Question: how long will it take for and I130 applicant to receive visa? My Mother is a US citizen, on August 17th, 2009 she applied for my married brother (over 21). We received the approval notice on January 12,2010 ( 5months later). The priority date on the notice says August 12, 2009. the case status on immigration website shows "document production/ oath ceremony" which is the last step.how long does my brother have to wait until he receives his visa considering the country of his residence is Iran. Answer: At the moment, the priority date for F3 petitions, married children of US citizens is 1 May 2001, including Iranians. That means that only petitions in this category filed on or before that date are now valid for use, or current. The priority date is based on the date the petition was actually filed, not the approval date. All the approved petition means at the moment, is that it will be sent to the National Visa Center until it's current. They'll contact your family once it gets close. However, you can follow the progress of the priority date, which changes from month to month, by going to travel.state.gov and looking at the Visa Bulletin.
