Answer: After you're off probationary period, yes. During your probation however, they don't have to have a reason to fire you. They can just fire you and if you are let go during your probation, they don't give you a reason.
However, once you're a permanent employee, there has to be steps taken and warnings given until you're fired unless you are insubordinate or commit official misconduct.

Question: Could I change my court fee payments to community service? During my time with my court collection officer, i planned to set out to pay my court fees through a monthly payment service, being a full time student who is on a tight budget and summer being just around the corner, i was wondering if i could change paying the fee to serving time volunteering. I would call the office to check but they are closed at the moment.
Answer: The court is the only place with the specific answer. It may be possible to have it changed. You may have to file a petition with the judge. But again the collection officer or your attorney would be the place to start.
Question: Is is true that lawyers cannot knowingly lie by law since they are an officer of the court? Laura Ingraham a radio talk show host is a lawyer. She claimed that between 4000 and 5000 people attended a "Code Red" rally on 15 Dec at the US Capital. In fact, there were fewer than 300 according to the US Park service which keeps track of the number for every rally on park ground. Did she violate some lawyer code of ethics?
Answer: Not necessarily. Exaggeration or amplification of the truth is nothing new for lawyers. Besides, the code of ethics for lawyers is generally bound to the courtroom and the legal sphere, so anything Ingraham chooses to do politically is not really covered by the Bar Association.
Question: I've completed my court ordered community service hours. How does the court/judge get record of this? My date to complete my hours is 3/26 ( Wednesday) and the hours are completed. Am I responsible for letting the court know that it is completed? My probation officer and the lady in charge of the community service hours are both so flaky and almost impossible to contact so I am concerned that Wed is going to come and the court won't have the information.
If the 26th comes and goes and they don't have information that my hours have been completed will I get arrested? Does nayone know the procedure on that?
Answer: I am a probation officer AND I am in charge of community service at my department.
Typically, once a month, the places that we send community service workers to are supposed to send the hours into our department. I then take the sheets and enter the hours into everyone's computer files.
Now, when people have a certain deadline that is not in line with our once a month submission, it is in the probationer's best interest to ask the community service site to please submit the hours ASAP - as there is a deadline to get them done that is approaching.
So, while you stated that you had your doubts - you should check with your community service site and see if they submitted your hours. Then call the probation department to verify that they have received them. If your officer won't help you, maybe you can get the secretary who answers the phone to tell you if your file reflects the hours. Or, ask for your probation officer's supervisor.

Question: What can you tell a probation officer for failure to report? No B/S answers pleez...just need a little help or info.....had probation for a year for DUI, reported, got a job opportunity in another city and moved, now have a court date for failure to report to probation officer or complete community service. Is there anything I can do for court or tell my probation officer? She wants me to call her before I go to court to see if there's anything she can do.
Answer: How long till she goes to court? If you have time, go get some community service done, or at least show that you are set up at some non profit agency to start it, are your fees paid? are you still working? Basically, if you are doing good, working, and not getting into any trouble, its a technical violation, (not reporting)and usually they will reinstate your probation. also it will matter if there is a warrant for your arrest on the probation violation. If so, you may have to do a few days then when you see the judge on the violation, they release you and you start again.
Call her, at least that way you will know what she is going for. In these situations, the judge usually goes along with the po.'s recommendation, is she pressing for jail time?
sounds like it is a summary probation thing, and they are a bit more lenient in than say standard, or intensive probation.
Each case is different, but in my 20+ yrs of experience in the probation, parole or pretrial services they will give you a second chance.Community service is an easy thing to get done. alot of places will give you 2 for 1 hours if the work is hard ( cleaning up bad neighborhoods, painting over graffiti, etc) usually its folding clothes at thrift stores, or cleaning up churches. its boring and seems stupid at the time, but it is part of your sentence, just get it done. I had 360 hours a year for 4 yrs.
Good luck, it will be over when you satisfy all your terms. sometimes early if you pay up, do your cs, and stay out of trouble.
Question: What happens when you go to traffic court? I just got my first ticket..i was going 42 in a 25 and my ticket was $610. But since i am a provisional license holder i can't just pay it off...i got to go to traffic court. The officer said to me it was a wavered ticket. Answer: It all depends on the judge. Be honest and be respectful.
Question: Does a court martial leave you with a dishonorable? My stepson is getting booted out of the Army after the first of the year under an other than honorable discharge but his commanding officer said that if he doesn't behave in the next 3-4 weeks before his out of there that he will give my stepson a court martial. If he gets a court martial will that mean he will part ways with the service with a dishonorable discharge?
Answer: you can only receive a dishonorable discharge at a general court martial which is for heinous crimes. your step son would receive a bad conduct discharge if he were court martialed.
Question: Disregarding the Orders of a Police Officer questions and more? I am a 20 year old male who was walking down the street in Avalon, NJ at 3:00 AM and I was intoxicated. A police car came and me and my buddies all underage decided to run for it. I was the only one to get caught. I was never Breathalyzed or anything but told the officers I had been drinking. I was not arrested either but I was transported by the police officer back to my house. When I got to my house he issued me something like Bourough Ordiance 7:19 disregarding the orders of an officer. I am wondering what is the normal fine for that? Also given my story do I have any chance at getting off the hook if I show up to court with a lawyer? Also, I was recently plead another drinking offense in PA however but the offense became a disorderly conduct as long as I completed an alchohol course, did community service and had no police contact. Does this violate my agreement since it was in NJ? Thank you for the help.
Thanks for the advice everyone. I spoke to someone who works in the office and they said the fine wwas $80. I am getting the feeling that this is just like a traffic ticket and the officer cut me a break because I cooperated with him after he stopped me. The thing in both my cases I have never actually been arrested or mirandized or handcuffed or anything so I think it has a possibily to be lost in the shuffle since it is such a minor violation. My new questions is do I inform the judge that I had police contact? Could I just plead guilty pay the fine and try to hope the judge from PA doesnt check the records from NJ? Answer: As far as getting off the hook. If you try to challenge that in court, which you have that right, you will more than likely piss the judge off since the police really cut you a break.
If they find out about your agreement in PA they can contact that court, and yes, it would be a violation even though it was in another state. Making a big deal out of the incident in court is a pretty good way for them to dig a little deeper and find out about the agreement.
Question: Is there anyway that I can go back to court and reduce this misdemeanor? I have no probation officer either.? O.k...I need to get rid of this petty theft misdemeanor NOW! In January of this year, I took $25.00 worth of food, from the grocery store. I bought a few things and stupidly took some things that I could not afford as well and got caught. Answer: If you have complied with the terms and condidtions of probation and you are not on probation for any other offense... you betcha.. you can expunge your record.
I don't know what state you are in but in so you must check your state's penal code for the proper procedures. In the state I practice in (California) it is quite simple. In fact, the county clerk has a form you fill out, file, and serve on the DA's office.
You definately qualify for an expungement.
Question: I am going to take my LECSE (correctional officer), how should i dress? I am going to be taking this as a part of my application towards working for the sheriff's department as a correctional officer. The exam is at the Court House and i was going to go dressed with a shirt and tie or a button up shirt, but should i just dress casual? I figure since its for the job and its at the court house i'd dress nice but would like opinions. LECSE - Law Enforcement Civil Service Exam.
Answer: For the written just wear normal comfortable clothing. Clean and neat but business attire is not needed.
For any oral interviews do wear conservative business attire. That means no athletic shoes, a sports coat or suit, shirt and tie.
If you are doing both in one day go with at least a tie, no jeans and no gyms.
Question: Pasadena court community service question? I'm stuck.

Well, every place I go to do community service I'm asked for this paperwork I don't seem to have, paperwork such as a referral to do community service, even when I show them the ONLY paper I received, which was from my probation officer, and it was basically the time and date sheet of hours done.
So basically my question is,
is there an office of some sort in the Pasadena Courthouse where they give you this paperwork every location is asking me for?

Question: Never Ending Divorce Proceeding? Thought our divorce was on the home stretch. the appointed family court officer that throughly investigated and visited our home recommended i have sole physical and legal custody of our 6 yr old son ruled in my favor. My stb-ex walked out us with no warning without support nothing no help it was almost a year that went by before I got to see him at our first mediation that totally sickened me when I saw through the fake tears of my stb-ex acting like he missed his son so much. It was almost a year before I filed for divorce year having no contact at all we were financially dependant on him and he left us to rot. Once I filed for divorce he responded with a counterclaim for custody and accused me of being a drug addict. I could not believe what a creep he had turned into so we were ordered to family court services for a through investigation and evaluation, they sent out questionaires to family friends counselors and teachers., they requested school records and came to our home for a supervised home evaluation and we had to submit to random drug tests. After all was complete the family court officer submitted to the court his recommendation that i be awarded sole physical and legal custody of our 6 yr old. After all that was completed we now had to attend the financial evaluation aspect. Her i am thinking we are almost done finally. Well not so fast! At that meeting the lady interviewed us asking various questions as well as asked if there were any concerns that each of us had? My stb-ex out of the blue says yes she is a drug addict and I am willing to pay for a hair follicle test! He also admitted that he would test positive for THC. Mind you he has not complied with any one of the court orders that were made by the court and at that meeting I had to bring to her attention that a default hearing was scheduled and a writ for his arrest was in process, and just recently I had to haul him back into court for contempt and he entered a plea of guilt with purgr conditions attached. And still he defies the court orders. Now this! He is prolonging this whole process and he admitted it to me. He told me he planned to fire his attorney at the very end and request a new trial with new lawyers. I'm broke barely get any help my lawyer is frustrated because he is pro bono. After he offered to pay for a hair follicle test but has defaulted on court orders I walked out and said I'm done with this meeting there are no visitation issues and the family court officer made their recommendations for custody with a schedule I went through all the requested pain in the ass hoops that I never should have had to. He walked out on us and left us to rot nearly a year ago I took my son and myself to counseling and have struggled financially to hold on to our home and my sanity. So no I am not agreeing to anymore of these ridiculous requests that he is offering to pay for. Tell him to use that money and apply it to the defaulted court orders he will soon be answering to. How can he be allowed to keep doing this? Needless to say I left and refused and we await another hearing with that company hopefully to resolve the financial aspects.
Was I within my right to refuse? How can he do this?

To this day I can only guess he is till drinking .A retired cop and court officer received 90 days in jail and six months house arrest Wednesday for a drunken driving crash that left another man severely injured.

The sentence handed down to Joseph Wojtas, 72, of Center Line, by Judge James Biernat of Macomb County Circuit Court upset family members and friends of the victim, Joseph Sengstock, because they believed it was too lenient.
Wojtas pleaded no contest to the original charge, drunken driving causing serious injury, which carries a maximum penalty of five years in prison. Sentencing guidelines indicated a sentence range of only zero to 14 months, and probation officials recommended 18 months probation.
"He should have gotten five years," said Sengstock's mother, Linda Sengstock, outside the courtroom. "He needs to have time to think about what he did. What he (her son) has been subjected to is beyond comprehension."
She claimed that if the victim had been Wojtas' age and the defendant her son's age, 30, the penalty would be stricter.
Joseph Sengstock Jr. of Sterling Heights will require around-the-clock care for the rest of his life. He remains bedridden with a closed head injury and multiple fractures in the head and face. Two arteries were torn, causing a stroke, and he is blind in one eye and partially blind in the second eye.
"He's handicapped for life," Linda Sengstock said, adding she has been told the cost of his lifetime care will be $5 million to $7 million. The family has already filed a lawsuit against Wojtas in Macomb circuit court.
Biernat, who also sentenced Wojtas to the longest probation term possible, five years, noted that Wojtas had no prior criminal record and a lifetime of helping charitable organizations. The judge noted he served more than 20 years as a "decorated member of the Detroit Police Department" and an officer at 37th District Court in Warren. Biernat received many letters from police officers, lawyers and judges attesting to Wojtas' good character.
Still, the judge said, "A crime can destroy a lifetime of dedicated service and charity. This is something Mr. Wojtas will have to live with the rest of his life.
"The court is mindful that the family is in ... agony over this sad and tragic event. Given the gravity of the offense, given the high level of alcohol involved, the court believes a 5-year probation term is appropriate."
In asking the judge to exceed the probation department's recommendation, assistant Macomb prosecutor Jamie Wittenberg pointed out that the charge is too broad because a serious injury can range from "losing a finger" to the near-fatal injuries suffered by Sengstock.
The victim's father, Joseph Sengstock Sr., said Wojtas should suffer greater consequences because of his former position as a police and court officer in which he saw firsthand the potentially dire consequences of drinking and driving.
"He should have more respect for the law serving as a policeman," he said.
Wojtas, whose blood-alcohol contest registered .19 percent following the crash, was speeding out of a parking lot about 4:40 p.m. Jan. 11 when his Mercury Marquis car hit a boulder, went airborne and hit Sengstock's 1976 Cordoba that was stopped for a traffic light at 10 Mile and Sherwood roads in Center Line, according to Center Line police. Sengstock's car was pushed into a semi-truck.
Sengstock had finished working that day and was on his way to visit his grandfather, Anthony Bugliesi of Center Line, his family said.
He graduated from Notre Dame High School in Harper Woods and most recently worked making robots for Utica Enterprises in Shelby Township. He also worked part-time at a group of bowling alleys.
He had lived on his own for several years but had moved back to his parents' home to be with his sister, Christina, for her senior year in high school.
About two-dozen supporters of the Sengstocks attended the hearing.
Wojtas spoke at the hearing but was inaudible to court spectators. His sister spoke and apologized to the family.
"I wish to express my sorrow," she said. "Our family and friends continue to pray for this man."
Wojtas' attorney, Albert Markowski, and a probation officer said that Wojtas has displayed sincere remorse about the incident. Markowski said Wojtas did not "publicly express his sorrow" due to legal reasons.
Sengstock's family members had accused Wojtas of being unremorseful and continuing to consume alcohol, driven to bars by friends, despite daily alcohol testing at the Center Line police station. Biernat in June placed Wojtas on a tether due to the allegations.
Markowski denied his client had been drinking.
The 6-month tether that Wojtas will be required to wear following his 90 days in the Macomb County Jail will include a device that can detect alcohol use.

Answer: Wow this really hit a nerve. There is NOT MUCH JUSTICE IN MACOMB COUNTY. I have had Warren police beat my son so badly he had to be hospitalized, because he was ill and couldn't answer some of their questions.
He was in for 5 years till we got the right attorney. It is horrible!! Just middle class people trying to do the right thing.
Question: how long should it take a community service officer to contact you for a minor offense in CA? 22 days ago I recieved a ticket for a minor infraction because I am under 18 I did not get an assigned court date it only stated that my parents would be contacted. Then about 9 or 10 days ago I recieved a letter saying that we would be contacted by a community service officer sometime soon and we haven't heard anything yet. Anyone know how long I should wait and is there any way for me to contact them? I receieved the ticket in Laguna Beach if that makes a difference

Question: We now know police did not inform social services of my childs abuse, what can we do? we have been told by the children and family court advisory service that the police are supposed to contact social services and child protection authorities when a child discloses sexual abuse. This did not happen in our case, my daughter was not questioned by social services or child protection officers, and the CPS came to the conclusion the abuser could not be charged due to insufficient evidence etc. The children and family court advisor said that this is very wrong and the police should have contacted these other organisations, and the CPS should not have come to the decision they did on their own.
What steps should I now be taking?
Answer: Without more detailed information of the case, it is impossible to give you an accurate answer. Ultimately, however, it is the CPS's decision, and theirs alone, whether to prosecute. The police provide them with the evidence, which would include a police interview with the alleged victim, and the CPS make the decision, which is based on the evidence and the likelihood of a conviction.
If Social Services were concerned that a child may be at risk of abuse and/or the parents were unable to protect the child, they would make a risk assessment in relation to this, and whether the child needs to be placed on the child protection register, but they are not directly involved in the prosecution unless they were witnesses.
