Question: How do I find out what the statute limitations is on a small claims case in Oklahoma? My mother needs to file a small claims case against a neighbor whose dog attacked and injured her dog, for the medical bills and needs to know how much time she has to file for a court date. It happened this summer, not exactly sure of the date. The police were called and it was ruled to be her fault in the accident report. Her pit bull jumped my mother's fence and almost killed her Bijon. I've called the court house and they told us to look the time limits up on the internet but I am not sure how because I just can't seem to find them. Anyone have any ideas? Thank you!
Answer: It sounds like this would fall under the category of property damage, and under Oklahoma law, the statute of limitations for small claims of this type is two years.
Question: How are the statute of limitations determined for credit card default? I currently live in Kansas. The statute of limitations for unpaid credit card debt 'open accounts' is 3 years. I lived in Texas and Arizona when the credit cards were opened. How do I determine the statute of limitations for this debt? Is it based on current residency or past residency?
Answer: Fair Credit Reporting Act says that derogatory accounts will show for 7-years from the date of first delinquency.
Statute of limitations varies from State to State and by what type of debt you are talking about.
This is the legal time that people can sue in court and get a judgment. Once the S.O.L. has passed you can still be sued but all you have to do is show the court that the S.O.L. has expired and the case will be dismissed.
I have posted a link so you can look up your State:
http://www.bcsalliance.com/index.html
There is no time limit on how long people can attempt to get you to pay. Never admit that a debt is yours and never pay a dime on one that is past the S.O.L. because this will restart the S.O.L.
Question: What if my states statute of limitations has expired on an old debt? Does agreeing to make monthly payments but them not accepting have anything to do with the debt becoming valid again or does the statute of limitations still come into play? It has been almost 5 years and just now contacting me about an old debt in NC. The limitations for NC is 3 years but I told them I could possibly do a very small amount each month and they said it wasnt acceptable. Im dealing with an atty. by the way. What should I do? Can it still go against my credit if the limitations is up?
Answer: First of all Attorney (who is acting a as A Debt Collector)
still has to abide by the laws of FCRA. Make them validate
the debt, and whether they bought ithe debt or were assigned, and get it in writing. If it is past the Statue they
can try to collect all they want but can't pursue collections
unless they can validate the debt. Read thru this website
it will explain what they need for validation and if they place
a judgement on you without validating it, then you can sue them back. I got tired of debt collectors, so I send an all in one letter, stating not to call me at home or work, and proof
that you purchased or were assigned a debt, explain and show how you came up with the amount you say I owe, and
a copy of the signed contract that I signed saying I owe you
the money, and if you can't provide proof withing 30 days
that I invoke my rights to file a lawsuit against them.
Read thru this website carefully, all the letters are here and
lots of other information creditinfocenter com

Question: How do statute of limitations in Massachusetts work? For instance; Statute of limitations for A&B in Mass is 6 years. If the defendant is not a resident of Mass or a fugitive from the law, it does not contribute to the 6 years. How about if they are incarcerated in a different state? Will it contribute to the 6 years?
Answer: No, of course not. If they are in another state, they are not resident in Mass!
Also, note that a statute of limitations is based on the time before charges are laid. Once a charge is laid, there is not SoL.

Question: What is the statute of limitations to collect on a tax debt in Virginia? How long is the statute of limitations for the Commonwealth of Virginia to collect on any tax debt...Thank you.
Answer: I believe it is 20 years on Virginia state taxes. If you never filed, they can go back as far as they want. If it is reduced to a judgement it can be renewed again and again. Federal Taxes are not the same as state tax and have a 10 year statute on assessments. There are several permutations to the law and to get an accurate answer in your case, you should consult a Virgina CPA or Enrolled Agent.

Question: What is the statute of limitations for possession of cocaine with the purpose of trafficing? What is the statute of limitations for possession of cocaine with the purpose of trafficing in Saskatchewan and Manitoba?
I was convicted of such a crime, in 1991, and may have convinced the real guilty party to come forward to clear my name, but they will only come forward if they can not be prosecuted at this time.
Answer: here's the skinny, you were convicted, the prosecuting attorney has a bird in the hand, is it in his interest to re-open the case? For you to be found not guilty, the actual guilty party would probably have to be found guilty first.
Question: What is the statute of limitations on a fender bender? I live in California (sacramento specifically) and I caused a dent approximately 1ftx1ft in the side of my friend's car while backing up.
This was in June sometime, so that would be around 8 months ago. My question is concerning the statute of limitations on such a dent.
If it is one year, does that mean I do not have to pay for it in 5 months?
Answer: I believe that the statute of limitations for property damage is now three years in California. That means that during the three years subsequent to your accident, you are responsible to repair this vehicle to it's pre-loss condition. If you fail to repair it during this time frame, your friend must file suit prior to this statute's expiration to preserve his rights to recoup his losses.
What kind of "friend" are you anyways, trying to get out of fixing his car?
Question: What is the statute of limitations on a company charging your credit card? We had a company charge our credit card about two weeks ago that we closed 1 1/2 years ago due to it being stolen. We got a letter in the mail stating that a charge was made using that number and that they tried several times to reach us, no they didn't letter was the first we heard about it, and they transferred the charge to the new account number. I can't understand how the bank can not raise a red flag on this charge, and actually just roll it over to the new account. So I am wondering that when you make a purchase, how long does the company have to charge your credit card before the statute of limitations expires?
The card is a government travel card, or GTC, for military members. This is the card they use when they are on the road for their hotels, rental cars, food, ect.
Report was filed immediately with police, and still have copy of report. Bank was notified immediately. All charges transferred to new account immediately. There were no auto payments to card. Due to the nature of the card, all receipts are kept for filling travel vouchers, so it’s difficult not to miss a charge, especially when this charge is for over $400 if we want to make sure we get reimbursed.
The account was closed a year and half ago, and the charge showed up two weeks ago. The letter that informed us of the charge states that the first account was “closed due to security reasons… we have transferred the charge to our new account number ending in ****. If you do not recognize this charge or have any questions concerning this matter call *****”
Answer: It sounds like you notified the credit company of the theft, but did you ever file a police report and send a copy of the report to the credit company?
If you had a balance on that card that "you" made, before it was stolen, did you pay that when you closed the card? If it was from a charge that you had made before the card was stolen, then yes, you are responsible for it.
If the charge was made after the card was stolen and you had notified the credit company of the theft, they should not be placing anything on another account of yours.
You should contact them, but don't speak to the first putz that answers the phone, ask for the supervisor or better yet, ask for the fraud department. Find out what is going on.
They should clear it up. "Be sure" to request that they send you, in writing, that they recognize the first account had been closed because of theft and also that you are not responsible for any charges to that card.
Question: How does the statute of limitations work in regard to the Theo Fleury case? I thought the statute of limitations meant that if you didnt press charges after a certain number of years you could no longer press charges. Im sure that the Theo Fleury case has long surpassed this time frame but there is a warrant out for his abuser's arrest in Canada.
Is it just an American law or is it because it happened when he was a child, or something im missing?
Either way, I hope the bum gets thrown back in jail.
Answer: In Canada ALL indictable offences (even if they no longer exist today) have no statute of limiations. The only time a charge has a statute of limitations is for summary convinction offences. No, the Fleury case has not past any time limits, because there is none. Theres a canada wide warrant, but Mexico and Canada have no extradition treaties (at least none that I am aware of), which means that as long as he doesnt enter Canada or any country that does have an extradition treatie with Canada, he wont be arrested. However IF he does get caught, he'll do serious jail time. The law states that a general jail sentence for someone who inflicts a major or repeated sexual assault upon a minor is 4 years in a federal penetenary. Question: What is the statute of limitations on a broken wrist in Connecticut? I am not planning on sueing, but i am curious. I broke my wrist back in september and i am just wondering what the statute of limitations on a broken wrist is. I would sue the person's yard i was on when i broke it because it was somewhat their fault.
Answer: There is no "statute of limitations" on a broken wrist. There is a statute of limitations (which varies from state to state, in the range of a few years) in tort law (i.e., if somebody did something or was negligent, and you were hurt by it, and suffered financial loss).
Unless you are permanently disabled, disfigured, or lost a significant amount of wages, or have major hospital bills (out of pocket & not covered by insurance), then don't even think about it. It will take years and a lot of legwork and clog up the court system. Also, if you have medical insurance, your insurance provoder will ask for money from your settlement to cover their costs too (its called subrogation).
Question: What is statute of limitations in Colorado for filing a wrongful termination while on medical leave? I was on medical leave when my employer sent a letter that they knew would be forwarded to my new address with a deadline response time of 2 days before 'job abandonment'. In my unemployment phone hearing, it was determined that I was not at fault because the HR rep admitted that they knew the letter wouldn't reach me in time. I feel I have a good case if the statute of limitations allows. I'm pretty sure that this company has lost a case for a similar reason. Thanks for any help!
Answer: unless you were on FMLA there is no law that you can not be terminated while under a Dr.s care.
