Answer: I think your best bet would be to see a doctor before you do anything. They may recommend some kind of therapy to help with your fear. That way, at least you would have some medical documentation to back you up when you tell the courts. I would imagine, in extreme cases, they may let you say your piece via a video camera...like with children. It is best you seek some therapy first though. We can all sit here and say 'just get on with it'...but if you have never had to go to court, you can't really say anything at all.
I had to give evidence a couple of years back, and, like you , I too was scared stiff about having to go. Really really petrified, especially when they showed me around the court room and told me where the guy who was being prosecuted was going to sit. Really really felt sick and shaky. But, once I got in there, I just had to ignore everyone else, and focus on the bad thing he had done, which made me angry and determined for justice. It worked, as he was sentenced.
Just think positively. Get some help, and focus on how better you will feel, when the bad guy gets his comeuppance thanks to you. Good luck!

If we judge someone and decide not to interact with them because of our judgement (that could be false), we never get to know how that person really is.
Most of the time I've noticed that my friends have judged other people and to me, it seemed like my friends were jealous of that person.

Question: What is a Magistrate Judge and how is it different from a regular Judge? This is for Divorce Court. I've been referred to a Magistrate Judge first. Is this better for my case?
Answer: A Magistrate Judge is a lower level judge. It's neither better or worse for your case, but one of the jobs of the Magistrate is to see if he can help you settle the differences between you and your spouse. However, he does not have the power to force an agreement upon you. It's better in the sense that it's faster. I guess it's also better because he's a neutral person who will examine every issue between the two of you and try to find a way to resolve each issue. Even if you only solve some of the issues, you're better off than a lengthy trial on everything in a divorce court.
Question: How would one address a judge in a letter for a character statement? I am writting a letter of character for someone I know and am unsure as to how best to address the judge.
Would it be best to write Dear Judge, or Dear Sir or Madam? Any other opinions?

Answer: To be honest with you, the second to last sentence you wrote is an excellent start. Humility is very important since it shows you are willing to accept your punishment and are attempting to straighten your life out as a consequence.
Include the date of the offense, date of the conviction, sentence given. Next include how you have completed the terms of the sentence (plea agreement), and the reasons why you would like the sentence reduced. It might be a good idea to include what your future plans are as well. Be straightforward, but professional. Use a spell checker and a grammer checker too. Misspelling words or using wrong words (your you're, they're there - both of which drive me absolutely insane...) destroys the credibility your argument needs and builds by detailing your actions.

Question: How to write a character letter to a judge who is doing the sentencing? I am writing a character letter to a judge who will be sentencing one of my friends. He was involved in an accidental hunting accident. According to the judge the sentence for involuntary manslaughter can go anywhere from 0-20 years.The main purpose of the letter is to get him a lower sentencing. How do I start such a letter to a judge?
Answer: First you must address the judge as The Honorable (full name)_____.
Then Dear Judge (last name and title ; if any such as Chief Judge)__________. Then state the purpose of your communication (name of defendant and this a letter in support of that person). Then state how and why (under what circumstances you have known this person : how (and how long), what , why ,where, etc. Next paragraph explain describe the positive activities the defendant has engaged in, and include any public service (PTA, Boy Scouts. etc.) or how the community would "miss" his contributions.
Next explain, how in your opinion, that society would not be served by incarceration and then ask the court for (or probation; suspended sentence, or whatever you "want" to ask for; or simply "leniency" ) You need to state what it is you are hoping for. Then explain why you think this event(such as) " a once in a lifetime" mistake in judgment and that the defendant is not a danger to society.. If you know, you should state any remorse your friend feels for the event and how you know this. Include your remorse for the victim and the family.
Thank the judge for reading your letter. And (if you wish) offer to be present at the sentencing hearing. (then your signature).
DO NOTS: blame the victim the cops, witnesses etc.; do not explain the event (that was already done in court, you will be insulting the courts intelligence and the ruling); do not tell (or imply) the court they were wrong; do not state anything you do not know first hand (unless you indicate the reliable source); do not embellish or fabricate (Judges "crap detectors really work well and that negate your letter by impacting your credibility and you will do more harm than good); do not use "informal" language or slang;
DO "type" (not handwritten) the letter and use good paper and address it correctly (with titles) and full address including the Chamber. Do include your full contact information including your phone number. Hand sign and date your signature. My sympathies to all involved in this tragedy.

Answer: No one is going to do your homework for you. Go to a court and see.
Bailiff calls court to order by, "Hear ye, hear ye, the court is now in session." Actually may tell people to stand and once judge is seated, then they sit.
Judge asks prosecution if they are ready. It is prosecution or plaintiff's responsibility to go forth and to prove a case. The defense then can object stating what objections are as prosecution has witnesses, etc. Prosecutor can't call the defendant, only defense can put them on if they choose. But in cases of monetary awards, it is a bit different from criminal procedures. There are criminal cases where there is prosecutor and civil cases where there are plaintiffs and their attorney. Defense is defense and defendant.
Prosecution witnesses are called. Then when they finish, defense puts on witnesses to their case and to dispute the case against them. They decide whether defendant is on stand. That is choice. Judge handles objections according to the law and rules of evidence. There are specific rules of evidence as to relevance, hearsay, etc. and when object, must state the reasons then judge rules. If you don't agree, can register an objection for the record (to be used on appeal). Closing arguments, prosecution or plaintiff goes first and then defense goes. Each gets to put up rebuttal. Same with earlier case so after defense, prosecution can rebut and then defense can rebut.
Prosecutor or Defense can suggest rules or instructions to the jury but the judge decides what it will be. There are some guidelines as to what they have to give or can be overturned in appeal. If there are lesser charges that could be found, judge needs to tell them that Needs to tell them judge determines law and jury the facts. So if there is a law, the judge may give it to the jury.
Judge doesn't allow in previous crimes unless they show an exception to hearsay --- such as a pattern of actions (mode of operandi-- there is another word that starts with an "M" but I can't think of it right now) but shows that is is the behavior or constant breaking of same law to show a mode of operations of doing it that way. Like MO -- mode operandi. Can show character of witnesses too so past crimes can be used to show the witness is untruthful or more likely to be untrustworthy.
Judge has to know the law as he is the arbiter of the law. Where there is jury, they are arbiter of facts, but if no jury, the judge determines the facts as well, as to whom they believe. Needs to know the elements of each rime, as to intent, motive, etc. and of lesser crimes. Has to understand court procedures and there is a list of rules of procedure in every court and you can go to the court and get a copy. Not supposed to badger a witness, but may have to object to get judge to call it.
Civil Procedure class teaches court procedures and copies of procedures or rules are available for every court. Attorney may dismiss a witness but reserve right to recall them (at the judge's discretion) but could call as a rebuttal witness if other side presented any information that the person could rebut. Attorneys need to really understand their case and where the various components of proof or defense will come from. Each element of a crime needs to be proven but there may be enough circumstancial evidence to find someone guilty at times.
