Say you lose a lawsuit & the guy comes from the court to assess your assets to figure out what you they can sell / auction before garnishing wages, and one of your only assets is a big fish tank filled with living fish. Hypothetically could the court order the tank to be auctioned off, even though there are living pets in it or are there some sort of animal rights laws that you can invoke to protect your fishies?
Answer: Pets are property. They have no rights themselves nor you to them beyond your property and, legally, are nothing more than, as you compared, equal to a couch. You can't argue that they can't sell your couch because you love it. If it can be determined that the fish have enough value worth selling and worth paying the debt, they can be sold. As long as the animals are not intentionally harmed during this process, it is not considered animal abuse.

Answer: usually, you cant 'commit' someone to the hospital without proving that the person is a danger to themselves or others - example, someone who you know is driving drunk, threatening to kill someone, or threatening to kill themselves. if he doesnt want to go to the hospital for tests, you cant have him committed. the only way you could get him to go otherwise is if you have been granted power of attorney (POA) over your dad, in which case he would have to sign over this power to you....in this case, you are entitled to make medical/health decisions in your dad's behalf in the case that he is mentally incapacitated, unable to make a decision for himself (in a coma, etc), or if you can prove he has some sort of mental disorder (such as dementia) that makes him unable to understand the repercussions of his decisions. maybe this is something you should talk to your dad about and see if it is something he may consider.

Answer: I hate to tell you but there is such a thing as In Utero Custody that he can file, but it is highly unlikely that he would go to that extreme.
Here is what you need to know, you being an unmarried mother at the time of birth have 100% custody of your baby. The laws in 49 states, and Arizona is the only exception, give you 100% control over that child in the eyes of the law and the father gets nothing until he goes to court and demands his visitation and custodial rights.
Now, I wouldn't go telling a bunch of people that you are moving, because he may try and file something but the court process alone takes a long time. First, because you weren't married, if he filed for custody it would get to the Judge and the Judge would say "I am not doing anything, or awarding any rights until a DNA test is done." That takes about 2 weeks and $500. Then you would go back to court for a temporary custody hearing where a temporary order would be issued.
But I highly doubt any of this is going to happen for one reason, child support! It is nearly impossible to get a custody agreement signed by a judge, which would award visitation, unless the matter of child support is addressed. So I really doubt he is going to file anything because I doubt he wants to pay for a lawyer, and DNA cost and child support....etc.
Be warned though if you file for ANY government assistance like food stamps, or low income houseing..etc the state of Ohio will REQUIRE you to seek child support for your child. There is no barganining, it will happen. The good news is that if the dad wants to bring a custody case while you are in Ohio, for almost every county, he would have to file where the child lives. So he couldn't file in SC and make you fly down. Although Ohio has some weird rules about how long the kid has to be an Ohio resident.
If I were you I would call an Ohio family lawyer when you got there. If you are still 17 at the time of your parents move I doubt anyone can make you stay in SC.
Question: How long does a court order for access to a child last? I went to Family Court about 3 years ago with my ex and we agreed times for him to have access to his daughter. Last year however, he got a new solicitor and different arrangements were made. These were done by us mutually exchanging letters and not in a court. On days when my ex is particularly spiteful he throws the line "you are still bound by the court order" at me. How can I be when different arrangements have been made since then?! Answer: unless u signed a consent order to change the previous order, the previous order is still effect. Go check your court file & see what the order states but is good until another order is granted

Answer: During your eviction hearing you need to bring this up. They will be fined at least one months rent in addition to everything else for denying you your income after they leave.
Their moving out does not effect your eviction, continue with the action. You will get your bank rent and lease amount. Also, there will be a note in their credit report to protect others from the scum bags.

This is a parenting plan. This is from a Washington court order. The father lives in Washington and has residential custody and the mother lives in Montana and has the summer visits and holidays. What will really happen if one parent decides not to return the children who are almost 11 years old and don't want to go back? Can the state that the parent lives in arrest them? Answer: Sort of kindof. Heres the deal. If she doesn't return the kids, shes in contempt. If he comes to Montana, he can get her arrested. But she can also get him arrested. If the children don't want to go back, they still have to. My advice would be to go back to the court and let the kids testify to the effect that they dont want to live with him. My son's father went and lied and now they are giving my son to him for 52 nights a year. My son doesnt know him at all. Answer: Well any logical one I will tell you that. Crazy as it sounds, you can be held in contempt and LOSE full custody of your daughter. It sounds crazy I know, but what can you do. I am NOT dramatizing this situation. She has children repeatedly and hands them off to other people in the family. She doesn't have a home and no job. She has been in and out of prison. She is pregnant AGAIN with what is now will be her 5th child and is only 27 so has many fertile years left. Drug use is heavy, drinks every day. At one point lived in a tent outdoors. I would say she is probably Bi-Polar but it has never been diagnosed. She has mental problems though.
