of the time and drop the child support if he dropped the comtempt charge, so he agreed, but now the state is going after him for child support and we believe the mother enforced it so now were stuck with a child support payment. We have learned the mother is moving but were not sure that it's out of state or not but she is going to school for a new career and she plans on going to texas for a week right after school lets out and she is also planning to move at the same time and she told her daughter not to tell anybody that they were moving. So any advice we be appreciated cause we really need it my husband is a good father and he does get her 15 days out of the month.
Here's the deal my husband called the lawyer the next day saying she would agree to 50/50 custody and drop the child support and the lawyer told him he would take care of it that he didn't have to show up to court here we are 4 yrs later with problems and now the lawyer won't fix the problem
The lawyer won't call us back and when he goes to his office he's never there I guess were gonna have to get another lawyer
Answer: She can't just up and move the child away from the father. The CHILD has a right to visitation with the Dad and obviously moving would strain that. If she does move, he can petition the court and I have actually seen a Judge make a woman move back.
When he dropped the contempt, did they not draw up new papers stating no child support?
Question: Can My Ex-husband who has primary custody of my children move out of state without a letter from the judge? Almost two years ago, I was incarcerated and during the time I was in jail, my ex-husband who has primary physical custody of my children them out of state. I was released and have been sober for almost two years..My ex- insist that I be the one to move to Washington from Calif if I want to be with my boys..They are 15/16 and my younger one is having problems with his step mom and his dad..Could I just send him a plane ticket or would I face criminal charges?
Answer: i don't think he can do that but you should consult with a lawyer ASAP.
Question: What kind of custody arrangement is best suited for this example? My ex moved to another state. She works nights and doesn't have weekends off and I work days 9-5 and have weekends off. I was granted primary physical custody of our son. What kind of arrangement is best suited if I have him during the weekdays and weekends off and she lives in another state 60 miles and works nights and weekends?
Answer: That's a long drive for a daytime baby sitter, but it is their mom. if the kids not in school yet and the mother's willing to lose sleepy time, have her keep the kid while your at work and you hav the kid nights and weekends. Meeting you half way to get the kid will help and if time lines and job locations match up work out a schedule. give her the kid when she has vacation time to make up for the lost weekend time, for the kids sake not hers.
Question: Is it incorrect to say that the attorney-client privilege applies to an attorney? In legal phrasing, I'm thinking the attorney-client privilege applies to the client, and that a duty of confidentiality then applies to the attorney.
However, can it also be said that the attorney-client privilege applies to the attorney? Or does the attorney only have a duty of confidentiality and not a privilege?
Answer: An attorney is bound by the Attorney/client privilege where a client is not, a lawyer has a duty, except in extreme cases to maintain that confidentiality.~

Question: Why do Orthodox Jewish women wear a wig, to give their husbands privilege? But the men don't cover any part of themselves from other people, and give their wives special privilege? Why are only men allowed to see their women's hair, but everyone can see the men's hair?
Answer: You seem to think orthodox women are some poor supressed victims of men. I do not know one single orthodox woman who covers her hair for her man but because she herself wants to cover it. It's a Tznius thing as hair is private. She does this, because she understands herself as something value, she's so much value that not everyone is allowed to see speccial parts of her body uncovered (this applies to ellbows, shoulders or knees as well).
Men by the way cover their head as well if they're orthodox with a hat, Kippa or Baseballcap.
Question: When is my white male privilege going to start kicking in? I live in a 400 square foot studio apartment, drive a twenty year old car, work at a dead-end job, and have no savings. When is my white male privilege benefits going to start kicking in?...
Answer: All white heterosexual males live in castles with servants and things. Right, Trevor?
Question: How are white privilege and male privilege similar/different? What are other forms of privilege that are similar?
Answer: Racial autobiography, self-narratives on how one learned about the idea of race, has been underutilized as a tool to familiarize and orient students in the process of critical inquiry for nursing research. The aims of this article are to explore how racial autoethnography: repositions students to effect an epistemological change, challenges dominant ideology, and functions as a link between the student and critical theories for use in nursing research. Students engage in and share reflective narrative about a variety of instructional materials used in the course. Reflective narratives are presented in a framework that addresses white racial identity development.

Question: Is alcohol consumption a privilege or is it a right? I have a (tiny) group on Facebook, but before I post, I want to know the facts. Is alcohol consumption by adults of legal age a privilege or is it a right? Driving is a privilege and not a right, so I was wondering the descrepencies there.
Answer: Good point. It can't be a right since the 21st Amendment allows states to outlaw sale of alcohol. http://en.wikipedia.org/wiki/Repeal_of_prohibition
Consumption is prohibited in the USA under age 21 by a web of state laws coerced by a federal law.
In other countries, there are different rules. Nearly all countries allow consumption of alcohol by minors at home except, perhaps, to the extent that it is abusive.
In the USA, even during Prohibition, consumption of SACRAMENTAL WINE was allowed. This suggests a recognition that there is a right to consume it.
Question: Is education a right like free speech or a privilege like driving? A right meaning, you are entitled to go to school no matter what.
A privilege meaning, it's there to be taken advantage of, if abused, you lose it.
Answer: Privilege
Question: Have we returned to the days of class and privilege? It seems like the world today is clearly split between rich and poor. The media is preoccupied with the lives of celebs, socialites, royal families and aristocrats. Luxury stuff are the most desired of all things.
No one cares to be middle class anymore, they want to be rich.
Are we back to the days of class and privilege? Are we back to the days of aristocrats?
Answer: i do think that we now have a subculture that is much more prevalent than in any time before....those of generational benefits scroungers. But other than that i think there has always been a class system, but with the intorduction of personal debt, the lottery, increased gambling etc the lines are far more blurred. One can have money with out having class!
Question: is police or fire department protection in USA a right or a privilege? how about good roads and highways?..or virus vaccinations to the population to stop a deadly virus spreading amongst the people..is that a right or a privilege?
Answer: All those items which you mention are a privilege. Rights are things inherent to your nature, something you are born with...having been born in the United States of America and not the U.S.S.R. The whole world wants what we enjoy and most here don't even know they have something special, thus they throw it away or disgrace it.
According to the Constitution, the Government is bound to "insure domestic Tranquility, provide for the common defence, promote the general Welfare". However, this does not cover Police and Fire Protection which are affairs of each State and even they are required to provide them for you. "promote general Welfare" certainly does not mean that every person is entitled to welfare or cradle to grave government assistance.
General Welfare is in reference to the Nation and not the people. The United States Constitution contains two references to "the General Welfare", one occurring in the Preamble and the other in the Taxing and Spending Clause. However, it is only the latter that is referred to as the "General Welfare Clause" of this document. Unlike most General Welfare clauses, however, the clause in the U.S. Constitution has been interpreted as a limitation on the power of the United States Congress to use its powers of taxing and spending. The narrow construction of the General welfare Clause is atypical when compared to similar clauses in most State constitutions, and many constitutions of other countries.
As for those pesky potholes, those are a privilege too, right along with the roads. Constitution of the United States, Art. 1 Section 8, "To establish Post Offices and post Roads;". Note it does not say paved roads without potholes nor interstate highways.
Virus Vaccines and protection against something that is already here, well that is a privilege too. Thus it would also fall under the "general Welfare" clause.
United States v. Butler the Supreme Court did limit the power to spending for matters affecting only the national welfare. The Court wrote:
"[T]he [General Welfare] clause confers a power separate and distinct from those later enumerated, is not restricted in meaning by the grant of them, and Congress consequently has a substantive power to tax and to appropriate, limited only by the requirement that it shall be exercised to provide for the general welfare of the United States. … It results that the power of Congress to authorize expenditure of public moneys for public purposes is not limited by the direct grants of legislative power found in the Constitution. … But the adoption of the broader construction leaves the power to spend subject to limitations. … [T]he powers of taxation and appropriation extend only to matters of national, as distinguished from local, welfare."
Question: Is a university education a right or a privilege? And if it's a privilege, why shouldn't graduates pay for it?
dave g - perhaps if more people understood media and politics they wouldn't be so swayed by whatever they read in the Daily Hate and the Terrorgraph.
Thanks for some great answers - I'll come back with some responses later!
Answer: Hi Skidoo
It is my view that university education is a right for the top 2% of academics.
However, we now have the attitude that 50% of our young will go to university. Many of the courses have been dumbed down to cater for the less able student. The whole charade was financially unsustainable.
We seem to be following the French model in order to disguise the true level of unemployment and conning our young people along the way.
Best wishes.

Question: In your opinion, is health care a basic right or a privilege? In your opinion, is health care a basic right or a privilege?
Answer: Neither. But it makes economic sense for us to figure out how to provide basic health care for our citizens. Exorbitant health care costs divert too much moola away from places where we could better use the money.
Question: Are we witnessing a return of class and privilege? It seems like most of the people that I know in the high income bracket believe that they are somehow part of this global community that exceeds even the connection they have with their own country. They relate more with the rich of other nations than with the middle and working class of their own countries. The world seems to be their playground and they live life as if it is an episode of Sex and the City. This is especially true of rich people from third world countries. Are we witnessing a slow return of social classes and wealth based on privilege? I mean the mass marketing of socialites like Paris Hilton and Nicole Richie is startling.
Your thoughts...
Answer: I think that many are embracing the concept of One World, One Culture. If we can somehow break down the cultural barriers which create an us against them mentality, we have a chance to achieve a worldcentric ethos.
More of the ones with means have the resources to attempt to implement this change, and they are putting their dollars to work in this endeavor.
To me, the concept of class and privilege is slowly transforming into an opportunity to initiate positive change.
Or, maybe my rose colored glasses are skewing my perceptions. I hope not.
