A Complaint for Modification is the action by which you can request that the Court make a change to past Court Judgments. If the Orders that you want changed are only Temporary Orders then you must request a change by Motion. A Complaint for Modification is the beginning of a new action and should only be used to change permanent orders which are called Judgments.
Question: IN massachusetts can a man file a Complaint for Modification if they have him as having a job that pays MORE? than he actually gets? LIke say they have him down as being employed for a military job but he hasnt worked that job for years and they refuse to change it?
Answer: One can always move for a modification in child support based upon a change in circumstances, but the legal burden on the person bringing the motion is to show a material involuntary change in circumstances not an easy burden
the courts can also impune income onto person based upon past performance, education etc
Question: How to Fill out Modification and Motion for Custody w/o too much information? I am filing for sole physical custody of my 3 year old daughter due to negligence (teeth pulled, fillings), suspected abuse and burn marks, and my daughter has no bed at the PRIMARY gaurdian's home and mother sleeps with bf sometime too.

Answer: Honesty is going to be your best policy. Don't lie or hide anything. If you don't come clean with everything that is wrong you won't win what you want. Don't try to play "nice" to your ex because when this goes full swing she's going pull out all the stops and attack you without stopping.
Talk to your attorney or whomever you are working with and go for as much as you can...if you can ask for Physical Custody do so. Remember that the sole purpose of what you are doing is for the best of your children and when you get a chance to say something to the Judge make sure you make that statement....."the only thing I care about is the welfare of my Daughter". Discuss everything with your attorney or whomever is representing you (You can get someone through family services on a sliding basis or low cost or nearly free depending on your income). Question: Has anyone filed a complaint against Sovereign Bank for how they were treated with their home loan? We have been jerked around by Sovereign Bank for the past 10 months while trying to get a forebearance/hardship and just recently denied for a loan modification, can anyone help us, how can we file a complaint against them and has anyone else had a similar situation happen to them concerning a home mortgage with Sovereign?
Answer: I have not personal worked with Sovereign Bank before but have worked with many other banks and home owners and know the frustration you are going through.
Banks don't usually like to bend for their clients (ie investors) assets if that asset is not severely non performing for them. Getting the banks to realize that you are wanting to help them is a feat in and of itself. I work with banks everyday and find most the time they are not rational but just following protocal.
One item i see that could have affected the outcome of your forebearance would be how you put together your hardship and the information you disclosed to the bank. Many time information just needs to be adjusted and sent back to the bank. However, it sounds like Sovereign Bank is being quite difficult in coming to an agreement.
You need to know that you do have more options than you think.

Question: What can I do to get my money back from a loan modification scam? I paid a company upfront for a loan modification service. I have been working with them for over a year, but now they are not picking up their calls, their emails no longer work and the website is down. What steps can I take to try to get my money back? I already complained to the BBB and filed a complaint to the FTC.
If I seek litigation, what steps should I take?
Answer: Unless you know where they are located, so a law suit can be placed directly into their hands, you can't sue them. If you can do that you need to prove in court that they did not do as they were contracted to do.
Question: Should I file for custody? I've posted before..I filed a complaint for modification of my original court order which was every other weekend visitation from friday to monday, joint legal custody, $200 per week, mother cover health insurance, nobody interfere with parenting time w/ dad, nobody to do child's hair except mom. Recently, my daughter has been complaining about her mom hitting her and spanking her while she (the mom) was mad. she had a burn mark on her leg from a curling iron. she was taken to the hospital and a 51 a was filed on mom. they definitely have trained my daughter to say that she does not get hit. They are living with maternal grandmother in a 2 bedroom. I got her medical record and it says mom had post-partum depression. She was stressed about getting an apartment and work. This was 3 yrs ago, and she never sought help. Could she still be stressed and taking it out on my daughter? The mother does not want anyone to do my daughters hair, but she pulls the sides of her hair ou.It is balled. All my daughter's mom cares about is her hair, not her oral hygiene or getting a place.

Answer: i don't i believe you... if half of this was true than why haven't you called social services? why wouldn't you bring her immediately to a hospital? wait, stop to ask a question on yahoo answers does make more sense!? maybe you also need to get over it, new woman or not, and figure out how to communicate with the mother of your child. you liked her enough at one point to procreate with her, so figure out now how to be a parent with her, even if the law has to be involved (on either side) for your child's safety.
Question: This whole transportation for visitation thing is nuts? So myself and my ex have a 2 year old, with whom I have visitation with twice a week for 8 hours a day. The frustrating part is transportation. When we were last in court this past July, I agreed to provide full transportation, but at this time she lived less than 10 miles away from me. She has recently moved and is now telling me I have to drive upwards of 30 miles one way to see my daughter, and I, of course, am not a fan of this. On top of the fact that I'll be doing over 1,000 miles per month to see her (63 miles round trip * 2 round trips per day * 2 days per week week * 4 weeks per month), but according to map-quest, I'll be spending nearly an hour and a half of each 8 hour visitation just driving, and that's not factoring traffic time. My question is this:
What can I do to make her at least meet me half way? Or to give me some added visitation time to compensate the amount of time it will take me to go see her and bring her back?
I know I could file a complaint for modification, but that could take months, I'd be lucky to see an end result by February. Any ideas on a sort of fast track method?
Answer: There is nothing you can do to make her do that short of the modification. You can ask her, she can legally say no.
Question: My mortgage company is messing with me. I have continually asked for a loan modification? I filled out all the proper information for they required but for some reason they continually are prolonging the process. it's been over 4 months now and they have thrown every excuse possible at me. I am not sure Y. I understand that they have allot of loan modifications to do but 4 months is excessive. I would like to higher a law year but im not sure what kind. Answer: Sorry, but a lawyer will not help your force the lender into a loan modification. Getting the modification is not a legal right you have...it's a courtesy the lender is extending to you.
In other words...the lender is under no legal obligation to grant you a loan modification.
Question: Losing house to Chase Bank after trying to do the 'loan modification' dance and an unbelievable escrow glitch? We've gone through the whole 'loan modification' song and dance with these turkeys a few times now and all we get is more grief and pain. We fax in all our personal information (minus our bank account statements) to them and they lost it, or so-and-so is on vacation, or the voicemail is full or they NEVER call back, or after 3 months of playing the game, it has to be re-submitted because it's expired...etc. In other words it never really goes to anyone that does anything with it. On one occasion we had faxed it in three times in a row and still no one knew where it was. I have renters living in the house that we are about to lose and they are ok with having to move in about 8 months, but we don't really want to give it up or wreck our credit...again. My husband has had to take a 5% pay cut at work at the same time Chase informed us that they didn't take enough out for the escrow account and that they need another 84$ per month to make up the difference. HUH? The weird thing there is that the property taxes went down, and the letter they sent says in effect, 'usually the reason your escrow account amount is behind is that your property taxes have gone up. Please contact your local tax assessor with any questions.' The zinger is that their glitch put us over the edge financially, our heating ($400!!!) and electric bill just drained us all winter along with other unexpected outflow of monies. Our renters are at their max that they can afford and frankly we are lucky to have them in there so getting higher paying renters (plus they took the option to buy and want to in 2 years) is not an option. We owe $112,000, the monthly payments have edged their way up to $1550, and it's not worth $80,000 in it's current neighborhood (3 foreclosures in spitting distance in the past year and one currently taking place have brought values to the ground). Any advice, ideas, resources? I know this is a prevalent issue, but I'm sure there is some sort of fraud being engineered and perpetrated on the people with mortgages at Chase Bank and its affiliates, I've seen a lot of the complaint websites, even the "F" rating they get at the BBB, but yet I've seen no recourse.
We are current on payments, but we won't be much longer, up in the air as to saving it...is that kind of negative escrow worth it??? We don't make a dime on renting it out, we actually lose. Since it's not owner occupied it's a little tougher to get help on it...but my renters really want to buy it, and since they can't for two years with their own credit issues, it's a big ole' mess.
Oh and it was originally written by Netbank Mortgage and then sold to Chase about 3 months after the purchase went through. We have requested the original loan paperwork but have yet to receive anything.
Answer: A few things you need to know are that Chase may have wrote the loan paperwork but after the loan closed Chase sold the loan to Freddie or Fannie and got paid a commision for generating the loan. The loan was then sold to Wall Street and then resold again to investors as a CDO.
So when you try to "modify" your loan you send it to Chase and it goes into the hands of a person working there drawing a salary and they must figure out who the loan has been sold to repeatedly; if those companies are still in business, who in those companies handles the paperwork, and how to get it to them for them to sign-off on adjusting the loan.
And when your loan is "bundled" with other loans by one company, resold to another company, REbundled again by that company, and resold again as a CDO which are chopped by in different slices it is NOT an easy quick solution for anybody. Your one loan may have been sliced up in over 6 different CDOs and each part of the loan is now having to be "modified" which affects the entire CDO and the investment group or groups that bought each part has to consider how your request affects the return on the entire CDO.
Also the person a the bank who you are dealing with has NO interest in the outcome of your case. They are getting swamped with requests that they simply are untrained for, unqualified to handle, and will not do anything to risk getting fired.
So YOUR personal situation and the fact that your income was cut 5% does NOT concern them. YOU bought the house, YOU signed the loan paperwork, YOU rented it out, and now you want them to cover the loss of equity for YOUR bad investment. Good luck.
Question: What actions can I take if I were scammed by a company who offers loan modification services? 7 months ago I sought out a company for loan modification services. We paid money upfront (I know) and decided to do a short sale on our house. We contacted the company to stop services because of the short sale. They already had completed a forensic audit for us, but had not completed the last phase...so they said we would get a refund of $1250.00. We signed the Settlement papers to get our refund, however we have not received the refund. Now, after contacting the company numerous times, we are not getting any calls back. The company still exists, but will not return any phone calls. Is there another agency or advocacy group that we can contact to get help with this situation. I already filed a complaint with the Federal Trade Commission. This company is in California. Please help. Also...don't worry about reprimanding us for paying upfront for services...we learned our lesson :)!

More and more mortagors who fell behind(Including those whose mortgages they have had for over 20 years-thus Not all sub-prime) are told to send in certain proofs several times, are told to keep paying modified amount for several months, are told to pay on line, (not by mail)are told that they will not receive receipts............and then all of a sudden, they receive a Notice of Intent to Foreclose? and then a Summons and Complaint in foreclosure.
Was this all a scam? With government and banks joined at the hip to categorically put people in more of a hole?

I have been hospitalized in the past. I have been to rehab and am clean.
I have been diagnosed bipolar 1 with psychotic features and was hospitalized for my mania. I have other mental health disorders as well. Including avoidant personality disorder.
I am unmediated. I can not afford therapy. Our local community mental health had such severe budget cuts they only do case management now and everything else is far too much for me to afford. So I have been without medication or therapy for 2 years now and my anxiety and avoidance has worrsened in the mean time due to the lack of therapy. I do not leave my house. So I do not work. Hence I require free services until I am well enough to be employed again and have no where to go to get them.
My significant other has blue cross blue shield they pay half and he is schizo effective and ocd. He is now 500 dollars behind because he can not affoard both therapy and taking care of me. Soon he will no longer be able to have services either. He is also 4 months sober.
I have no where to go and am just waiting shut in a house ot go psychotic again and he will soon be in the same boat. We dont know where to turn. CMH used to be an option but it is no longer and I dont know what esle is.
So first is cost. Secondly some referral service like they have for rehab. A central number that individuals can call to get directed to the help they need. We don't even know where to start looking and I know without the help we will both be in a bad spot.

What do I need to do? Here's the story...I fell behind - for a few reasons, VERY sick child, wife lost her job due to taking care of child. Fell behind on payments. Called Mort. Company and asked for help. Spoke to them to do a loan modification. They told me to pay April (this would bring loan current) and then not pay anymore because new loan is considerably less and will be done by then. (I am paying 8 and 12 percent now...OuCh) I have been calling them at least 1-2 times per week since May. I have also verified evertime I should not be paying asnd everyone agreed. And it is always "it will be done next Friday call back then.) Now we were served the summons without warning. Stated we are in forclosure and we should have been paying all along. I started recordiing my calls abut 2 weeks ago and have some of it on tape. Now what should I do withthe summons. i am about 4 months behind at 2500/mo..
Answer: I think you misunderstood when you were told to stop making payments. A mortgage company would never tell you that unless they had all the paperwork ready to sign for a new loan. Are you dealing with a sub-prime lender? Call the loss mitigation department of your current note holer NOW.

Question: Do you think a lawyer would take this case? a) My mortgage company offered to do the Obama modification program.
b) They filled out an app and said I was pre-approved
c) the guidelines state that until I get the final approval foreclosure proceedings stop. I qualify for all the guidelines - income, home value depreciating (for example the mortgage is higher than the value so it's almost like I'm doing them a favor to stay otherwise they wouldn't approve it)
d) they NEVER sent me paperwork about it even though I have recorded phone conversations telling me they would, telling me I was pre-approved, recorded conversations of them taking my app and everything.
e) They never told me my new payment amount, just that I should wait for my info to be underwritten
f) next thing I know I get a letter from an investor saying since my home is in foreclosure would I like to speak to him about it
g) I call them up saying wtf, am I really in foreclosure, and the 3rd person I speak to finally admits that I am and 10 days later sends me the notice. Supposedly I missed the first modification payment which they never informed me of and which is almost 1,000 higher than my current payment which doesn't make sense.
h) they are ignoring all my attempts to work something out. They totally mislead me, lied to me and I filed a complaint with the treasury they're not giving me a copy of the lender's response but one of the lady's on the phone secretly told me that part of their response states that they have no documentations on their end to dispute my claims - ex. they didn't save the recorded calls they say are recorded. They have no paper showing me that I had any payment due - I had no idea about it until they put me in foreclosure and verbally told me on the phone I had missed an imaginary payment.
My sale date was supposed to be 2 weeks ago, I postponed it for a few weeks more. I wouldn't mind going to the same exact terms before this hoopla started. NOw I owe tens of thousands to catch up in the course of 8 months. My 30 year fixed loan was FIXED at the time I signed it and without me seeing any paperwork or agreeing to anything they have 'modified" it to $900 more/month. It is such a joke I am losing sleep getting very ill over all this. They are a very large bank so I don't know if it'll be a lost cause fighting them. I feel taken advantage of, my perfect credit now has a foreclosure on it, all my equity is going away, I had remodeled the whole place brand new condition last year. I am so upset I can't believe this is happening it's like a bad dream. I wish i never watched those commercials Obama was on non-stop saying to apply for a modification to lower your payments. I believed in it, got suckered in and now they are taking my house away through shady dealings I have all on tape from my conversations.
I can only afford $5,000 in legal fees at the most - do you think any lawyer would give any good result and put time in for that much? Do you think I even have a case? I don't want to roll over and give up if I have a chance. I am somewhat confused. Did you stop making your regular monthly payments? If so, did you stop before or after you talked with the bank about a mortgage modification? Were you already delinquent on the monthly payments before you talked with the bank about a mortgage modification?
I suggest you contact a local attorney, preferably one who has some experience with mortgage modifications. Have the answers to my questions available. I would suspect the lawyer will want that Information. If you have a regular family attorney, go see him/her. If the attorney does not feel competent to handle a mortgage modification case, he/she will refer you to another attorney working in that area of law. If you do not have a family attorney and do not know an attorney working in the area of mortgage modifications, contact your county bar association and ask them to refer you to an appropriate attorney. Most likely the bar association will give you a few names that you can chose between. Time is of the essence in this matter and you should contact an attorney as soon as possible.
I cannot speak to what attorneys in your county will charge. However, most will provide some reasonable payment arrangements. Most will have minimal or no charge to listen to your problem and tell you if they feel you have a course of action.
If you cannot find an attorney to deal with the mortgage modification matter quickly, contact a bankruptcy attorney. They may be able to put together a quick bankruptcy filing to put a hold on the mortgage foreclosure and then find a way to resolve the matter for you.

Question: Is the attorney more worried about his license....? we had an attorney represent us for a child support/custody case, adn we found out over time (we received a finalized decree in March, we never got to see draft), through some memos and letters in the master court file, he had received the draft in december, and the opposing atty. wrote in a letter to the signing judge that our atty. verbally agreed to the draft. We found eight to ten significant erros, adn when we brought them to his attention, he told us to get a transcript and file our on modification. He ten told us he had new job, where he not allowed to handle domestic cases. We filed a complaint with our legal grievance board, and he received a copy of it this week. Since then, he's been calling my hubby nonstop, leaving voicemails he'll do anything to "straighten the case"- give us a full refund ($6,000), and fix the errors no charge until we're happy. Because of these mistakes, we are now $7,000 in arrears do to a mistake-filled child support order. Is he trying to cover his

Answer: Write down exactly what you want him to do. Write down how much money he has cost and how much you need to fix it.
Give him 30 days to do so.
Send him this information in a certified letter and if things are not rectified in 30 days, go forward with your complaint.

I have been battling Truman Foreclosure Assistance for six months now trying to get my $1600 refunded. This company sold me on the idea that they could help modify my loan but failed terribly. (In fact they made things worse. See link below from Complaint Board).
I had been promised a refund months ago, in writing, from David Bouffard, the COO of Truman Foreclosure, but nothing yet. Now they don't return phone calls or answer emails but still seem to be operating normally.
I have contacted the BBB and Chamber of Commerce, emailed and called dozens of times, faxed over my emails, but all in vain.
Short of getting a lawyer, any ideas on how to get my $1600 back that was promised to me by Truman Foreclosure?

Question: How about Obama using his air time to warn people in trouble with paying their mortgages that there are scam? ~~
artists out here making 'promises' to those such people that they are experts in 'loan modification'.
I feel so sorry for people. The mother of a friend got behind on her mortgage payments (not sub-prime), her house went into foreclosure, she saw a bunch of sites promising that in this case - lawyers - could 'work things out' even if a person was 6 - 7 months behind.

So she didn't check these lawyers out ~~ other than that they really were lawyers ~~ went ahead and paid one of them $4,500.00 back in January, and the one she paid told her she wouldn't have to pay anything to the mortgage company until they 'worked it out'.
So now here we are in April; she can't find the lawyer she gave the money to, the other lawyers say she "made the agreement wth him" and not themselves, and except that she has been saving her money, she is still behind. A check with the attorneys who are representing Chase Bank tells us that no one had ever answered the complaint in foreclosure, and that no one had ever contacted them regarding obtaining an extension to answer or to speak to someone there that may have been able to help.
And she isn't the only one these things are happening to. The lawyer she dealt with has basically dusappeared, but a further check determined that he had taken people's money in other states and then 'disapepared'.
So please Obama !
The little people don't have much of a voice. When you explain that peo[le can seek to re-finance their loans or otherwise modify them, make sure you also tell them that the morgage companies aren't all that willing to help them if they are 5 - 6 months behind or more.
But more than anything, President Obama, use your air time to warn people that the time is ripe for scams such as described above.
Never mind trying to please every fg body.
Take the time to help the mdidle class who are feeling the results of an economy gone sour.
