Question: When you when a small claims court, do you automatically start wage garnishment procedure.? I'm just carious, lets say if you lost a case and you owe someone $150. Can you do wage garnishment even if the debt is small or is their a certain requirement. What about states that prohibit wage garnishment unless its federal law like child support. How does the winning party make sure they get paid in small claims court, its not like you can ever go to jail for debt.
Answer: Actually you can go to jail for not paying, what you lose in a court case, in some states, for contempt of court. If a judge says pay it and you don't.
Question: Is it a violation of privacy laws if a bank releases info regarding a garnishment to a joint account holder? This bank called my brother-in-law (joint account holder) and told him he should get off my account because they received a garnishment from a court. Is this legal?
Answer: Yes. If his name is on the account, he is legally permitted to know all information concerning the account, hence the name joint account. Basically, the bank is sending him information about his own account, it's not just yours when you feel like it should be.
Question: What rights do I have for wage garnishment? I am willing to pay on the principal and not the added fees and interest. Garnishment payments have started but it has been quite a hardship, since the payments have cut my take home in half, causing me to start being behind in the major necessities(rent, food, home amenities). Answer: Unfortunately, you really don't have many options here. You really can't decide that you only want to pay principal and not fees and interest. If they are garnishing your wages, they have already tried to collect the debt, sued you, and won. A court has awarded them an amount and the right to garnish. The time to make those offers has passed. The debt collectors don't really care that you might get behind on your rent. Depending on how much this is, you may need to get a second job or supplement your income somehow to pay.
Question: Can consolidating a loan get it out of garnishment? What are some options for federal student loan garnishment. I was in a horrible car accident. In process my loans fell into default. At that time that was the least of my worries. Now walking and totally recoved it is my new nightmare. On top of $300 per month garnishment they want payments of 600 per month. Please help.

Question: Once you receive a garnishment from the state, is there anything you can do to reverse? I received a wage garnishment of 25% for unpaid taxes. Answer: It's not a garnishment but a levy. A garnishment requires a court order while a wage levy does not. Virtually all states have the power to levy wages and other assets (bank accounts, investment accounts, etc.) for unpaid taxes without securing a court order.
Waiting until your employer has a wage levy is letting things get way out of hand. You SHOULD have been setting up a payment plan with the state as soon as you became aware of your debt. A levy never comes out of the blue; you would have received and ignored several notices before they would resort to this drastic last-ditch measure.
Now that a levy has been placed the state has less incentive to accept a payment plan though most will. Contact the state DoR about setting up a payment plan. Once that's in place they should lift the wage levy, however don't plan on them refunding any amounts already recovered via the levy.
Question: Where can you find examples on the answers to a writ of garnishment of property as the garnishee? I received a Writ of Garnishment of Property in the mail. As the garnishee I am required to file a written answer to the Writ. I have never done one of these before and am looking for examples to these answers. Any suggestions?
Answer: Sure, I do these everyday as an attorney for a local government. Not sure what the form looks like in your state, but in my state, the answer to question 1 is just a calculation of the employees wages. You have to subtract tax withholdings and other deductions "required by law." So your bottom line is what the employee earns after MANDATORY deductions. In my state health insurance for a child is mandatory. Question no. 2 should be that you do not owe the employee anything except wages. Question no. 3 should be that you have no property of the employee except unpaid wages. Question no. 4 lists any other garnishments against the employee. Question no. 5 is whether or not you are withholding child support. Question no. 6 is just a statement that you have given the employee copies of all the garnishment documents. Question no.7 is whether you have incurred attorney fees in answering the garnishment. That leads me to an important point. In my state, if you hire an attorney to answer the garnishment, you can withhold the attorney fees you incurred in preparing the answer. Therefore, if you don't know how to answer, you should be able to consult an attorney in your state and get your fees paid by the employee. Here's the problem with your question: I can't be sure your form is the same as the form in my state. If you hire an attorney to do this once, you have a form you can use forever.

Answer: Most likely both garnishments will apply to your wages, however they will be proportional now. It will still be limited to the state ceiling of 25%.
Question: PLEASE HELP: How common is genetic testing if I want to get it done in Canada for a hereditary brain disease? My mom has severe Ataxia of the cerebellum, where her motor skills are bad and she has no balance so she cant walk. My brother has showed signs of the disease ,so has my maternal aunt's daughter and maternal uncle's son. I havent showed big signs but feel my balance going awry a bit. I know the gene that causes the specific ataxia can be identified and also noted in offspring of a family line. I would like to get genetic testing done to see where I stand. Answer: I suggest you visit http://www.ataxia.org/. This is the national ataxia foundation in the US and you should be able to find a lot of info here if you haven't already. In terms of testing, there are plenty of places where you can get the testing done depending on the specific gene in your family. You can visit www.genetests.org to find a lab that tests for your specific gene. University of Washington in Seattle, WA has a fantastic ataxia clinic, and so does Baylor college of medicine in Houston, TX. Goog luck to you.
Question: When is the medical industry going to use genetic testing to diagnose illnesses? Traditional medicine is just so inferior compared to genetic testing. There have been so many times that certain medical events have happened to me that I believe are genetically related that the doctor says are not. I don't believe them and I hope that genetic testing comes into the picture so I can say to them, "I told you so, moron!" I find that doctors never listen to the patient anyway...maybe the DNA will finally be the key ingredient that makes the doctor listen.

Its use is not widespread and commonplace. The average Joe does not have the opportunity to have a genetic test performed because of cost.

Answer: It is already being used, but not all diseases are genetic. Many, many are not.
Genetic testing is also very expensive. If you have a sore throat, you need a $5 throat swab, not a $5000 genetic test, to see if you have strep.
If your doctor is not listening to you, it could be:
*He/she is too busy trying to see enough patients to pay for the rent on his/her office
*He/she is a jerk, and you need to find a new doctor

Answer: First most genetic tests run from about $40 to $50 depending on the test and lab running the test.
First you can DNA typing which if you have the DNA type of the parents can verify parentage. However it WILL NOT find a parent or breed. If you do not have the DNA typing and know who the parents are it will not find them for you or tell you what breed your horse is.
Other types of DNA testing is for genetic defects like HyPP, HERDA in QH breed CIDDS in Arabs and LWO in paints.
JUST SO THERE IS NO MISTAKE. DNA TESTING CAN NOT TELL YOU WHAT BREED YOUR HORSE IS AND CAN NOT PICK OUT PARENTS WITH OUT THE DNA SAMPLE FROM WHAT YOU BELEIVE TO BE THE SIRE AND DAM. THE DNA TEST CAN ONLY TELL YOU IF THOSE HORSES ARE THE SIRE AND DAM OF A GIVE HORSE NOTHING MORE.
DNA TESTING CAN ALSO GIVE YOU GENETIC INFO OF THE COLOR OF A HORSE THERE IS NOT A TEST FOR EVERY MODIFIER. EX DUN

Answer: I don't know exactly what kind of genetic testing you are talking about, but if it is in general, here's a quick list.

One will know what diseases you may possibly have in the future and could take pills to prevent or retard the diseases.
Smarter and more beautiful babies can be made (through "Intelligent Design").
Genetic diseases could be completely wiped off the planet (once doctors find the gene sequence that causes the defect).
Virtually every organ can be created by stem cells (and would also eliminate the necessity to try and create artificial/mechanical organs).
Clones can be made possible; this would have a number of uses, which range from being able to start a sheep farm with only one sheep to cloning yourself so you could be in two places at once (or, as in the movie THE ISLAND, have an extra clone for organs if one you get in an accident).
Cons:
There will be a psychological effect on the person and he/she will worry about that disease 20-30 years before it takes effect.
The morality of genetic research is questionable, since most stem cells are obtained from aborted fetuses (however, recent research indicates that the amniotic fluid that comes out of a mother during birth has stem cells that can be used instead of those that come from aborted fetuses).

There aren't as many cons as pros because the main argument against genetic testing is that it's immoral (but if you need the same amount of pros as cons on your lab report, you could probably think of counterstatements to the pros I gave you).

Answer: They check that through your blood work, I have four children and when they were tested for spina bifida my two daughters tests came back saying that they may have it so I had to get an early ultrasound with both of them and they were both born healthy baby girls.

Answer: Direct-to-consumer tests would leave people open to abuse. An employer, insurance companies, governments, or even in-laws bullying people into submitting to tests to "weed out" potential "problems". When it comes to money, religion, or politics, such a thing can, and has, happened.

There are tests available which can be carried out on 2 adults before they conceive.
Down Syndrome is inherited from the parents - this is and easy way to find out what chance the baby will have of developing the syndrome Down Syndrome (trisomy - 3 genes instead of 2).
If the chances are high then it is the ADULTS responsibility to NOT GET PREGNANT!
