Answer: Has he been convicted and sentenced yet?

Call the lawyer, and find out what kind of ruling it was. It may be appealable but the lawyer doesn't believe it will succeed, or it may not be appealable at all. If he thinks the lawyer isn't doing his job he can always find another one.
Question: A notice of appeal and a motion to stay? Custody case help? The other parent in my case has filed an appeal and a motion to stay the court order. Now, in the notice of appeal, the reason for the appeal and the specific parts of the court order being appealed were not listed. Can this be thrown out on a technicality? Question: Where can I find a Notice of Appeal form for Illinois 3rd District? We're appealing my girlfriend's sentence. We're in Whiteside County, Illinois. 14th Circuit Court, 3rd District. I don't know if these files are printable on-line or what but if anyone know's where to get them let me know.
Answer: The form is in the West publication, "Illinois Court Rules and Procedure--State," along with the rules you will need in order to properly complete, file, and serve the form, and do all the other things necessary to perfect an appeal, such as securing the transcripts.
If you think all you need to do is fill out a form, you are in for a surprise.
Question: I received California EDD "Notice of Appeal and Transmittal of Appealed Determination". What should I do? I just received a notice from California EDD "Notice of Appeal and Transmittal of Appealed Determination". It says that my former employer has appealed the Department's decision finding me eligible for unemployment insurance benefits. It also mentions a judge making the decision to whether I am or am not eligible based on the evidence presented in a hearing. Does this mean my unemployment insurance benefits will stop and I have to go to court against my former employer?
Answer: You will have to go to before a judge it will just be you and your former employer. You will both given a chance to provide arguements and present evidence. If the employer can prove that you were justifiably fired you will lose your unemployment benefits.
Question: What key words do you use in your violation notice appeals? I received two violation notices tonight for two of my recent "best answers." In the appeal I wrote: "This answer does not violate community guidelines. Its deletion was the result of malicious reporting."
Both answers were reinstated.
Answer: up until a fer weeks ago i had only had 2 since i started, then there was a rash of them all i did was ask them to actually read my entry and really look at who complained...they dropped a couple and one person avatar cant report me anymore..so they will have to make a new account just to bug me by the way, next time you see a lot of thumbs down notice their reply wont have one if they make one..such j.a.'s..
Question: I filed a notice of appeal followed by notice of designation of record all within time limits.? The Court clark has been sitting on sending the transcript for more than six weeks now. Does it mean my appeal will be rejected by the court of appeal?
Answer: No they are not reviewed daily or even wkly. It depends on the court system and what time is set aside for appeals. No news is good news.
Question: Not sure which Notice of Appeal to file? My sister was just ordered to pay her ex-husband's lawyer fees. She would like to appeal the judgment but is unsure which form to file. Answer: Motion for Reconsideration. If she files very quickly, she can ask the judge to reconsider his decision. I have to tell you that Motions for Reconsideration are very rarely granted.
Was this a judge or a court commissioner who made the decision? If it was a commissioner, she can file a Motion for Revision and have the matter reviewed by a superior court judge. There is a time limit to file this motion, too. So she should not delay. Although possible, it is not overly likely that she will prevail.
If the decision was made by a judge and the judge will not change his/her mind (which almost never happens) then she can try to appeal to the Court of Appeals.
She should remember that judges have a great deal of discretion - and the only time appeals are generally successful occurs when the judge made a mistake with regard to his/her interpretation of the law. The decision to order one party to pay another party's attorney fees is generally at the judge's discretion . . . meaning an Appellant court is unlikely to vacate the judgment. Your sister should also remember that if (probably when) she loses her motions and/or appeal she will almost certainly be ordered to pay her ex-husband's ADDITIONAL attorney fees. She could easily end up paying him three or four times what she is currently ordered to pay.

Answer: Ill probably be in trouble for saying this.
Although you have appealed, (as I have a few times) they have always after the appeal time sent me an email to say that the appeal has failed, and that they dont read individual appeals/questions.
Just the fact that they say this suggests that the appeal system is a complete waste of time.

Question: I am appealing a notice that I am not eligible to receive EDD benefits in Calif; what do I need for the appeal My employer said I was terminated because somebody called and complained. I did exactly as I was trained to do but was still fired. I was an exemplary employee and probably can get at least 2 or 3 people to back up my statement that I was an excellent employee.

Answer: You should get in touch with one of your elected state officials. A member of your General Assembly - a state senator, etc. Best kept secret in politics is they are at your disposal and are very eager to perform constiuent services by helping people like you on issues like this. Good luck

Answer: You can only appeal to an appellate court and only points of law that were objected to during the original trial in order to preserve the error. You can't introduce new evidence and a blank appeal will be thrown in the court clerks trash can, it won't make it to the judge.
A stay may be granted if the judge agrees that the possible error was preserved by timely objection but if the other side is not knowledgeable in the rules of evidence and is attempting to appeal without grounds or a preserved error, it's not going to be granted.

Answer: if your appeal fails it costs you 10 points so unless you are sure of yourself don't bother.

Answer: The State of Florida has 5 DCAs (District Court of Appeal). Which district are you in?
If the case you are wondering about was defended by an APD and the defendant lost the case, depending on what type of case it was will be whether or not an automatic appeal takes place.

Now if you are in full awareness of this BEFORE you lodge the appeal I would understand the rational behind it, to stop trivial appeals, BUT to be told it AFTER you have posted your appeal is just WRONG!

Answer: I had a 'violation' followed by instant suspension.
I appealed albeit unsuccessfully, so I went into the Suggestions Board and posted the Q&A for which I was suspended and gained a lot of backing.
I then appealed a second time, again unsuccessfully so I emailed the Y!AT who subsequently removed the violation and suspension.

Question: If you filed an Notice of Appeal and Supersedeas Bonds. And the courts granted it in your favor.? Then later the court of appeals sends a letter back to the lower court stated that the judge signature was missing on the papers the court faxed up. So it could not be docket. Then the lower court which granted it then now dismisses it. And re-sentence the defendant. Which the defendant followed all procedures and timely file an paid everything. But later after fighting it, the court reinstates the Notice of appeal with signature but still denies the Supersedeas Bond to be reinstated. Meaning you have to serve your sentence giving, while appealing the case. My questions is. Can the judge do that when it was never dismiss by court of appeals and it was the judge's error for not signing it? Are you entilte to a Supersedeas Bond, when in the beginning it was granted and defendant paid the Bond the judge set to stop sentencing while appealing the case? {Sorry for last question if it confussed anyone. Answer: Hendricks County. It doesn't have to be anything fancy, just a one page document that says you are notifying the court of your intent to file an appeal. The deadlines come quickly, so DO IT NOW.

Question Details: In the office where I work (it is a large, national company) every so often the branch manager and one of the ladies working there go out to lunch together. They spend about one hour and a half. When they return, the lady does not act or look the same as when she left. She acts kind of crazy, is disshelved, and is sweaty looking. Maybe I am naive, but in today's culture I wouldn't know if they are doing drugs or something else. They always bring back what looks like leftover food in plastic bags. I feel affected by this since I have to work there unless I look for another job. Could I please have your take on this? Thank you!!!

You're right, the asker wanted "your take on this" and that implies a subjective analysis of the situation, which you gave. It's not like asking "What is the capitol of Kansas?" where there's only one correct answer "Topeka." You're entitled and expected to give your personal opinion.
Do appeal. Maybe if enough of us appeal these frivolous notices of appeal, they'll improve the system some day!!
Question: How can you send a complete text of a deleted post when you appeal a violation notice? If the question has been deleted, it can't be opened. Is there some trick to this?

Answer: Try this go to your profile "My Profile" then press my questions it will be faded but you still should be able to see the question you posted.
For the answers if you have it set where when your question is answered you get an e-mail you will still have who answered your question and some of the answers. Other then that I don't know.
