Stipulation

A point or condition agreed upon by the parties.

Question: What is a stipulation if judge does not sign ? My mother was given a stipulation to move in 4 weeks. The lawyer for the bank "owner of her home" gave her the stipulation to sign. Her hands it to the judge, the judge says she wont sign it until she gets "ratification" from the lawyer. The stipulation she took home was not signed by the judge. Is this still valid? This is very important, please answer if you have legal knowledge. Thank you.

Answer: A stipulation is something that both parties in a legal dispute agree on. The bank is asking your mother to agree to move out. The judge is saying that your mother's attorney (and by association, your mother) are not agreeing to it so he will not sign it. This gives your mother and her attorney at least a chance to dispute the foreclosure but, really, she is probably just delaying the inevitable.
