Question: Affidavit? I did an affidavit at a lawyers office , by her para-legal, is it legal? It concerns a house in Puerto Rico, I being the eldest am renouncing my part and giving it to my fathers [who passed in 2001] wife. She says is not legal, I paid $250.00 dollars to get it done , all it has is the paralegals signature and paper from with the lawyers name. How do I find out if is legal?

Answer: It's "legal", but it doesn't have the full effect of conveying your interest in the property, there's more to it then that. I would need to know more facts (like was there further actions being taken by the law office), or was the affidavit to be used by you for use at the county/city recorders office to transfer your interest. Sorry, not much more with these facts.

Answer: They have them at the DMV/BMV and half of the people there are notaries (can notarize the document). Just leave yourself a little extra time on the day of your license test.

Answer: It does depend on your income and on the number of people you have in your own family in the US. plus the total number of people you are sponsoring. as long as the amount for the total number of people you are sponsoring from overseas and supporting in your household at 125% of the Federal Poverty Guidelines remains below your actual income, you're ok. You remain liable to help everyone for whom you've filed an affidavit of support for quite a long time. but you're not liable if they commit some sort of crime.

Answer: An affidavit would have to be notarized and witnessed, yes. What you signed was more like a "pledge" to follow the internet usage policy. Improper usage is most likely grounds for dismissal, right? What would be the point of having you sign an actual affidavit.

Answer: If you could prove that the affidavit is false by whatever means, then that would be considered perjury if it was a sworn piece of testimony and they could held in contempt. Everything balances on proof.

Answer: Since the search warrant was served it is part of a court file. The copy of the actual warrant left with you likely had the docket number on it. it is simple to go in front of a judge and get a subpoena for the affidavit. A couple of things to remember. The CI is not named in the affidavit no matter what your brothers in smoke say. An information that relates to identity is redacted. You only have the right to confront an accuser at trail. Also once you get the affidavit using any information learned from it in any illegal way will be considered an intimidation which would be an added serious charge.
