Money paid by a divorced husband or wife to the ex-spouse for personal support. In Alaska, this is generally called spousal support, and is only awarded under certain circumstances. Other states may call it alimony.
Question: spousal support? how come if the wife is stay at home and she and her husband divorces she gets spousal support but if the roles were switched the husband wouldn't get spousal support, how come?
Answer: It depends on the Laws of that country. Different countries have different laws.

In Texas if you have lived together & have a child that is over 10 years old but have only been legally married for seven years could your spouse be obligated to pay you spousal support even though the law says you have to be married for 10 years. Also is there such a thing as an early inheritance my husbands mother gave us a house when we were married now my husband says i cant touch it because of early inheritance. During the first part of our marriage I worked and paid the bills then the last four years I was a homemaker & he was the sole provider.

Question: Spousal support? My husband of almost 5 years has cheated for the second time in our marriage with the same woman...the first time it started after we had been married only 2 months, we were together 5 years before we got married. I have filed for spousal support but haven't gotten the subpeona yet. Any advice on what to do when we go to court?
Answer: i think you need more help than just the initial court dealings.
this man has really hurt you and you are hating him for "living the life" now that you are gone.
seriously, he is going to suffer. if he was married to you and cheated with this woman, he is going to do the same to her and his money will never last him, let him spend his last cent on leisures, its his debt now, not yours!
you keep working and staying honest, it will all come back to bite him in the ***, 3 fold.

Answer: Contact the child support office in the county where your former spouse resides. Be prepared to give them his social security number if you have it. Also, be prepared to listen to the whole phone menu, this can be frustrating, they may ask you to give information which you do not have, like your case number and workers name. You may need to write to that county child support office.

Answer: Child support? No, not until the baby is born. Spousal support? Possibly, but not a guarantee. That's all only once you go to the courts and officially file for divorce though. So you better get a lawyer and get to work. Divorces can take months and months to finalize and it can take a few more months before you get the payments worked out.
Hopefully the two of you can work it out where you at least stay on his insurance until the baby is born (assuming you two are civil). As for the bills though, unless he's just provided you with this lavish lifestyle then completely left you high and dry, its not likely that you'll get much spousal support. Not for very long anyway.

Answer: yes,it possibly be modified to pay your spousal support based on current salary,but you must prove to the courts your financial situation has been reduced.yes the law considers your current situation,what you pay is based on your income,however it changes,it will be adjusted,they take so much percentage.

Answer: How old is the child? He might still have to pay if the child is not with him!! They might just be forwarding it to someone else!!

Answer: Its a decision taken by the court keeping in mind the financial back ground of MAN alongwith his payment to first ex spouse...in any condition court cannot fix spousal support in a way that living a life becomes difficult for the husband...court will consider all the facts...

Answer: Yes, you can modify your court order. You will have to provide tax returns and pay stubs with in the last 3 months of the court date.
Although it may not be lowered much but its worth a try.

Question: Taxes on Spousal Support when living in different countries? My husband pays me both child support and spousal support. I know that child support is not taxable, but spousal support is. Since we have separated I now live in Canada. Do I have to do a tax return in both countries? I am a citizen of Canada, and soon to lose my perm res status in the USA.
Answer: Since you were a lawful permanent resident in 2008 you are subject to US taxation on your world-wide income. This status may continue for some time after you surrender your Green Card. This includes your Canadian income as well as the alimony from your spouse. You then take a credit for any Canadian income taxes paid on that income using Form 1116. This should wipe out most if not all of your US tax liability, if you have any at all.
Contrary to what another poster claims, you do NOT file a non-resident US return. Your Green Card makes you a US resident for tax purposes even though you no longer reside in the us. (Don't fret over this as it lowers your tax liability.)
As for how long you will have to be subject to US taxation after you surrender your Green Card, see IRS Pub 519 http://www.irs.gov/pub/irs-pdf/i8854.pdf as well as IRS Form 8854 http://www.irs.gov/pub/irs-pdf/f8854.pdf and its instructions http://www.irs.gov/pub/irs-pdf/i8854.pdf . Once you are no longer subject to US taxation you will no longer report the alimony in the nor pay any US taxes on it.

Answer: Spousal has no specific guideline amounts like child support. This will help you on Texas. Also, the guidelines are not mandatory amounts.

Question: Does a change in relationship status change the entitlement to spousal support? If somebody is collecting spousal support and now they are pregnant with their boyfriend's baby (they are living together), when the kid is born does that automatically change their relationship status (he will have assumed to role of "spouse") thereby negating the entitlement to spousal support?

Answer: I would start by informing your attorney that his pay will come out of the spousal support he COLLECTS for you. That may inspire him to do his job.

Answer: I think it is 10 years. But why can't he work? I never understood spousal support. If you are married, you are an adult and therefore able to work. If you can't work you are deemed handicapped by the state and receive support from them.

Answer: I think legally if you are married for the right amount of time they are ....unless you had a prenup agreement stating infidelity entitles them to nothing. I do think that she shouldn't get it!!!!!
