Witness List
The list of people you intend to call during your trial or hearing. The judge will tell you when the witness list is due. If you do not file your witness list, the court may sanction you by not allowing you to call your witnesses. There is a simple witness list form ( SHC-1050 ( Word | PDF) and SHC-1051 (Word | PDF)) - and remember you must designate who will be called as an expert witness.
Question: How far in advance before trial do I have to provide a potential Witness List in a District Court in Michigan? It is Dec 1, the trial is Dec. 17. Do I still have time to file and serve a potential witness list if I mail it tomorrow?

Answer: If you get any answers on this website, my fervent advice is that you disregard anything that is said. As soon as the court is open, call the clerk of the court and ask him. Advice on this website may come from people who know nothing, who are familiar with rules of different courts, or who are driven by malicious motives. Can you rely on any of them?
Question: Is there supposed to be a witness list for an unemployment hearing? I have a hearing tomorrow vs. my former employer. This is the rescheduled hearing, the first one was rescheduled because their witness wasn't available. There hasn't been a list submitted, either before or after the rescheduling.
Answer: Unemployment hearings are very informal. The witness list will generally be whoever shows up.

Answer: Yes, if you are subpoenaed or summoned to give a deposition. They can't just tell you to come in and give one. Depending on what you say, your name may or may not be put on the witness list.

Answer: It sounds like she is trying to set precedence that you were abusive or something. Generally this is used to convince the court to divide your assets unfairly, who wins child custody and whether you pay alimony.

Answer: Basically, JW's cling to a verse in Revelation that mentions 144,000 who are saved.

And they sang a new song before the throne and before the four living creatures and the elders. No one could learn the song except the 144,000 who had been redeemed from the earth.
Now, anyone who has ever studied Revelation knows it is a very difficult book to comprehend. JW's believe that ONLY 144,000 people will enter heaven, all of them JW's. But not all JW's enter heaven. How does a JW get to heaven? By working hard! Good works! Which means, of his own actions and his own doings. The JW religion totally discounts the grace and mercy poured out upon us by God. They make it their own responsibility to get tehre. So the best thing they can do is "witness."
But think about it.... if you knew that by going out and getting more ppl to be a JW, that meant you'd have fewer chances of being in the 144,000, would you do it? Of the whole world, already past until it ends, only 144,000 people can get in (they say). So you'd better be pretty darn godo at witnessing... but only to those who would be worse at witnessing that you! is that crazy or what?!
Question: Where do I file a Proposed Witness List? I am pro per in California. Although opposing counsel has not followed California Rules of Court or Civil Procedure, I would like to show the integrity she has not. I've received no information from her but I have drafted a Proposed Witness List and Respondent's Offers of Proof. I understand that I should file this with the court (Family Court) but I do not know where to file it. I filed an ex-parte Motion to Compel, last week but I do not know if that is where I file this type of document as well. I have mailed the list and offers of proof to opposing counsel and will file a Proof of Service as well.

Answer: It has to go to the clerk of the family court for that county, the same place you filed the Motion to Compel. It's all the same (I would also send a courtesy copy to the judge assigned to the case, with a cover letter).
Question: As a witness on a trial list, what does "Jane Doe #8" signify? -----In a list of witnesses in a federal trial, I saw "Jane Doe #2" and "Jane Doe #8" listed, along with many ordinary names. Why do they give a name like "Jane Doe #8"? That is hiding the name, not giving it. ---Thanks, Jim

Question: Is gov't in a RICO case required to reveal witness ID before a trial if the wit. protection prgm is involved? For a witness's protection before he goes into the witness program, are the government prosecutors required to provide a witness list pre-trial to the defense that includes the person they have promised to protect and relocate?
Answer: The witness list will include the real name of the witnesses they intend to call. It will NOT include any information about their new identity, or where they live etc.
If the defense wishes to depose the witness prior to trial then the Gov't will make him available to them at the police station or Federal building, and then return them to their new location afterward.

Question: I'm on a defendants witness list for trial.? I told the prosecutor that I dont want to talk to anyone until trial. Of coarse they dont listen. Will they keep bothering me if I tell them I dont want to talk with them or will they keep harrassing me? Will I be in trouble not talking? Will they come to my work and embarres me? the lawyers for both sides want to know what you're going to say before the trial.
you might note that the reporters who didn't want to testify before the trial spent many months in jail.

Question: what are my civil rights regardging being served as a witness to something I refuse to testify for? This is for an accident that happend over four years ago involving a girlfriend. I was not a witness to the actual accident, but did give some care for the victim after the accident.
I am afraid to speak or see the ex-girlfriend at this time.
The lawyer has already been spoken to about this, and is supposedly going to contact the client to see if I can be taken off this witness list.

Answer: Contact the attorney directly, but you may be out of luck.
If she was just a girlfriend, you were never married, spousal privelege doesn't attach. I'm assuming you were not her physician, so that is out.
If you are subpoenaed, they can compel you to testify. You can tell the judge no, but he can tell you "Go to jail go, directly to jail" and keep you there until you talk.

Answer: Absolutely. Each side is required to provide full access to evidence and witness lists prior to the trial. If she calls a witness without notifying you first, you may object on grounds that she violated evidentiary rules regarding discovery and disclosure. It would then be contingent upon her to give just cause as to why the witness should be allowed, such as demonstrating that the witness was only just discovered at the last minute or that it is a rebuttal witness to refute testimony of one of your witnesses. Generally speaking, surprise witnesses are not allowed.
Question: Have journalistic conventions regarding the documenting of attempted witness contacts changed recently? It seems that more stories increasingly reflect a journalist's attempts to contact a potential witness. Statements like "A message left for Mr. Doe on Friday evening was not immediately returned" have been around for a while. However, it seems that statements discussing whether a witness was listed in the phone book, and other relatively specific statements, are now more commonplace. If this more than my imagination, is it due to some change in AP, NYT, or other conventions?
Answer: To my knowledge, there has been no conscious change, however there may be an evolutionary change which occurs with most things.

Question: Can one be subpoenaed as a witness in another state? My brother's ex-wife lives in Fl (I am in NY). I haven't spoken to my ex sister in-law for at least 2yrs. My brother saw my name (maiden name) on a list of witnesses for his ex. I don't wish to support her or attend. Is it true there is such a thing as a phone deposition if I don't appear?

Answer: You will have to call that court and ask.I belive they will have to pay for your flight meals and hotel if they do. You do not have to testify on her side. Normally someone will call you first, her attorney and they will screen you first, if you are not going to be of benefit to her case, they will not call you as a witness.
