I my ex is ordered to pay me child support through the disbursement unit for the state, then it's processed to me so it can be kept record of. however, an account is not setup for that i need to wait 30days. in the meantime his mom is writing me checks for child support not even half of it. they r given to me, not mailed to the state to be kept record of. I told child support services and they say it doesn't count -- the checks are also in his mothers name not his. so weird.
Answer: Tell him that can support not paid through the courts is not legal. I have a man who paid the mother the proper amount for five years, by check, only to be reordered to pay for the same time period when the mother filed for a retroactive order. Over $50,000

He would have inner workings with the Michigan Friend of the Court and payments to recipients for child support; who is this man with no name?

Answer: You might be a victim of identity theft contact the agency immediately - someone might be using your social security # - do it NOW!

Answer: It is possible but not smart on your part. Should he not live up to his word you will have to restart the process. Leave your state order in place he can go in and make cash payments on your case even if there is not a reported job to withhold directly from. This way your child is guaranteed some protection.

Answer: Don't believe your ex as it is a trap and DO NOT DO THIS! Once you get the court ordered child support dismissed, he will stop paying you and you may not be able to get it reinstated because you canceled it. Your ex is quite free to go to court (he doesn't need a lawyer) to ask that it be temporarily reduced while he is unemployed but honestly, he should be busting his butt trying to get any kind of work as his child deserves to have a roof over his head and food in his tummy, whether or not his father has a proper job.
Please don't do this as it will probably have permanent repercussions that you have not thought through. At the very least, ask your lawyer for advice before you do a thing. I know you feel sorry for him but you need to concern yourself with your child and your child's needs. Your ex is a grown man and he has no intention of going without either a roof over his head or food in his tummy...so why should your child do without? And to be honest, if he is willing to assist you with money anyway, he should be willing to pay the proper child support. Good luck!
Question: child support help! please, im about to give up? I live in IL. and I previously had an order of child support, but it was attached with in order of protection. The order of protection has expired and I now live in a different county. I tried taking my ex to court pro se, and the judge pretty much laughed in my face stating that I need legal council to get any where. Answer: DuPage County has a legal aid office. They will help you for very little or no money. Also, Northern Illinois University's law school has a legal aid clinic that, if I'm not mistaken, is also in DuPage (though they can help you even if they are in a different county. It's either DuPage or Kane; i forget which. Don't worry about inexperienced law students; they are supervised by experienced attorneys).

Answer: In my state (Virginia), there has to be 3 consecutive months without payment before they do anything against the non-custodial parent. I believe the first thing they do after 3 months is put a lien out against any state/federal refunds that he would be receiving. Then, after another 3 months, they suspend the drivers license, and after another 3 months, they proceed to get a court date and get him back into court to explain why he hasn't made a payment.
I'm not sure how it works in your state though. You may want to give your worker at child support enforcement a call to find out what happens.
Question: Can anything be done when an employer fails to release child support in a timely manner? I am the custodial parent and I know for a fact (I have seen the non custodial parents pay stubs) that the non custodial parent IS having the child support garnished from their wages but the employer is sporadic about when they chooses to send them into the state disbursement unit. Sometimes (its happened twice) they come 2 days after the day date and others (more often) they come 3-5 weeks after the pay date. One time the amount sent to the state was LESS than what was on the pay stub as taken from the pay. The non custodial parent and I still communicate and are getting frustrated by this situation. The noncustodial parent is not angry about paying it, but is angry when the child has to wait for things that he should reliably be able to have since the noncustodial parent is paid regularly and the garnishment is taken regularly. The noncustodial parent is afraid to confront the employer for fear of losing the job that has been a regular source of employment for 4 years. So my question is: What can I as the custodial parent do?
My child is provided for and I have been working with the state disbursement unit to make sure things are timely. The are simply not receiving the payments. I am able to provide basics for my child, the CS helps him do the extras he likes like music lessons, football games and saving for his goal of a pet. I simply can not afford those things alone on my tight budget, and honestly, the amount of CS would not even feed my child or even cover his health insurance (which I pay for) so mostly the money goes to him and lets him have a more comfortable life.
Answer: The disbursement unit may be the hold up, not the employer.
Employers must make the payment on the same date they pay the employee. The parent should check with his employer to be sure that they are paying on the correct date, and mention that the checks have come to you late. The employer should be treating it as they would any other employee paycheck. If it is a small company and they are having financial problems they may be fudging a little to try to make their money last longer. Is the employer a stable company? If they are not stable then the parent probably should be worrying more about finding another job so that if this one goes under he won't be there.

Answer: You should be in contact with your case worker and push on the Child Support Enforcement Agency to utilize the child support collection methods available. A state worker will not take it upon themselves to work unless forced or unless Uncle Sam is breathing down their neck (ie: you're receiving state benefits also)...
Call your case worker and have them put pressure on the deadbeat.

Parent A has custody of child, parent B was placed on child support, however Parent A realized she would get a better deal out of the deal if she removed Parent B from child support. Answer: If you are paying without a court order, it can be considered a gift, with you ordered to repay for the same time period, especially if she's on Welfare.
Question: Child Support - My husbands dad used his social security number (I think)...? My husband pays child support for our step-daughter. We are able to view the payments online through the State Disbursement Unit to make sure that they post on time, etc. When we logged on for the first time we saw his current case, and also a previous case from 1993. My husband was 8 years old in 1993 and was not paying child support. I looked up the case number on the courthouse website and it pulls up that it was his father paying his mother child support. My husband and his father have the same exact name. Considering my father-in-law has used my husbands social in the past without his permission, sabotaging his credit, Im inclined to think that his father somehow managed to pull off a scam! I think his father used my husbands social security number for the court to verify that he "wasnt" employed. My mother-in-law only recieved $40 a month for 3 kids in child support from my father-in-law, which makes absolutely no sense because he has always made a lot of money! So Im assuming since they have the same name, he used my husbands social to avoid having to pay 20% of his salary in child support. I couldnt think of any other reason my husband would be a non-custodial parent in his own child support case. Now, I was wondering how this would be possible but child support doesnt require the childrens social security numbers, only the parents. Does anyone else think Im right? We reported it to child support and are now waiting to see whats going on. Has anyone else been in, or known someone in a situation similar to this?
I have a friend whos uncle used his sons social when he was only a few years old to avoid a higher child support payment! His son had no idea until "he" was behind thousands of dollars in child support when he was like 30 years old! Thats why I think this is a similar situation. I wouldnt be so quick to judge, but with all the debt and bad credit my husband has thanks to this man, I wouldnt doubt him scamming the system! LOL! I did ask my mother-in-law about it, which is how I learned of him paying only $40 a week. She took him to court 3 times a year to try to get an increase, but they could never verify his income. Hmm.. I wonder why... hahaha! =)

Answer: Who knows. I do know that years ago the mother and father could agree to a dollar amount he would pay and she would accept for support. Once that was written into the divorce decree, that amount was set in stone and immune from any new laws. I know a guy that made close to 175K per year and his wife agreed to $25 a week in child support when the child was 3. Once the laws here were changed to be up to 50% of gross income, she took it to court numerous times and it was thrown out. If it is written into the actual decree here, courts won't change it no matter how good your attorney is. He never paid over $25 a week the entire 15 years until age 18 when it was over. So, it is possible that your MIL agreed to the $40 either with or without knowing she had.
As for the other, I am sure the officials at the child support dept. are all over it. It sounds like your child support division just mixed up the SSNs They, at least in my state, are not known for accuracy.

Answer: No, as that requires a court order and he has the opportunity to defend himself. In this economy, there are six men for every job, unless he fudges his resume to get a low paying job, as minimum wage employers will not hire someone they think may quit.

Question: FL Law: Receiving Child Support? I got divorced about 3 years ago and have since petitioned the courts to have my ex pay through a central depository, State of Florida Disbursement Unit. Answer: Florida has a Child Support Enforcement which is part of DCF (Florida Division of Children and Families). Start with them, though I think they are only aware if it is court ordered to be paid thru the Court. Good luck.
Question: I live in Florida. My ex is on Workman's Comp & I haven't been getting my court ordered child support payments? He has attained a lawyer, won't discuss anything with me or answer my questions regarding this.He claims everything must go through his lawyer. In this world courts can make all the judgements they like but if your ex does not have the money you are not going to get it. It was his employer that collected the money from his checks and sent them out to the state collection and disbursement unit under the wrong case number. Thanks for answering. This is not a new employer. They were paying to the right account for a few months, but then began paying to a different account for four months. It does sound very fishy and I'll take your advice and call tommorow.
Answer: I recieve support in TX. On the back of every state-issued check it clearly says that if you recieve a payment in error, you are responsible for paying it back (if you cash it) or reporting it. It is the STATE'S responsibility to issue the payment. So contact your CS office/attorney general's office and let them know whats up....what the hell took you so long? I am at the mailbox waiting for mine or my son would starve....:o)

any referencing on any of these receipts to units or repairs or punch list (exhibit A). Please attach a filled out reimbursement form and make sure that all amounts that you are asking reimbursement for are completely referenced to that form.
the receipts provided should be referenced to either the reimbursement form or to a unit #. If there are multiple items on a receipt and some of these items are not for an item on exhibit A from the bank it should not be reimbursed or referenced. (example - plumbing items).
the receipts should indicate what unit was worked on. EACH ITEM MUST BE LISTED TO A UNIT OR TO GENERAL
...the receipts I have are from a store which includes items bought for the repair of several units. For instance, three of the units needed Drywall repair. I bought the needed amount for drywall. Do I place the same receipt for each unit?
