Answer: it is illegal to sell 'real' absinthe in america, however it is not illegal to consume it, or buy in a forgein country (or online) and bring it into america. unfortunately pretty much all absinthe sold around the world is not the 'real' stuff they had back in the day.............

Answer: Society as a whole has deemed certain areas of such importance that the accused's "actual knowledge" is immaterial. Typically used in inherently dangerous activities such as the use of dynamite, or handling wild animals, and also for certain types of product liability (manufacturer who releases the defective product to the general marketplace or "stream of commerce"). Also in areas like statutory rape, where "I didn't know she was 15" is not a valid defense.
I don't see any problem with applying this to especially dangerous activities. It's a finer line, I think, when it comes to crimes such as statutory rape, especially cases involving consensual sex.

Question: Should Courts Have the Power to Declare Statutes Unconstitutional? Statutes are enacted by elected representatives, or, in some jurisdictions, by direct vote of the people. Should unelected judges have the right to declare statutes unconstitutional?
Answer: If not them, then who? If there is no one to declare a law unconstitutional, then what is to stop a state from bringing back slavery, or a ballot referendum to ban Libertarians? Even when justices are not elected by the people, they are appointed and approved by elected officials.

Answer: Hi, What you have to fill out, or write, is called an 'Answer". You are supposed to write down whether or not you agree that their claim in a true one...in other words, that you feel you owe or, do not owe the loan. You need to agree or disagree to the amount they are suing for. You need to let them know any reason for defaulting on the loan...like you were out of work or for a medical reason, something to that effect. You NEED to, if you agree you owe the loan, tell the court that you agree and are willing to repay the loan and that you can afford to pay $XX.00 amount each month, week or, however you can pay it with out defaulting. The courts will allow you to do this. You will be responsible for all the court fees etc. for their claim if they win. I believe this is due on the day of the hearing. If you do not pay the loan in the agreed installments, they can petition the Sheriff to take any of your belongings that they want to pay the loan. Answer: Well that was kind of the whole point of the statutes. It requires a whole lot less burden of proof on the part of the government. So it is much easier to get a conviction.
It allows the government to convict the godfather or president of a company without having to prove they personally perform any actual crime.

Adoptees having been fighting for their records for years. Adoptees are faced with discrimination due to the sealing of our adoption records and birth certificates. not one single parental surrendering rights paper has ever been found that promises confidentiality, yet our largest opponents claim this is the reason for the records sealing.
You would think that "implied secrecy" wouldn't stand a chance in court for petitioning for my records, however the state of california still refuses to give them to me. Even though, there has NEVER been a confidentiality promise written into law, or surrender paper. They don't exist.
The problem here lies in the interpretation or mis-interpretation of the law. I have a right to my birth certificate as an adopted citizen, there is no misinformation there.
History clearly shows that records weren't sealed to keep the surrendering parents and adoptees from having access to one anothers information, it was to protect adoptees from the stigma of being born illegitimate children in a different time when stigmas changed your life. Its time for the laws to reflect adoptees as equal citizens and these ancient laws need reformation.
Question: Should the Supreme Court have the right to overturn state statutes? In Roper vs. Simmons, the supreme court ruled that it was unconstitutional to execute someone who committed the crime while they were a minor. They said it violated the 8th amendment and it was cruel and unusual punishment.
My question is: Is this a constitutional question which allows the us supreme court to overturn statutes or should the states have the right to determine how the 8th amendment should be applied under their inherent police powers?

Answer: it's not a matter of number, it's when was the last one done, and at one point did the person legally harmed know or should have known. it's generally one year. but be careful, statute of limitations means when were charges brought, not how long the person has been able to avoid the police and getting arrested. if they have been charged, just not caugh, statute of limitations is out the window

Answer: It depends on the city where you live. Call the police when you think you have a legitimate reason to complain about the noise going on in your neighborhood. The police can explain to you if what he heard and observed was the kind of noise that is prohibited by the city ordinance or maybe by a state law.
