Question: What are my chances of getting joint legal custody without a lawyer? I want to file for legal joint custody of my 1 year old daughter. When the mother first took me to court I was made out to be evil. I had to take parenting classes, random drug tests and supervised visits. I did all that with flying colors. Now I want more time as I only get her 3 times a month for 5 hours. How can I proceed?

Question: Who is responsible for the lawyer and educational bills of the child when the divorced is joint legal custody? In a joint legal custody divorce decision are both parents responsible for the childs legal (if necessary) and educational (summer school, etc.) expenses equally or does it all fall on the person who has sole physical custody?
Answer: That depends. Is there a child support order in place. Normally if a man is paying child support the mother must take care of all other expenses UNLESS noted in CP agreement.

Question: Is there such a thing where one parent can have full physical custody and both can have joint legal custody? My boyfriend wants to move out of the state to pursue his education and the mother wanted to seek full custody. My boyfriend has full physical and legal custody right now. The mother is okay with us keeping full physical custody of the child but she wants joint legal custody. Answer: No, but it is possible to have joint custody where the parents have the child equal parts of the time, but one parents residence is the primary residence considered for school attendance. What I am wondering is why all of a sudden does mom want joint legal custody. Also, does your boy friend have legal custody of the child or has mom just let him keep the child. If he already has custody legally and there is no provision that he can't leave the state with her, then he only has to figure out with mom about the visitation. I think he needs to contact an attorney.

Answer: Some states call it primary custody, others call it physical custody but the bottom line is that person is entitled to child support. SO, if you are not legally identified as that person you can not receive child support, and until you are legally identified as that person you have to continue to pay child support.

Answer: Legal custody means that in legal decisions you both have to make the decision and are responsible. Things like Health Insurance, what school the kids go to, if they can leave the country etc. Full physical custody means that the kids live with you. Unless there's a court order you wouldn't have to let her see them. In most states if there is a legal disagreement the court sides with the parent that has physical custody.

I was in another state out of california and she got what is temporary sole custody and they said it was up to california to decide custody. I am now in california and im trying to see my kids with no problems. If i applied for joint legal and physical custody what are the odds of me getting that?

The father's family is a good family, but they work at the school that she (5 yr. old) went to last year. Answer: Easy. Deduct her share from the next child support payment. Don't forget to send her a copy of the bill so she knows why the payment is short.

Answer: I have two boys and when my ex and I got a divorce back in 98. I got custody and he got visitation. They gave him every other weekend and 1 month out of the year and he was ordered to pay child support and I got to claim them on my taxes. He has never taken them for a whole month and his every other weekend dwindled down to never and he is over $ 40,000 behind in his child support. Take it back to court. Get it modified. Answer: Without knowing more about the specifics of your case, I will offer a "chances are" scenario.
Courts generally award joint legal custody of children to both parents, however physical custody is usually awarded to the mother. Physical custody carries the right to make the day to day decisions regarding the child. Joint custody obliges both parents to consult and make joint decisison regarding the health, education and general welfare of the child.
Visitation schedules for the father where the mother has physical custody can vary from being very detailed and specific to only detailing holiday schedules.
For you to impose supervised visitation upon the father, you will have to make a strong case about why that is in the best interests of the child. If you petition the family court about this, the judge may come to a decision in a number of ways - some quickly and some not so quickly but expensive. For example, the judge may require a psychologist's report. You and your husband are responsible for paying that psychologist.
You mention the father's incompetent or immature behavior. You will have to be more specific than that and have it documented.

Answer: You may file a contempt proceeding in court to enforce the court's order, and to request that she purge herself of the contempt by paying back the amounts. The court may issue an order to show cause - and if she is found in contempt - she could be facing fines and/or jail.

Answer: I'm not familiar with Georgia family law statutes, but if he's complying with the Court Order and scheduling the vacation during his visitation time, then you have no right to refuse his plans. You can probably petition the court to order him not to go on the vacation, but it seems very unlikely that the court will grant that request, and you'd just be wasting money on legal fees, since it doesn't sound like much of an emergency.
