Marital Rape
Marital rape is any unwanted sexual acts by a spouse or ex-spouse, committed without consent and/or against a person's will, obtained by force, or threat of force, intimidation, or when a person is unable to consent.
Question: Did you hear about marital rape becoming legal? I saw it on Cable Pulse 24 but didn't catch what country it was. Does anyone know what country this became legalized in? I think it is just disgusting!
Answer: It didn't "become legal". It was already legal, and the US was hoping that in the new legal code the Afghan government was bringing in, marital rape would be forbidden.
The draft of the new laws, however, leaves Islamic law in place in this matter - that a wife has a legal duty to have sex with her husband, and that if he forces her he is merely taking what he has a right to, so it is not rape.
This is the law in almost ALL countries that have Islamic, or Shari'a, law. It has only come to the attention of the media because this is a new legal code for Afghanistan, and the west was hoping that it would be more "woman friendly".
Many countries are trying to pressure the Afghans to change their minds on this, but it is unlikely. The duty of a wife to provide sex for her husband whenever he asks is a fundamental part of the Islamic concept of the wife as a chattel of her husband, so I cannot see their changing their minds.

Question: What is the difference between MARITAL RAPE INCESTUAL RAPE & RAPE by strangers ? Do you think all are equalbad If you think all are different then please arrange in an order as to which is the worst and which is the least bad and why do you think it that way.
Answer: Well, all rape no matter who the rapist may be is bad. The differences between the perpetrators you listed will, however, cause somewhat different emotional trauma in the victims.
I believe that rape by a family member-incest-to usually be the worst of these crimes in terms of the trauma caused to the victim. I was raped by a stranger four years ago, which is hard enough with which to deal. However, being raped by someone like a parent who is supposed to love and cherish you and instead abuses you is very, very difficult and leaves horrible emotional scars. I've met people that were victimized by incestuous rapes during my counseling and they invariably had great difficulty recovering from their trauma.
Marital rape would be bad because, again, the person violating you is supposed to love and cherish you.
While being raped by a stranger is of course scary and dfficult to deal with, at least it doesn't involve a betrayal of trust by a loved one.
Question: Christians, is marital rape possible? Is there anyone that denies the reality of marital rape? Just curious. Other religions? How do you feel about this topic?
Answer: Rape is not a crime of sex, it is a crime of violence. Just because you are married does not give the right to do violence upon your partner.
Question: Afghan government writes the right to marital rape into the law -? - and what have Hillary Clinton, or Michelle Obama, had to say about it?
Answer: I don't know, but Hillary MIGHT have something to say about it... Michelle? Her job is to support her hubby in portraying Americans as little blind sheep, not to be an advocate for women's rights in other countries.
Question: What's the difference between "taking it" and marital rape? My wife never seems to be in the mood for sex. Some people have said I should just "take it". I don't understand, what's the difference between that and rape? Seems like if she backhands me and I keep grabbing, that's rape. Right? How do situations unfold where the guy "takes it" and the woman fights a little and then allows it... ?? Isn't this rape?
MamaLuna, you have crossed the line. Read my profile....
Answer: Both the Old Testament and Lifetime TV have declared that once a woman takes on the vow of marriage, she has officially decided to perform all wifely duties at the mere mention by the husband. Failure to perform such duties actually creates a breach of contract. In some societies the woman would be stoned to death for such hideous disobedience.
Unfortunately, that stoning thing has never really taken off over here in the west. Plus, rocks are not so readily available in most urban areas for a proper stoning.
If she backhands you, that is assault. I feel terrible for you for all this grief. I hope at least she is a good cook.
The best situation for now is as once prior person has said...bring hookers home for her to see and hear. Maybe that will get her juices flowing. Be sure to pay these women in front of her. She may get inspired if she she's how much money she would be able to pocket.
God bless you sir.
Question: What does communism say about homosexuality premarital sex extramarital sex marital rape polygamy ? What does it say about partner swapping abortion etc? Does communism support gender equality? Please don't tell me about the activities of various communist governments. What does communism says exactly about the above activities?
Answer: There are, I believe, better things in life a communist or for that any party workmen to think and worry about, if he or she is a committed politician or otherwise in life. You may say that these are also social problems and issues. But I say that these are ways of life one selects and as long as it is decent, does not create major social and communal issues, let us expect our political parties concentrate more on burning national issues.
Question: is getting a spouse unknowingly drunk considered marital rape? she didn't know that some very potent alcohol was being slipped into her wine
he did this for the specific reason to have sex with her, as they hadn't had sex in awhile
Answer: Yes, that is rape.
Introducing any substance into someones food or drink, with the intent of impairing their judgment, in order to have sex with them, is rape in the statutes of nearly every state.
If the wife decided to, she could file a criminal complaint against him for rape.
The husband would then be facing serious felony charges, and could spend several years in prison if convicted. He would also have to register as a sex offender for the rest of his life.
Being married is not a legal defense to a charge of rape.
If the situation was reversed, and the wife got her husband drunk in this manner, she could be charged with rape as well.
Question: What do you think of this solution to end marital rape? Women, start fulfilling your wifely duties and stop denying your husband!
who's making fun CC? i'm serious!
Answer: how can you say that, you are a woman, right? Yes the husbands happyness is part of the wifes dutys but also, the wifes happyness is part of the husbands duty. Both need to support and respect eachother, rape violates the respect. the husbands duty is to make sure she is safe, and not harmed. He isnt allowed to rape her just because hes horny and she isnt in the mood. She is allowed to refuse when she wants to. A wife isnt a sex slave.
Do you think of yourself as a sex slave
Question: Why there is marital rape laws in western countries, sex is legal right of husband? wife must submit her body to husband. it is written in the Holy Book
Answer: Because a man can no longer force his wife to have sex with him.
Question: No such thing as marital rape in Kenya? The sexual offences bill was passed, finally. Yet, among the issues it failed to address, according to some, was the issue on marital rape since the bill specificall provided that rape does not apply to couples who are lawfully married. What is your take on this?
Answer: Kenya is a very complex country, there are 42 tribes who have 42 different languages cultural practices and traditions. As a democratic country the government has different people cultures running the country. In one of the tribes, once a woman gets married any married man from that tribe can sleep with her. It's something that is frowned at by many Kenyans and other countries but it is their custom. In another tribe once the husband dies the woman is inherited by his brother. These traditions are still very strong sometimes even beyond religious beliefs. There is however an organisation called FIGA which is a women's organisation which fights for women's rights in Kenya. The last time I was in Kenya (7 years ago, ) their voice was respected by the Government. These women have fought against female circumcision, underage (ie under 18) marriages, and even got the Government to bring back some Kenyan women who had gone to Saudi Arabia to work and ended up enslaved.
I think in time things will change. Kenya is not as it was 20 years ago or even last year.
Question: Christians, do you think spousal rape should be punished (law) similiar to other forms of non-marital rape? Definition: Spousal rape is non-consensual sexual assault in which the perpetrator is the victim's spouse.
Or should the fact that they are married make the punishment lesser or worse?
Answer: Getting married is the definition of consensual.
You'll have to pin another offense on the "perp", - like assault or domestic violence (DV).
But since you're asking 'christians', -based on what the Bible says, - you're body belongs to your spouse (too).
The wife's body does not belong to her alone but also to her husband. In the same way, the husband's body does not belong to him alone but also to his wife" (1 Corinthians 7:3‑4).
And even saying 'no' to the spouse, - has to be agreed upon by the other.
1 Corinthians 7:2-5 - Since the sexual union is upright only within marriage (Heb. 13:4), the man and wife are to fulfill one another's desires for sexual affection. They are not to voluntarily separate except by mutual consent for a temporary time for spiritual purposes.
BTW: My comment would include that each spouse is meant for sex for their mate. That does not include any and every possible sexual gratification purpose by the other's imagination. Sorry, - no back-doors are required by the wife. - Unless of course it's agreed upon.
Question: Can any one tell me where i can find a famous feminist critic on marital rape in 21st Century?
Answer: I don't know about the 21st century, but Susan Brownmiller wrote an excellent critique (Against Our Will) in the 20th. This is about all rape, not just marital.
Question: How is marital rape possible?
Jade196: That's assault, not rape. The husband isn't protesting the sex(as no sane person would) but the continuous batterment of his PREVIOUS injury. Are you implying all marital rape cases involve women whose genitals were injured beforehand? if not, please come up with a RELEVENT example. kthxsbye
also women are not in dreadful agony during sex if there's no injury.
Answer: It is possible in much the same way that rape is possible outside of marriage.
At the same time consider that in a traditional Christian marriage a man's body becomes the property of his wife while the woman's body becomes the property of her husband. They literally give themselves to one another. In such a case, they voluntarily give up the right to say no to sex unless there is a good reason. At the same time, a loving spouse will not force himself/herself upon the other sexually. If a spouse is reluctant to have sex, then it is time for communication. Sometimes you have sex when you don't feel like it for the benefit of the spouse whom you love. Sometimes you refrain from sex for the benefit of the spouse you love when you really want sex.
Marriage is about love, sacrifice, communication and choice. When these are used in a mature and caring way, then rape is not possible.
Rape is only possible when one or both in the marriage are being immature and selfish.
Sex should never be a weapon or bargaining chip. Sex should never be a reward. Sex should be a natural and normal part of the marriage.
Those who can still have sex even when arguing understand this. There is nothing wrong with healthy communication. There is nothing wrong with healthy disagreement. Sex is not a part of disagreement. Sex, by it's very nature, is about sharing.
Question: What do you think about these marital rape laws? In Afghanistan these laws have been put into place obligating a wife to have sex with her husband at least once every four days. Should women be controlled in this way? Be honest please.

Answer: NO WOMAN SHOULD BE TREATED THAT WAY.
Its sickening... it really is. Women are more than just a sexual stimulant and birth canal.
Question: how do I report and prove prove marital rape? Is marital rape impossible to prove in courts ?Is there a law on marital rape?
Answer: The first thing you should do is to go to the police & give as best a statement as possible. If the rape happened recently, then you should get a perp kit done.
No matter if the person is your husband, brother, father, friend, or stranger, rape is still rape. Unfortunately marital rape is not as easily believed in courts as some people assume that women automatically give up sexual rights as soon as they get married, but it's becoming more of an issue lately. Many times marital rape is paired up with physical & emotional abuse, so even if the police/courts won't be as believing of the rape, they will still acknowledge that he is abusive.
If you are in a relationship where you are being raped by your partner, please get out as soon as you can. Any women's shelter will be willing to take you in. Don't worry about not having money or posessions, as most places are used to women showing up with literally nothing to show but the clothes on their back & bruises on their bodies. You have the right to say no & have your rights obeyed. Marraige does not give someone the right to your person.
Question: Should Marital Rape Be Legalized? I am pro-marital forced sex. It's a man's imperative that he may get his slice of hole each night from his wife, and if his wife is 'loving' she will deliver. If the wife in question does not have voluntary sex with the husband, the husband should have the right to have involuntary sex or 'rape' (as most feminazi's call it) with the wife.
Answer: I hope your wife cuts you to pieces with a rusty knife.
PS: Don't you dare use the word "Feminazi". That belong to Rush Limbaugh, and he is most certainly not a woman hating pig like you.
Question: Christians, do you identify marital rape as a prominent issue needing to be addressed? What are your personal views concerning the issue?
Answer: Any form of abuse, regardless whether it is within marriage or not, is a serious issue that needs to be addressed.
Question: Ramadan. Salam, is it true that there is no such thing as marital rape in Islam, could you explain why please? as my wife thinks it is the most disgusting thing she has ever heard (she is kufr), so what should i tell her to reason with her.
So, stranger what you are saying is that marital rape is a crime under sharia?
Answer: Becuase under Shar'i law, a wife is not allowed to refuse her husband sex when he wants it, unless she has a valid Shar'i reason (menstruation, obligatory fasting, or illness or injury so severe that it would cause her further injury). Refusing sex is one of the things that a husband is allowed to beat his wife for. Rape is illegal in Islam, and there is nothing in Shar'i that comes out and says "it's okay to rape your wife", but it's a grey area because nothing in Shar'i deals with or mentions marital rape, obviously because under sharia a wife is not allowed to say "no".
some of the rights of the husband:
(a) The obligation of obedience. Allaah has made the man a qawwaam (protector and maintainer) of the woman by commanding, directing and taking care of her, just as guardians take care of their charges, by virtue of the physical and mental faculties that Allaah has given only to men and the financial obligations that He has enjoined upon them.
(b) Making herself available to her husband. One of the rights that the husband has over his wife is that he should be able to enjoy her (physically). If he marries a woman and she is able to have intercourse, she is obliged to submit herself to him according to the contract, if he asks her. That is after he gives her the immediate mahr, and gives her some time – two or three days, if she asks for that – to sort herself out, because that is something that she needs, and because that is not too long and is customary.
If a wife refuses to respond to her husband’s request for intercourse, she has done something haraam and has committed a major sin, unless she has a valid shar’i excuse such as menses, obligatory fasting, sickness, etc.
(e) Discipline. The husband has the right to discipline his wife if she disobeys him in something good, not if she disobeys him in something sinful, because Allaah has enjoined disciplining women by forsaking them in bed and by hitting them, when they do not obey.
The Hanafis mentioned four situations in which a husband is permitted to discipline his wife by hitting her. These are: not adorning herself when he wants her to; not responding when he calls her to bed and she is taahirah (pure, i.e., not menstruating); not praying; and going out of the house without his permission.

Question: What is the law on marital rape in your country? In Korea there was Marital Rape Case recently
http://www.koreainsider.com/Marial-Rape-Case-in-Korea.html
Answer: The law varies from state. I remember back in the 70's or 80's a marital rape case was successfully prosecuted in Oregon, and was the first of its type in the US.
Question: Is there such a thing as marital rape? I mean isn't she giving lifetime consent when she is marrying u?
Answer: No, under Australian law, a man who has sex with his wife may well be considered to be raping her.
A case happened where a man was having consensual sex with his wife. She asked him to stop.
He said he stopped immediately.
She says it took him 30 seconds.
He was duly convicted of rape and spent 4 years in prison.
This is the Politically Correct madness that Feminists have foisted upon EVERYONE.
