Answer: They probably wont dismiss the case. The custodial parent will probably show and win by default. That way they will use it against you later.

Answer: It's difficult to answer this question. We don't reaaly have enough information to answer it. For example, what were the points that were sustained during the trial? What was found on discovery? What are the circumstances that have changed to broach the subject of dismissal? If any witnesses to the first motion follow through with the rest of the case, chances are slim that it will be dismissed. In other words, if the person that applied for, and received the protective order pushes it, you aren't going to get a dismissal. If someone feels threatened enough of you to pursue a protective order, they have already presented evidence to have the order granted.

Answer: It is a sort of dismissal, the employer wanted you to leave as it wasn't working out. Although you were unhappy and wanted to leave anyway. It's a bit of a difficult one really, although it was mutual, your employer wanting you to leave is still part of it.

Question: Does a union have to support an unfair dismissal case if I was a paid member at the time of being dismissed? I was unfairly dismissed and was a paid up union member at the time. I subsequently missed a payment and despite offering to bring payments up to date am being told by my union rep that they are refusing to now support me on that basis. Answer: Write to the union headquarters.
It may well be they are using that as an excuse as they know that you have no actual case against the company and would prefer not to represent you.

Answer: You would better substantiate this by informing the police and filing a complaint before dismissing him/her. That way you are protected from any kind of legal action.
If you have hard evidence (video) I would do something like this, and attach a copy of the police report, and trying not to call him or her a thieve literally (just in case your Labor Laws are anti-employer, which happens in a lot of countries):

In New York State, should you go before the judge in your "appearance hearing", this is your initial hearing, when you only offer the court a pleading of guilty or innocent, you will be scheduled a "trial hearing". All parties to that trial must be present in court. Should you plead innocent, and all parties are not there to represent themselves, you win. It would be the same with a minor traffic ticket basically. The burden of proof lies on the defendant (The Cop, The State, The County, whoever issued the DWI), if they don't show up for Court, after a preliminary hearing has been held, and a trial has been set, then yes, your home.

Answer: Really, that's about the best you can do in California. You can try filing a PC1203.4 petition (a simple form you can get at the courthouse), which will "expunge" the charges. However, it will still show on your record. The only advantage of the 1203.4 in your situation is that it will (theoretically) prevent potential employers from investigating the arrest and/or using it against you. However, that's just theory, and any smart employer can still use it against you without opening themselves up to violations.
You can TRY applying to have the record sealed--if memory serves, it's PC841.8 . . . however, that requires a finding of "factual innocence" which apparently didn't happen in your case based on what you've said.
