Any physical, sexual, emotional and/or other maltreatment or exploitation of a child. For legal purposes, the term "abuse" is specifically defined in both Federal and State legislation. The Federal CAPTA legislation provides a foundation for States by identifying a minimum set of acts or behaviors that characterize maltreatment of a child. This legislation also defines what acts will be considered to constitute physical or sexual abuse of a child.

Question: Child abuse? Yesterday I saw a girl in a store about three years old. IT was noon and she was still in obvious pajammas with her hair unkept and food stains on her face. When the fat worthless mother dragged this kid out to the car she put her in the front seat with no belt on and lit a smoke before driving away. In your mind... is this child abuse? Should we be giving this fat whore of a mother a state aid card to buy her groceries at caseys and ruin this child... probably have another soon too? Am I wrong for wanting to kill the woman and do the kid a favor?
Answer: I don't know about child abuse. Bad parenting, certainly. Until you know more about the day to day life of this child, it's impossible to say. You saw a snapshot of what was going on. It's clear this woman has a pretty poor idea of what to do with kids, and basic car safety, making sure a child is dressed well, etc. It does make you wonder how much worse things are at home, if that's what is being allowed to be seen.
If I were you, I'd watch out for her again. See if she turns up again with her child and judge the situation then. If things are the same, then it might be worth calling the police or social services because you feel there is a child at risk. Note down her registration number. After all, who else is going to look out for the child if her parents aren't bothered?

Answer: Spanking to me is alright. Not to be confused with abuse. Which just makes my skin crawl. But does one honestly think that putting a kid in time out ( kids in this generation) will do anything for them. No! But a good spanking, will make sure they will never make the same mistake twice. I cannot understand how a parent or any adult could ever hurt a child that way ( to the point where the either end up in the hospital or worse dead). it is truly horrific. Those poor kids. It is sad as well, that most kids who are abused wIll most likely end up repeating the cycle, if they do not get proper counseling.

Answer: They are both criminal charges. The other one is just specifying that he was charged for child abuse.

Answer: Here is how the law defines what is typically called child abuse:
273a. (a) Any person who, under circumstances or conditions likely
to produce great bodily harm or death, willfully causes or permits
any child to suffer, or inflicts thereon unjustifiable physical pain
or mental suffering, or having the care or custody of any child,
willfully causes or permits the person or health of that child to be
injured, or willfully causes or permits that child to be placed in a
situation where his or her person or health is endangered, shall be
punished by imprisonment in a county jail not exceeding one year, or
in the state prison for two, four, or six years.
(b) Any person who, under circumstances or conditions other than
those likely to produce great bodily harm or death, willfully causes
or permits any child to suffer, or inflicts thereon unjustifiable
physical pain or mental suffering, or having the care or custody of
any child, willfully causes or permits the person or health of that
child to be injured, or willfully causes or permits that child to be
placed in a situation where his or her person or health may be
endangered, is guilty of a misdemeanor.
The word child is not defined in the chapter and thus takes the common meaning of minor under 18. Bruising and tearing are not necessary. If the adult is simply protecting him/herself, it is legal t use force. Verbal abuse is not illegal in and of itself.
Question: What is the difference between child abuse and child neglect? Would ignoring a child as they grow up and giving them no rules, love, or nurturing be considered neglect? Is not giving them food or clothes neglect or abuse? Where is the line drawn?
Answer: You need to specify the context of your question. If you are referring to abuse or neglect definitions as they relate to various Child Protection Acts adopted by various jurisdictions, the differences, if any, will be spelled out in the statutory provisions. In those circumstances, "neglect" could mean not feeding your child where a doctor or pediatrician would say there is a "failure to thrive" issue; it could mean you left your child strapped in a car seat in a locked vehicle with the windows rolled up in 101 degrees Fahrenheit while you knocked back a few beers at the tavern watching the Lakers. Abuse is more like giving the child a subdural hematoma or hemorrhaging retinas after shaking the baby for 10 or 15 minutes or breaking the baby's arm or leg in anger.
The line is probably drawn at the point where a parent's or "responsible" adult's conduct would result in serious physical or emotional harm to a child. Who makes that determination? Usually it's the judge.
Question: How do you draw the line between child discipline and child abuse? I believe that children need to be disciplined to learn the consequences of their actions, but I also know that child abuse can cause heavy pschological damage to children. What in your opinion is the acceptable way to discipline one's child?
Answer: There are probably as many ways to discipline your child as there are kids in this world. Every parent is different. We have an 11 month old son and do plan to use spanking as a means of punishment. BUT I only plan to spank after other methods have been used, such as time out, removing privileges, praise for good behavior, etc. And then I only plan to use spanking if it's effective. Also, there is a right and a wrong way to spank. You should never spank in anger and your child should know why it is happening. I agree, beating your children can cause psychological damage but there is a great difference in spanking as a discipline method and abuse. We were spanked a bit growing up, but honestly more damage was done to us kids through my dad's form of verbal abuse. But in the end, you do what you are comfortable with and what works for your kid. I think more parents should discipline SOME WAY, instead of treating their child as their best friend!
Question: What could I do to help stop child abuse as a senior Girl Scout? (Plese no dumb answers making fun of me or girl scouts. I really need some ideas)
I'm a 15 year old girl scout (don't ask) and i'm working on my gold award. That's like a really big 4 year project. Some people build shelters or send books to 3rd world countries.
I really want to do something to help stop child abuse. I read the book 'A Child Called It' and it made me really want to do something to stop or prevent child abuse. Ludacris's new video 'Runaway Love' really influenced me too.
Doing something for the victims in the shelters is easy, but they're already saved. I want to help the other children who really need it.
I know it's a lot to ask and there's no real way to stop it. But there has to be something I can do. And I have a whole troop supporting me and 4 years to do it.
And by the way, I can't fundraise.
Any ideas are appreciated.

Answer: I took an excellent class last semester on Child Abuse - so my first word of advice would be to contact local universities to see if any are teaching classes on the topic (usually in the sociology or social work departments), and see if you could make contact with their professors. I'm sure anyone who cares enough about this topic to teach a whole class on the subject would be to sit down and talk to you more about the topic.
Here's a few ideas you might want to consider:
- Do a Google search for "Child Advocacy Center" and see if you can find one in your area. These centers are places where children come when abuse is suspected in the home, and they work with a team of advocates from different fields (police, attorneys, dr.s, social workers) to make sure they gather the correct evidence to make sure the perpetrators are brought to justice and the child is kept safe. You may be able to connect with them to create a fundraising event or awareness event which would be appropriate for a gold award.
-Another idea is to see what local agencies may be working with schools to educate children about sexual abuse. Many times these agencies do assemblies on "good touch bad touch" and may be able to provide you with the opportunity to help with program planning etc.
Not to damper your aspirations - because I completely agree that this is one of the BEST causes, and the Gold Award is an excellent way to make a difference in things that matter to you - but consider the possibility of offering support to an existing agency for your project instead of creating something new. It takes a long time to learn (and be certified) to do work with children who are being abused, or have the potential to be abused. There are people who are more qualified to do this - and working WITH them is possibly the best way to make a difference in something like this. Answer: Under Canadian law persons who are related lineally, or as brother or sister , including by adoption may not marry. Incest, which covers sex with one's parent, child, brother or sister (including half-brothers and half-sisters), grandparent or grandchild, is also an indictable offense and liable to a maximum of 14 years' imprisonment. It does not include cousins, uncles, aunts, nieces or nephews.
Question: What does a severe child abuse charge mean? I am a foster parent of a child in Tennessee. The baby is the third child the mother had born addicted to drugs. They charged her with severe abuse, and she agreed to the charge. Yet, nothing else has happened. She didn't have to go to jail, or anything, and the state has not terminated her parental rights. Answer: Aggravating circumstances of physical or sexual abuse of a child under 17 or a child with physical or mental disabilities. Your local police will have the info of whether she is a registered sex offender or not.
Question: When do you consider something child abuse? I consider hitting(not spanking, but hitting) a 0 - 5 year old child abuse to an extent, and a closed hand beating child abuse. I also consider leaving anything other then one or two bruises or a cut child abuse.
But anything over that I'm unsure. Some people consider hitting a child out of anger and not punishment abuse.

Answer: If you are actually concerned about the children, don't neglect to check out Protestant missionaries, since such abuse is slightly more common among Protestant clergy than Catholic clergy.

Answer: It depends on the crime. Not all child abuse is violent or sexual.
For example in CO there are 4 main types of child abuse
Reckless causing injury (ie beating the child)
Reckless not causing injury (ie smoking meth in the presence of the child).
Neglient causing injury (ie forgetting about the 2 year old and leaving them in a position where they get hurt)
Neglient without injury (leaving a child in a car in a hot day, no injury to the child 'cos someone called the police or got the child out of the car)
Depending on the level of injury or the intent of the offender, child abuse might be a misdemeanor or a felony.

Answer: It depends on the school most still teach stranger Danger - which is old and outdated. I have used Protective Behaviours with the young people I worked with which tries to get children to understand their own instincts and the flight and fight feelings their body give them.

Answer: It is not possible to be sure of the most common implements used to assault and torture children. Child abuse is societally-sponsored by society and thus society refuses to record proper statistics.
The reason why crimes committed by children are so "contriversial" (not the best choice of word) is very simple. Society insanely and malevolently decrees that all children are sub-human owned property slaves of their biological creators and society itself. They are expected to be broken, supervised and obedient.
Further, the younger the child committing a crime the more strongly the Forbidden Truths of crime and child abuse are in danger of being revealed. If a 6 year old murders someone, that is proof that by the age of only six society abused, demented and tormented a child so badly that it caused the child to harbour murderous levels of rage, frustration and anger as well as a strong sense of injustice against humans and society.

Answer: There is no simple or easy answer. It depends upon whether the child can be kept safe at home, and what the laws of that particular jurisdiction say. It also depends on the particular circumstances. Each case should be looked at individually. I am aware of many children who have been more abused after removal from their home than they were when at home. Foster care is not always the best solution. Sometimes it is quite possible to work with the family and keep everyone in the home and keep the child safe. I am also aware of cases where the child appeared to everyone to be quite safe at home, but the child died at the hands of a parent.
