Answer: Being a lawyer is a mixed bag. Some lawyers work long hours and receive little pay, others work long hours for great pay. Some sell their soul to make a buck, some are into it for the sake of justice and the law. It is slightly difficult to become an attorney. You need to go to a University for at least 6 years and you need to pass an examination testing your knowledge and application of general law. To be an effective attorney, you need to be able to communicate well in both oral and written form, which means being able to read and listen as well as to speak and write. You need to be able to apply similar situations to the situation at hand. And, you need to be able to be concise and detail oriented.

Question: What gives a lawyer the authority to obtain private records? Let's say I want to sue somebody for libel but all I have is their Gmail address. Naturally, I need a lawyer to obtain their name and IP address from Google. So what does the lawyer do to obtain those records? Does he show up at Google and say "I'm a lawyer and I need this?" – what gives a lawyer that authority?
Answer: Goes to a judge with jurisdiction and asks for a subpoena for the information; if the judge agrees he has just cause, he grants it

He proceeds to tell the lawyer that he has committed a armed robbery the night before. What would the lawyer tell the client, and what steps would they take in solving this case.
Answer: The lawyer can't advise the client to flee the jurisdiction.
The lawyer can't advise the client to destroy evidence or threaten witnesses or try to bribe them.
The lawyer would ask why this person is making such a claim? Does this person wish to turn himself into the police?
The lawyer may advise the client to surrender to the police because that could reflect positively when it comes time to sentence the defendant.
Question: What are the downsides of being a lawyer? Hello, everyone. I need some insights and wisdoms from people who are lawyers or know a lot about the inside and out of being a lawyer.
Growing up in my community, I had so many people telling me how glamorous life of a lawyer is, how much money they make, how nice are their houses and cars, how respected they are in their community. It almost sounded like being a lawyer is one of the most fantastic careers in the world with hardly any problems.
But as life is, I am sure there are downsides of being a lawyer that many ordinary people don't know about. 1. What are the downsides of being a lawyer? 2. At the end, do you believe the good sides far outweigh the bad sides? 3. Would you recommend the career to someone who values deeply on family time and enjoying life?

Answer: Your always swamped in working in the city, you constantly face personal ethical issues, you defend guilty people, you defend people who don't really care about themselves. I would recommend it to a single person or a person with older kids, and a spouse that doesn't mind a crazy schedule.
Question: What kind of lawyer should I seek under the following situation? I give a loan about $8000 Aus dollars to a friend of mine and I am unable to get it back. It's been 7 years now and have not received any money from them. Right now I am in U.S . Answer: First, you need to find out whether there is still a case to answer, 7 years is a long time. You need to speak with a contract lawyer, it helps if you can prove the loan was not a gift. You do not need written evidence as contracts can be made orally. As this is a social relationship, the courts will presume that there was never any intention to create a legal relationship, it is for you to rebut this presumption. Ask yourself, when you made the loan, was your friend fully aware that failure to pay it back would result in legal action. If yes, go to court. Small claims court is not sufficient if the amount of damages you are seeking is greater than $5000. Australia and the US have very similar legal systems. Speak to any contract lawyer who can advise you.
Question: How does a lawyer get admitted to practice in the Federal Court? If a lawyer is licensed by a state, such as New Hampshire, how would that lawyer get to practice in the Federal court system? Where would they apply for this license?
Answer: Contact the Federal Public Defender or Court Clerk in your federal judicial district (I believe New Hampshire is its own federal district whereas some states have two or more fed districts.
Question: What kind of lawyer do I need to sue a company for defamation of character and sexual harassment? I just posted a question about being sexually harassed at work and then fired and now the boss is defaming my character and I'm taking you people's advice and looking for a lawyer on my state's bar association website and I am so clueless as to what kind of lawyer I should be looking for!! Answer: Call your state bar association's lawyer referral service. Go to their website for details.
The referral service will ask about your situation and give you a referral to an attorney who handles that kind of issue. The first visit is very inexpensive and does not require you to hire them for further services.
Question: What if my lawyer does not show up at my preliminary hearing? My public defender?
Because i haven't got one yet and my court date is tuesday.
Can i ask for a continuance due to the fact that i am not being represented by a lawyer/attorney?
Don't they have to make sure that I have some sort of lawyer?
If he is not there, does that mean it will get prolonged? Or what? I don't know what to plead to until I talk to my public defender.

Answer: Probably the single, most important thing if he doesn't show up will be that he won't be there. I'm guessing on that but that seems to me the most important thing.
And you can ask for a continuance or just about anything if he doesn't show up but I'm not a lawyer so I don't know if the judge will allow it or not. You probably should ask your lawyer that question.
Question: What kind of lawyer should I go to if I need assistance with both divorce AND financial matters immediately? In other words, I am going through a divorce for financial reasons. I am not going to declare bankruptcy, but need legal assistance to deal with creditors. I have a small but steady source of income; enough to pay for a lawyer on a payment plan and enough to pay back what I will owe to bills and creditors, but the creditors WILL NOT work with me and I want to do it all through a lawyer.
I make too much to qualify for Legal Aid or any other assistance of that sort.

Question: How come a lawyer can't help me from possibly getting expelled from college? I was cheating on a test and the notes were found in my lap. I don't want to get expelled from a college so I called a lawyer. He said it was in the administrative's hands and getting a lawyer is a waste of money. I really want to pass all my classes this semester.
Answer: The college has the right to set its own rules re: expulsion, and being caught for plagiarism is fairly common grounds for being considered for such a thing. The lawyer can't help you because when you agreed to attend this uni, you also agreed to follow their rules - including following their rules regarding how disciplinary actions take place.
Your best bet is to talk to your academic advisor to find out what the official uni procedure is for this sort of thing. What are the steps? Will you really be expelled on your first offense, etc?
While some colleges will expel you for this, at others, it's more likely that you'll fail either the exam or the entire class. It depends on the colleges, so you need to ask.
Question: What type of lawyer would handle car manufacturer defects? I recently had some problems with my car in which I had to take it back to the local dealership and a special engineer flew in to diagnose it. They finally came to a conclusion saying it was a defected car and they're sending a proposal to buy it back. But if the proposal is too low or just unreasonable I plan on hiring a lawyer and sueing. What kind of lawyer would be right for this situation?
Answer: I've been in your shoes with the defective vehicle buyback (and I'm a lawyer)! My buyback process was great - I turned over my defective vehicle, and the dealership delivered the new car. (Obviously, there was quite a bit of paperwork to go along with that. Also, in my case, the dealership had actually had my car for 1 month prior to the buyback decision. During that time, various engineers flew out to look at it, and they tried to fix the software problem. Ultimately, it was deemed unsafe, so I never got that car back. I had it for 3 days when it went into the service department. To further complicate my situation, the vehicle I bought was a brand new model of car which had just been released. Supply could not keep up with demand, so all of these cars were special orders only. Therefore, the manufacturer had to build one specifically for me, so that took another month.)
The software glitch started before I even took delivery, so there was no loss of value on my vehicle. I got to do an even exchange. It sounds like you may have had the vehicle for a while (since you're worried about the proposal being too low).
If you need a lawyer, get a lemon law attorney. I talked to a lemon law attorney ahead of time but never needed him. (Even though I am a lawyer, I don't practice in lemon law or in the state where I bought the car). Hopefully, your process will go as well as mine did.
Question: What can a lawyer do for me if i just got a speeding ticket while on deferred disposition? I live in Texas and got a ticket 2 months ago and was granted deferred disposition meaning that if i do not get another ticket with in 90 days it will be dismissed... however i just received another... i have heard of people paying a lawyer to possibly "work deals" with the judges to get something dismissed or reduced... anyone know what a lawyer could possibly do for me? Is it worth it?
Answer: You pretty much got your deal with the deferred dispostion. I used to be a law student, and from what I can tell you your best bet is to accept responsibility for what you did. Once you get a deal like that and you mess up again, a judge is going to be much less likely to want to give you another chance because in his eyes you already got a second chance and you kind of messed it up. A lawyer will charge you more than what it is worth (remember for them they won't do anything unless the make some money), and you will probbaly still end up paying a fine. Call the judge and see if you can talk to him yourself, accept responsiblity, admit you messed up, and maybe lighten up on the foot a little bit. Good luck to you.

Question: What do you think of a lawyer who tells an opposing pro se party that it is okay to ignore a deadline? If the lawyer says that a time deadline imposed by a judge in an order is "flexible." what would you think?
Would you think that the lawyer and perhaps the court would be bending the written Rules of Court on other matters, so that the pro se person would have no way of knowing what the real operational rules were? How often do lawyers stray from adhering to proceedural rules, and are they usually allowed to do so if the are proceeding against a pro se party?
Answer: The pro se party is a goat in a field of lions. He has to know his own way around the system or get really put upon by legal tricksters like the one you have described.
I'm afraid that is business as usual. There are no flexible deadlines. Either you make it or you drown.
Question: My lawyer says I need to send a demand to a credit card company that's reporting false information? He's not my lawyer for this matter, but told me I need to send a demand to my credit card company for reporting false information to the credit bureaus. I have already disputed it without success. What is a demand letter? Where could I find a copy of one?
Answer: A demand letter simply states the information they have reported that is incorrect and demands that it be corrected. There is no set form that this has to take, just something along the lines of
Dear Credit Card Company; You have made the following false report on my credit record dated......
and stating........Demand is hereby made pursuant to the law of this state that you correct your false statements within thirty days of receipt of this demand. Failure to comply will result in this matter being referred to the proper authorities for legal action against you. Your Signature.
Question: How do I deal with a lawyer that overcharged me in a court case and is now suing for payment? We hired a lawyer to represent us in a court case that an ex filed regarding modifcation of child support and visitation. Our lawyer overcharged us and when we questioned him, he removed him self as being on record as our lawyer with the courts and is now suing us for payment. We paid 75% of the bill, but have questions on some of the remaining charges.
Answer: It is quite rare that an attorney sues a former client for payment because the counterclaim is ALWAYS malpractice.
Contact the local bar association and the State Bar and request arbitration of the attorney's fees.
If he actually filed a lawsuit against you... you should counterclaim if he made even ONE tiny mistake. That should back the attorney WAY off.
Question: What type of lawyer spends the most amount of time at an office, not a courtroom? On every TV show/movie that involved Lawyers, you see them in the courtroom arguing a case. Personally, I want to be a lawyer that spends more time at the office than public speaking/aruging at the courts. What type of lawyer spends the most time at the office instead of the courts?? Corporate Lawyers?? Intellectual Property Lawyers?? Some people want to argue their case in front of a jury or a judge, I do not. I would like to give people legal counsel but not have to really defend anyone by arguing their case.
Answer: Corporate Lawyers, In-house attorney. Depending on the firm- tax lawyers, WET Lawyers (Wills, Estates, & Trusts), Patent & Copyright Lawyers. Personal Lawyers (Like Trump's lawyer), and maybe corporate outsource lawyers.
There are several branches of law you can go into that requires very very little time in the courtroom, possibly none. Besides, if you're a lawyer and you get selected for jury duty, you probably wont be kept long. ;)
Question: What does a lawyer have to do to file a motion? The Correctional guards told my b/f he would be allowed to hold his newborn baby during a visit if the lawyer files a motion to do so. We asked the lawyer to do it a month ago, but he still hasnt done it. He acted like it was no problem. Does he have to go in front of the judge?
Answer: Hello Victoria. I have never heard of getting a motion for an inmate to hold his own child during a visit, but this is in Ohio, so obviously your state's laws are different.
To answer your specific question however: a motion is a request made to the court asking for an action to be performed. Motions can be filed either by an attorney or pro se (meaning done by the person himself without the use of a lawyer).
The actual motion can be handwritten or be of a preprinted nature. It will state what action the person is asking the court to perform or allow. This is filed through the Clerk of Courts for the county involved. It will be heard (read) by the presiding Judge who will render a written verdict either granting or denying the motion. The motion is then returned to the person who submitted it.
A personal appearance is NOT needed nor called for when filing a motion. It can be mailed to the Clerk of Courts and the answer will be mailed back.
Since I have never heard of any motion asking permission for an inmate to hold his infant child, I cannot help in the phrasing or terminolgy needed. Nor do I know of any preprinted legal form that would help here.
One thing I will suggest is to call the facility and ask for the Administrative Assistant. This is a position directly under the Warden. Ask the AA about this "rule" and see what the official statement is concerning this.

Question: how should I choose between being a lawyer or being a research psychologist? Lawyers get to help people to get justice, but psychology sounds interesting. I like to analyze and write, and I hear that is a good quality for a lawyer to have. Isn't it very stressful to be a lawyer though?
Answer: ..just go with your heart i guess. Which one comes more natural.
I was stuck in the same rut. Music, or psychology, or art.
But I realized that I've been analyzing people all my life, so I would be getting paid for what I loved.
