Question: child support? does child support has to be claim as income on state and federal tax returns?

Answer: Hi, Mary! The IRS clearly states that child support is never deductible to the payer and never taxable to the recipient. The Virginia individual return (Form 760) uses the federal AGI, and neither the instructions nor Virginia Schedule ADJ make any mention of adding child support back into income.

Question: Child Support? If you are owed back child support, will they deduct it from their tax returns? She is paying now, but we are still owed about $1500 back support.
Answer: They are suppose to offset it with their tax refund if they owe on arrearage. However, I wouldn't count on it. It will depend on if the right form has been filed with the IRS by the agency collecting your child support payments. I live in Missouri and I have over $10,000 owed to me in arrearage. I have only seen 1 small refund intercepted in 10 years. I have made many calls to no avail.

Question: Child support ..........? The father of my child is in England and we are not together and he wants nothing to do with his son. Answer: Go to a child support advocate. Have you talked to your father? Don't listen to your mom, she just wants to keep your money.

My daughter is 20 months old .I applied for child support when she was 3 months my case was closed and reopened in July of this year.I basically forced her father to take a DNA test.He doesnt visit and has never paid a dime.I have provided the local office with his name,address,social security number,place of employment,and dna results.How do I get them to issue the order to set support,they know everything I call them once a week and they tell me the same thing.Is there a way I can file the petition myself?Her father has 2 kids in other states that he ran off before a DNA test could be done.What steps can I take to get them to just file the petition??
Answer: Get a lawyer you can file yourself in fact there are several child support collection type agency that exist now that take a % of the amount they get so it costs you nothing out of pocket, they can and will use their own PI to locate him if needed
and also __make sure your lawyer attaches to any income tax return he has coming now and in the future until he is paid up.__
My sons father actually quit numerous jobs to stop job garnashements and hasnt filed a tax return since the last one we filed together in 82. The state is very slow to go after them if they live in a state other than yours especially. Since 82 they have managed to get less than $400 total of the $200 a month + interest allowed by law for the last 25 yrs. I never even tried to get it raised as the cost of living went up, no point since he would rather be a bum. $200/mth x 12 mths x 17 yrs + 25 yrs and counting of interest....do the math.
Some places have legal aid (texas does) for exactly stuff like this where its based on your income or free if you recieve any public benifit. Call your local department of human service resources and ask about it.
Question: CHild support?? Just wondering but when I go to court with the father of my child are they going to set up visitations that day... like he will get him every other weekend? and will they let me know that day how much child support I should recieve each month?
Answer: Depends. Is this a divorce or child support only hearing? If it is a divorce, then they will set up his visitation during the divorce proceedings as well as let you know how much your going to get. If this is through the child support office, and all you are doing is child support then it's different. In the eyes of the court child support and visitation are two completely seperate issues. If the two of you were never married, then they will not automatically set up his visitation. He has to ask for it in WRITTING. Meaning he has to file his own court papers asking for it. If he does not, they will not address it that day, and verbal requests will not be humored. It is possible to go to court more than one time for seperate hearings. They may tell you that same day what you are going to get each month if everything is already in order. But if he contests paternity, forgets to bring some sort of verification, or even doesn't show up, they may continue the hearing for another day in which you'd find out then what he's going to be paying. But, yes, you will be told when they finally have everything, and you will get copies of the documents stating as such.

Answer: Yes, you can take the necessary steps to get the ball rolling. First, contact CSO the Child Support Enforcement Office. They have a new program available to families that do not want to hassle with all the paperwork mess, it's called Help The Children. The number is 1-800-526-8658. You need to ask to speak to a child support enforcement officer. If you have any problems you can also contact CPS. They have counselors who can help guide you step by step at no cost. Their number is in the yellow pages and depending on what area you live in you will get your local office. You will need to know your fathers full name, social security #, place of employment, address and phone number. Question: How does child support stop when the child reaches 18? I have been paying child support through the Division of Child Support Enforcement in VA.
The child I am paying for will turn 18 soon, and I will no longer be obligated to pay child support, my question is this:
Will the support stop automatically? (currently deducted from my paycheck) Will I need to contact the Child Support people to let them know the child is now 18?

Okay - how did the support even start in the first place?
Because there was an order from the decree. That same decree also states the stop date (s). However, how does the state know your case from a zillion other ones?
Contact them in writing that they have the correct date(s). You do not need to go back to court. It is already all there!
And it stops.
Question: How does child support work when father is deployed to iraq? My son's father is being deployed to Iraq in May, but leaves in March for his training. Child support is already court ordered, but I know that there will be a huge increase in his pay once he leaves. What should I do about getting child support increased? Should I contact his national guard unit or child support enforcement now or should I wait? If I wait until he has gone, how do I show his income?
He is ordered to pay, but has just started to pay because he will most likely to have to serve 30 days before he leaves. His court date is on the 18th for that. He is over 3000 behind already.
He is in the national guard so when we processed the orders he was working a minimum wage job. His pay will increase.
Answer: the increase in pay we get over there is not our real salary so they never go by that. although since he will be getting regular active duty pay u should hit him up for that. and the army CAN enforce the child support order. your child is entitled to all of the servicemember's BAH. when my husband was deployed i didn't get a dime and his unit told me they can't enforce it with no court order! i too am in army and know that's not true.

And if the non-custodial parent is on welfare because of financial hardships would child support be taken from those payments as well?
Answer: Payments can be taken from IRS tax refunds. If they are on cash assistance from Welfare, then payments are not even enforced, as it is seen that the individual can not afford them. I had child support completely and involuntarily canceled because he was on Welfare. Didn't matter that it was only because he was a lazy bum who wouldn't rather than couldn't keep a job. Don't expect Welfare to help you out on that one. Look to the IRS.
Question: How does child support work in the Netherlands? Does anyone have any idea how this works - the child is now 18 (nearly 19), finished High School last year, working, still living with the mother BUT intending to continue education after a year off. So, how does child support work in this case? Does it stop altogether because the child is now working, or does it stop for a year and then continue again once the child goes to college, or does it just continue regardless?

Answer: As soon as someone is 18, it's 'technically' responsible for him-/herself. When you decide to go work, you won't be able to expect any form of support, (maybe 'zorgtoeslag' if you earn (very) little money.
When you, after a year off, decide to go and study, you will be able to accept study financing just like anyone else who does the study, as long as you don't get paid from an other country as well, and you study in the Netherlands or in 'border regions'.
All money paid for study financing or health care by governmental organisations will be paid to the person who will have to 'organise' it, so the child will receive it.

Question: How does child support work when 1 of 3 children has moved in with noncustodial parent? I live in Texas. My oldest son moved in with me 2 years ago. He is 14. Would there be much of a change in the amount that I pay in child support if I attempt to modify the support order?
Answer: Generally, in order to initiate a "Change of Circumstance" there must be at lease a 20% change in your payment. To simply remove the child from the obligation would not meet that requirement. The difference between 35% and 30% of your income is only 14%.
What you need to do is to file a motion to modify custody, as well as child support. Even in Texas, a child does not have the simple right to go live with you, it still needs to be approved by the court. You will need to file a motion to get child support from the mother. This is an area where things can get hazy, requiring an interpretation of the court.
In a straight forward interpretation, you would be paying her 30% of your income in child support, while she would owe you 20% of her income in child support, if she's working.
Now, understand that all child support is rebuttable, so unless she's on Welfare, the amount does not have to match the guidelines.

If she's working, and does not want to be ordered to pay 20% of her income in child support, than use a Certified Mediator to develop a new custody agreement and child support order. The Mediator will print out the modified order which you take to the Clerk of the Court to file. The Clerk sets a court date at which both of you go to before the Judge to swear to the contents of the agreement. He signs off, than you take a certified copy to the AG Office to change their records and any notification to your employer on payroll deduction.

Question: If I owe back child support will I not get my stimulus check? I don't owe alot of back child support. But with the state of Texas, if you owe more than $500 the government gives your tax return to the child support division. So will I get my stimulus check or will that go towards my back child support?

Answer: file a motion in family court to end the child support based on the child being an adult now and served the other parent the papers. If the child is attending college then child support will continue. Check into that as well.
Question: What happens if you do not pay child support and there is a court order to do so? A judge ordered child support to be paid by my ex. The order was dated June 24th of this year. So far my ex has still not paid a penny of child support (three months after the court order was put in). He is already in arrears (my child is over a year old now). Answer: If you're the man owing, you get held in contempt and go to jail, even if he has sole custody.

If you're one of the 15 out of 100 non-custodial mothers actually ordered to pay, of which less than 1 on average actually pay any, nothing happens as it would be harmful to the children to know their mother is a deadbeat.

Question: How much child support can I get from the unemployed father of my son? After 7 months of my sons fathers lack of helping I decided to get the law involved and make him pay child support. The problem is.. He don't have a job and don't want a job. He is fine with his mommy paying for everything he needs. Answer: If you go to the courts and get a petition for child support set up they will use what they call a formula, where they take your income and the minimum he should be making and calculate it. What ever the calculation comes up with he will be made to pay. Just because he doesn't have a job doesn't mean he's going to get off with not paying it. If that were the case, then all these people out here that have to pay child support would quit their jobs and not worry about it. I'm not sure what the lowest limit is for your state, but my child's father was ordered to pay $130/month. Of course he hasn't paid that and his excuse is that he doesn't have a job. Now he owes $2500 and is about to be sent to jail.

Here is a little more detail. It getting close to review time and the custodial parent now lives in the same state as the non-custodial parent which was not the case with the original order. So the question is which state handles the review.
Answer: WELL I would suggest that you or the other parent contact the old jurisdiction and alert them of them move.
if that doesnt get your case transferred then you may need to file a motion to transfer jurisdiction
usually this is done when the parent has lived with the child in a new place for 6 months or so.
you need to do this because each state varies on its child support guidelines and you do not want to be on the short end of any sticks

Do I recieve payments as often as he pays in (weekly) or do the Friend of the court let it accure, and I get one monthly check? So my question is Do I get child support weekly or monthly ?
Answer: usually receive payments based on their employer paid weeks..you could also check with your child support case manager
