Question: Sexual Assault? I was searching for sexual predators in my are and I found this guy I know and his conviction is listed as "NJ014 - AGGRAVATED CRIMINAL SEX. ASSAULT"
Can somebody elaborate on just exactly what that may mean.
This is in Pennsylvania. I know they guy from coming into the beer store I work at. He is a true scumbag and I've almost gotten into fist fights with him on a number of occasions.
Answer: It means the person has been found guilty and convicted of the offense of a serious sexual assault on someone. This may have been a woman or a man or a child. It really means that the person used brute force, punching, hitting, that kind of thing then they sexually assaulted the person. The man could have punched a woman/man and grabbed his/her breasts/genitals and touched her/him in private areas, whilst holding her/him down and using force. It does not normally mean rape.

I passed out on the floor next to a bunch of friends and the next morning I woke up and a guy I hadn't seen since high school was trying to undo my bra and had his hand down my pants. There was no digital penetration. But he was as close as you can come before that. Is this sexual assault? This guy was not at my house when I passed out he came over long after I had passed out. Also this happened at my parents house with 10 of my close friends all passed out around me. I also woke up and told him to ge tthe he** off me. I told my firends about it the next day and they told me not to make it a big deal since nothing really happened. So I just kind of forgot about it until a discussion we had in one of my classes today.

It sounds more like sexual misconduct. Sexual assault occurs when the act involves force, violence or threat of intimidation. Sexual misconduct is non-consensual intentional physical conduct of a sexual nature. Since he basically invaded your privacy, and you are unharmed and not afraid of him in any way, I would seek the advice of a lawyer before filing charges. The legal cost alone would be staggering.

I am a student researching disclosures of sexual assault on social networking sites. To help my research I would really like to understand what are the impacts (positive & negative) of disclosing sexual assault or abuse on social network sites in particular for young people.
Answer: Online is easier and very private but the advice could vary and it may be harder to get help.
A phone call would be uncomfortable at the start but it would make the victim feel less alone and they would receive better advice and support from the one on one communication.

Answer: most of the time it is the lack of professionalism in the media, they fail to get it right. But even law enforcement is inconsistent in their definitions. Rape involves penetration - sexual assault may simply be unwanted groping or touching.

Answer: I think one has to do with touching the genitals of another. Molest can be unwanted touching as can sexual assault, but can also include touching boobs or rubbing thighs etc where (thank you Bill Clinton) sexual touching is not involved.

Give as much details as possible, including photos, receipts, addresses of employment (Other surfing instructors may be doing the same thing to their clients/pupils), etc.
Then get in touch with the District Attorney's Office within your region/county. An undercover operation may be needed to flush out any and all wrong-doing at that place of business. It may be some type of "acceptable" practice at that place of business that needs to be addressed by an authorized criminal investigative body.
Notify the National Organization for Women-N.O.W.- through the phone book or through your church help group. You may want to contact an analyst or physician about the matter or even your local clergy.
Details and proof are essential as is the strength to follow through with your efforts or else everything you feel and attempt will be lost. Others may have been wrongfully challanged or harmed as well. Chances are, once someone gets the ball rolling, others will step forward and perhaps a class action law suit may be filed.
Seek the advise of an attorney, the Legal Aid Sociaty or the American Civil Liberties Union for court action. You may be the victim of someone who has perpertrated a crime against others as well. You may also contact the press, radio call in shows, t.v. news station or the local print media-newspapers. Try writing a Letter-To-The-Editor to more than one newspaper about the matter.
It is much easier to win a civil case than it is to win a criminal case against someone. The 'Beyond a Reasonable Doubt' clause does not apply in a civil case. But, you would still need some satisfying or substantive evidense to proceed in a civil case.

The point is, there is no one solution, but a myriad of choices and avenues you can persue. You should not be ashamed of being a victim. The Surfing Instructor is the one who should be ashamed of himself as should the business or employer that hired him. They are the culprits, not your girlfriend.

Answer: I've been told that you can never really trust anyone as a result it's caused me to be quite paranoid when in public. I won't go through parking lots without looking under cars for creepers that could possibly pop out and assault me. I carry mace on me and never let people get too close to me. Girls are often seen as vulnerable I guess this is why we often come off as too cautious.

Answer: Depends on the age of the victim,if the victim has to give evidence i think it would be by video and no one except the judge will know the victims Identity.

I've heard from different people on this, but aparently there is a HUGE number of military-women within the U.S. military who are sexually assaulted or raped within the military, I've heard from 1-in-3 to 1-in-10, I mean I know any form of sexual assault is a problem, but is it a big problematic problem. My question is, are the numbers really high in the military as others have said, and what can one do to stop/reduce this from happening any further?
Answer: I dont know if your stats are correct but i do know that its a huge problem not only with women who are serving but alot of women on base period my friend who is a Lt. in the army based out in washington has to deal with the paper work on these cases all the time... women are constantly harrased by other soldiers and are often forced to have sex not always physical force but i know when another friend of mine was in Iraq he was telling me about how one of the commanders suggested that one particular female do "favors" and when she refused she was assigned to the more dangerous patrols more frequently ... but to be honest these cases are not as frequent as i think you said its more common for women to be sexually harrased not so much as raped and honestly from wht i know they really try as hard as possible to prevent this different seminars and stuff and when stuff does happen its handled quickly and seriously

Answer: hmm, if I get what your really asking I have an answer. (If you were assaulted.) Animosity, you don't have to post who you really are and you can get support, or just the, "I'm sorry that happened to you." The positive side is that you get relief from actually letting someone know it happened, gain courage to go further with it, and simply heal from it. The negative is worry that someone you didn't want to know this, finds out, that you will be told you are wrong, and that you may be shunned/ridiculed. Hope I can add an insight.

Answer: Under section 271 of the Criminal Code there are numerous circumstances that must be considered particularly if the victim was a minor.
My understanding is that there is no statute of limitations and that the maximum sentance is up to 10 years in prison. It's considered a federal crime and therefore not limited to a particular province.
