Question: When can you abstain from voting with Robert's Rules? I am drawing up bylaws for an organization, and we have come to the issue of abstaining to vote. I have heard two sides:
1) Anyone can abstain from any vote at any time.
2) Since abstaining is basically a "no" vote, you can only abstain if you have a conflict of interest or were absent for a related vote.
What's the bets call?

Question: conflict of interest with judge and attorney??? i recently went to court over custody of my daughter. her father got most everything in his favor and basically my life and my daughters was ordered to fit around his schedule. it seemed as though important information was being overlooked and judgements were being based with ridiculous reasoning, or none? anyways, i spoke with a new attorney to discuss reopening my case and she informed me that the judge who ruled our case and my ex's attorney share the same suite. also, the judge was retired and occasionally stands in on cases. i was told to file a complaint with the bar association, but is there anything to do to make a change in the rulings that have already been documented??
in addition to this, my attorney i just fired referred me to another judge/attorney who heard our case at one time, and has on several occasions not met my expectations and has made it seem as though each time we spoke we were meeting for the first time. this is the first time i have ever dealt with this type of situation, but i dont feel as though i was represented even decently? in the end (at our last court date) when i asked my attorney for an evidentiary hearing, she did not mention it to the judge and told me it was to late because the judge already made his ruling. i believe this is incorrect also. anything i can do about that? I feel as this whole case has been a joke to everyone except me!
Answer: The first thing you want to do is research. All states have "Rules of Professional Conduct" that all lawyers (judges included) have to abide by. The state bar association is who enforces the Rules of Professional Conduct but nearly every state has adopted those same rules into their Supreme Court Rules for more power against the those who break the rules.
Once you've done your research there, the next step would be to dictate a letter of your experience, with as much detail as you can provide, to both your state's bar association and Judicial Commission. The Judicial Commission (or Committee) has complete authority over all judges. Both agencies should inquire and bring an investigation against the judge you've mentioned and it is possible that your judge could not only be reprimanded by the agencies but also criminally charged.
The last and final step, and you will be able to do so, is appeal your trial based on the same argument you now have. You could possibly appeal with doing the above two steps, but the court will be much more likely to grant the appeal if they see you are exercising other remedies. Keep an eye on the judge and everyone else this time, if something doesn't seem right, have your attorney file a motion to recuse the judge - get ride of them.
In conclusion, if what you're alleging is valid, I would not only go after the judge involved but the other party's attorney as well. Not only did the judge violate several provisions, in what you allege, but the councel for the other side did as well.

Question: Why do accountants or CPAs give their clients investment advice? Is there a conflict of interest? I am a financial advisor & have been advising for a few years. I have a BS & MBA degree & have taken a number of accounting classes above my requirement; however, I rarely advise clients on tax issues or if I do I tell them to verify with their tax professional.
In my career, I have noticed that a lot of clients take investment advice from their tax preparer (rather they be a CPA or not). The advice they give in many cases is down right wrong or focused on the wrong thing.
Isn't there a rule or law that states that attorneys or CPAs can only advice clients on investments in a limited capacity if they are not licensed to do so? Are they also required to notify the client that they are not licensed to make professional reccomendations on investments?
I have had a lot of business killed by accountants that are really unqualified to give portfolio recomendations.
Answer: If they're giving recommendations as an individual then that's not illegal or immoral. It's only if they try to cash in on their financial training to make money recommending investment choices that there's a conflict. If it's just two guys talking about investing then how do you restrict that? People assume that accountants know what they're doing because they work with money - why is that strange?
A professional recommendations on investing means that you're paying the person for the advice. If it's your accountant that you pay to do your taxes and you ask for some stock tips, he's not doing anything wrong.

Question: What to do if the judge in your child support visitation case is bias? here's the story a friend of mine has a child with a women who works for the family court every time he goes before the judge she works for the judge sides with her and doesn't listen to the friends side before making unfair rulings. The friend asked the judge if him being over the case was a conflict of interest and the judge preceded to rule an outrageous amount of child support. Is this judicial misconduct? He can't afford an attorney he barely makes child support it's over half his paycheck. What can he do besides bend over and take it.
Answer: I can tell you exactly what happened, in short he pissed off the judge. You do not question a Judge, especially if you are not a lawyer yourself. See what your friend doesn't understand is that there are set amounts given by the state for the amount of child support a person can legally be obligated to pay. Usually for one child it is between 20-25%, but this is Gross pay, not net! So let's say you get paid $1000 a week. Then about $300 of that goes toward social security, federal, and state taxes, so now you have $700, but then you have to pay for your health insurance which is $100 a week, so now you have $600 a week take home pay. 25% of 1000 is $250, so take $600 subtract $250 and you get $350 a week!
I know it sucks but those are the rules, it is based on Gross, not Net pay. And it is at the Judges discretion on whether to give the 20 or 25 percent, or somewhere in between. The only way your friend has any case at all against the judge is if the amount ordered exceeded the limit set by the state. Like if the state law sayd 20-25% and your friend was ordered to pay 40%, then there would be a case against the Judge for an unfair ruleing.
But from the sounds of it he went into the Judge's court room and mouthed off and basically asked the Judge if he knew what he was doing, and then called his ethics into question, which is possibly the most sacred thing to a Judge. So, the Judge gave him the maximum....I would tell your friend to kiss the Judge's ass next time and he MIGHT not get the maximum, if the Judge is in a good mood.

Answer: There does seem to be a perception of bias.
All gays would benefit from this successful appeal. Either in being able to marry or to know their status is raised by having that right.
A heterosexual judge on the other hand, would be less motivated. His status would not raise or fall whichever way the decision went.
Also it might be fair to say that while 95% of gays would support gay marriage it is approximately only about 50% of heterosexuals. Thus for political and practical reasons a homosexual judge would be much more inclined to prejudge the decision than a straight judge.

They have the right to question their partner's motivations and, ultimately to leave the relationship if their needs are not being met, but everyone is an individual person with their own personal and physical integrity.
This applies to men as well as women. Say, for example, a man is in a high powered executive job when a couple marries, but shortly after the marriage has some sort of crisis (mental or physical) and decides to go into lawnmowing for a living.

Question: On Restitution of Conjugal Rights? I was harassed by my in-laws for various reasons, the primary one being on matters regarding handing over my salary to them. 7 months back I went back to my mother's house and I involved my widowed and dependent mother and other elders in the house to handle this situation by talking to my in-laws. However, this did not work. They were never open for discussion.
Instead my husband filed a petition for restitution of conjugal rights. There were a number of false allegations against me and my family in the petition. The most important one being that my mother prevented me from going to my matrimonial home.
In the petition my husband prays the court to restore his conjugal rights on me and expressed his willingness to take me back. But this was clearly to protect him and his family from 498A. When I came forward to talk to him about this - he put 3 conditions (which have not been mentioned in the petition). Some of his conditions were to enter his house only after quitting my job and disowning my mother and all my relatives. We tried for mediation, it did not work.
Now, my question is - since in his petition he has only stated that he wants me back as wife (conditions have not been added in the petition, that was only to harass me further), can I go to his house while the case is still pending in the court? Do I have to inform the court before i enter his house? What should I do if he / his family prevents me from entering the house?
If I divorce, then he goes scottfree. He does not have to compensate me for all my losses and can marry again. I do not want men to take women for granted.

To the replier - Truth Alone, I am sorry to tell you that you are jumping into conclusions. My husband earns well enough to look after the family, my contribution is not required in the form of salary to take care of day to day expenses. I have promised them that I will be supportive to his family in buying a house, what more do they expect from me. Ok, I have also agreed to quit the job if my husband assures to take care of my mother who has no source of income, which he has denied. Do you mean to say that I leave my job, see that my mother is in road and live happily with my husband who will treat me like a slave?? I request you to please be more polite in your answers.
Answer: Enter his home your matrimonial home in presence of two or more respectable members of the society who will be eagerly ready to enter the witness box in the family court and state the truth about his misbehaviour, including his demands and conditions which otherwise he has not mentioned in his Petition for RCR.
You need not wait for next date of the case to take permission of the Family Court for doing so, nor tell your learned lawyer this step you are taking as you don't know your lawyer may pass on this information to lawyer of the other party and spoil your game plan of collecting the relevant evidence of his misbehaviour towards you as well his not allowing your free entry in the matrimonial home rather imposing irrelevant conditions on you for doing so.
Once this whole game plan as explained here by me is carried out and your husband is taken by surprise any act that he does as he had being telling you with regard to conditions for your entry to the matrimonial home etc being witnessed by independent witnesses he will be in real soup as his Petition for RCR will fail after these witnesses tell the real story about your husband to the court.
His RCR petition fails that will be good evidence for getting order against him like protection order under the D.V. Act, as well for providing independent residence with all basic amenities for your stay and monthly maintenance for you.

Answer: Don't file restriction of conjugal rights. It takes long time and again you have to file divorce. Simply file divorce case, during court mediation if she willing to join with you take her with conditions otherwise proceed further. 498 A is criminal case they can file at any time. In case of 498 A get anticipatory bail from high court to avoid arrest.

Answer: If this wife of your is having sexual relationship out of marriage than better collect evidence with regard to this and straight away file for dissolution of marriage on the ground of adultery, cruelty and desertion for more than 2 years.
No use filling for RCR which will mean waist of time. Your marriage is already broken down and by the time your divorce case proceeds in the Family Court, there will be new ground available to you which is "irretrievable broken marriage" under which you case will be completely covering and give you benefit of obtaining divorce from her.
As far the issue such as maintenance is concerned that you may have to pay her even if you file RCR. But it is not necessary she will get it just because she is not working now but if she has source to maintain herself she may not get any amount from you, this all depends on the source of income and capability of both parties.
As far section 498A IPC, Dowry/Cruelty matter is concerned that she has no control as that is a State case against you and even if she compromise on this it will be left on the trail Court to dismiss that criminal complaint of High Court to quash the F.I.R.. No use waiting result for this criminal matter better go in for divorce straight away.
