A person's legal home, i.e., where the person spends most of his time, or intends to return if currently living elsewhere. In divorce, domicile is important in establishing jurisdiction and selecting venue.

Answer: "Domicile" usually means where you are currently living or where you were living at the time stated. I could say that my domicile at birth was Anytown, CA, but my current domicile is Sacramento, CA.

Answer: The UK and Ireland have a unique concept of domicile that is important to understand because the tax implications are enormous. No other country has anything even remotely like this.
The definition of domicile for the UK and Ireland is 'the place you plan to die in'. You will not find out anything through 'the legal system' as this is an internal tax issue with each country making its own ruling which is not shared with any other. For instance, my father is regarded as British domiciled by the Irish and Irish domiciled by the British.

If you are British born and have lost your domicile, be aware that you can get it back awfully fast if you move back to the UK unless you take deliberate measures to avoid this. Obviously one way is to avoid becoming ordinarily resident but you would not be asking the question if that was your plan as then your domicile is not relevant. At one time you could establish a foreign domicile by buying a burial plot but that will not wash any longer. You should have another place where you have the right to permanent residence, have a place to live, driving licence etc and you pay taxes.
Preferably not a place where the taxes are especially high :-)

Answer: There are just to many factors to give a real answer.
1. You have to have 2.5 years on station, to pcs for joint spouse.
2. You also have to have at least a year of re-tainability after a pcs.
IE: since he just pcs'ed.
You will have to join him.
Which means you need 2.5 years at your current duty station, before they will pcs you, to the post he is on.
Then you will need one year, lefty in the service, after the pcs
Which generally means, your gonna have to extend or reenlist first.
Then you have to factor in your ranks and the duty station.
IE:
1. is your mos at his duty station
2. is there an open slot for your mos at his duty station in your pay grade

Answer: If a British citizen remains in Spain for a period of more than 90 days then they are obliged to apply for 'Residencia' - so the family member should have a Residencia Certificate. Likewise they should also have an NIE Number, a Social Security Number, and a Healthcare number - things that they should Not have in the UK if they have never worked or lived there permanently

Answer: You should start by asking them what they will accept. Sometimes it's just as simple as a utility bill with you name and the address is enough to show this.

Answer: Many aliens acquire lawful permanent residence and soon after return to their home and employment in a foreign country, visiting the United States only briefly each year. However, simply using their Form I-551 (i.e. green card) each year for visits to the United States does not entitle aliens to retain their lawful resident status.
After an absence of more than one year, a returning resident must be in possession of a reentry permit or an immigrant visa issued by a U.S. consulate located abroad. A reentry permit is a document issued in the U.S. to help a returning resident come back to the U.S. Reentry permits are valid for not more than two years from the date of issuance and are not renewable. The INA makes it clear that the issuance of a reentry permit is at the discretion of the Attorney General.
The returning resident must be coming back to an unrelinquished residence. That's not a document, it's a place. Your home. Your residence. Your place of abode. It's a residence which has not been abandoned, given up.
So, if you want to be gone more than a year, you will need both a reentry permit and an unrelinquished domicile to return to.

see in aieee it simply doesnt matter anything on domicile of a person . you get the state rank only as per the state of eligibility which is the state from where u have passed your class 12th...

Answer: If u are a citizen of India, according to the Constitution of India, u can have property any where in India except J & K and probably few north eastern states like Arunachal Pradesh, Nagaland etc. where either u have to be a domiciled of that state or u need to have spl. permission.
So being from KERALA u can jolly well purchase a flat in MUMBAI, DELHI, CHENNAI, KOKATA where ever u wish.
Question: How to remove domicile cup fungus? With the recent rain, a domicile cup fungus (pasta shell shaped mushroom) is now growing on my window sill - wall corner.
Research on the web shows that it is not toxic, still I would like to remove it.

Answer: You want to put a plastic bag over the fungus before you pull it or cut it loose. If you don't, is will spore off and give it a chance to repopulate elsewhere.
A 10% chlorine bleach solution will kill the fungus.
You do need to find the source of the moisture. You may need to replace the sill if you can set it to dry out properly.

Question: My wife is a US citizen living in UK. In order to move back to the USA she need prove domicile status. How? She needs to prove domicile status as I (UK citizen husband) is moving with her but she has lived in UK for 7 years. US embassy says she needs to prove domicile status (or take actions to prove she is moving back. We cant do anything permanent until I get a job in the states. I cant get a job until I get a visa. Catch 22.
Answer: Just a suggestion. Have her fly back, rent a cheap place and return to the UK and then she can file for a spousal visa. She could also stay and start a job in the US. It would mean being separated for a long period of time. The US takes roughly 8-12 months to process their spousal visa's. (the UK processes their visa's a lot quicker) Wish I could offer a better solution.

Answer: if you haven't been at your current location at least 12 months you cannot get new orders. and there must be room for your MOS and paygrade at the duty station you want.
MASCP is never a guarantee that you will always be stationed together.

Answer: That doesn't seem like a very good bet. The bottom line for the Army is whether or not there is a post within 50 miles of your proposed domicile, where there is an authorization for her MOS and grade. If there is and there is a vacancy, there is an outside chance it will be approved, but only if she has met the minimum T.O.S. requirements for her present duty station. I wish you luck, but wouldn't expect it to resolve favorably.
