Answer: In most states they last a year.

Answer: I don't mean to be a bit** BUT..... Are you ready to take over your daughter? If so, then give her a choice-- her new boyfriend con and you say nothing IF she agrees to let your daughter come to live with you or... you just keep you eye on the situation and if all is ok then let it alone.

Answer: In some situations, lawyers are the only ones entitled to these sorts of specific cases. Because of the nature of the legal system, the docket is subject to change..... hope that helps

Answer: WAY over the top and ridiculous. you dont have to cut off everyone whos female just because your in a relationship, thats crazy.

Answer: If the person is already receiving retirement, their spouse usually starts getting their cut about 2 months after the order is signed by the judge. It all depends on whether, prior to submitting the order to the court, the parties had run it by the pension plan administrator and made sure it complied with their rules. Sometimes you get it sooner, sometimes it takes submitting an amended order to the court.

Answer: Some time it pays to get your custody done by a Legal Document Preparer (LDP) and not a Lawyer. A LDP can usually do it cheaper because they only prepare the paper work and do not go to court. That is where lawyers charge you the most court appearances. Look out for a lawyer padding his bill by wanting to make an appearance. To be fair your state may make it procedurally necessary to go in front of a judge even in a no contest situation as a safe guard against fraud or duress in the custody process. It may pay to consult another attorney or go online to the National Association of Legal Document Preparer (NALDP) to find a LDP who may be able to answer your specific question.

Answer: He has to wait until he retires to get it. Why shouldn't you have to wait too? It doesn't matter what your order says. If he isn't getting any retirement payments how do you expect him to give any to you? The only exception may be if the two of you agree that he will give you one lump sum payment to represent your share of his future retirement in exchange for you having no future claim to it. That way if he dies right after retirement--you win!

Answer: Can he do it? yes.. but will the Judge honor it.. Hell, NO.. like U said.. just cuz he is sick.. he is abandoning his daughter.. they are for life.. !!!!!! Question: How can I get Domestic Relations in Motgomery County, PA to enforce my case?!? I am owed nearly $20k for one child who just turned 10. My ex jumps from state to state and consistently quits his job to avoid paying me or any of the other 3 kids he has. Everytime I conctact them it is an excuse. Answer: Find a good lawyer who is willing to take the case on contingency. The PA Bar Assoc should have a referral service for that. Otherwise, you could petition the court for full custody without visitation and cease any further support demands. That way at least he won't have any claim to the child. Then you can focus on your life and your child's life without any influence from your ex. You could even choose to forget about the back payments at that point since it will probably cost you at least $7,000 just to collect it. Good luck

Answer: you can try.... but you'd be better off contacting Domestic Relations and having them re-issue the check.

Answer: Then she should report her attorney to the Bar Association, Grievance Committee and have specifics! Then, she should get another attorney IMMEDIATELY. Do NOT go in there without an attorney... she will get crucified and only have herself to blame! Please advise her against representing herself for her own good! After several of my friends got screwed after they had spoken with me and did not listen. Those that paid attention and told the judge to please give them time ot get an attorney resulted better off! She CANNOT afford to go alone!

Answer: QDRO's are very complicated. Even some lawyers have other lawyers with specialized knowledge prepare these. Doing your own QDRO is like doing your own root canal. Even though it is a 50/50 split, the specifics of how it is to be paid and when can be quite complex. Spending the $750 now could save you many thousands years from now.

Answer: A QDRO is completed as a part of the settlement. It is useful for splitting retirement assets between the parties and avoiding tax consequences at the time of the transfer. It is not recorded, but may be public record if the state and county where you are located requires it to be an official part of the record.
