Answer: You usually sign it right after the ceremony. You would sign your maiden name since you have to legally change your name before you can start using it, which most people don't do until after the wedding ceremony.
Question: MARRIAGE CERTIFICATE? Me and my husband got married this year in april (Melbourne Australia). Until now we still have not received our marriage certificate and to make things worse i spoke to the minister and he said that he had not finished filling in the forms. I have tried to contact him again but had no luck.

Answer: You are legally married. The clerk's office sets a deadline for the MINISTER to file the forms. They often are late, but not this late. Call or write the minister and explain that not having the marriage certificate is causing you problems and you can't prove that you are legally married. Ask him if there is anything you can do to speed up the process.
I would wait a week or ten days, and call or write him again. Tell him you will call his diocese if he does not act soon. To be this late to file the forms is unconscionable. Good luck!!

Answer: Since after the death of your husband now you cannot apply or get marriage certificate after its registration under the Hindu Marriage Act, 1955 as a joint application along with individual affidavit of both the spouses is required for the purpose of the registration of the Hindu Marriage under section 8 of the Hindu Marriage Act, 1955 rather even for the purpose of the registration of the marriage even under any other central or local marriage registration Act a similar requirement is there. In your case your husband is no more to apply jointly with you for the registration of this marriage hence you have to use any other document such as a certificate issued by the priest who preformed your marriage or the temple where you got married, along with this the photographs of the marriage ceremonies, wedding card, name of your husband being mentioned in the birth certificate of your child as the father or in the voter's identity card as your husband or the ration card or your passport or any document issued by any government or any public authority where your husband's name was mentioned as your husband to identify this fact that you both were married. The courts in India have recognized any such documents as mentioned above along with a long period of staying together as husband & wife in the society sufficient proof of being married couple. You can procure any such document which I mention here & along with that you can give your affidavit stating about your marriage on the date , place & according to Hindu ceremonies , marital status as 'now widow' & naming him as your ex-husband. All these will be sufficient evidence for proving your marriage before any authority in India or any other place in these circumstances as you are now having his widow's status.

where ever you were married. It usually cost a little money
to obtain a copy.

Answer: First of all, congrats. I was ordained as an Interfaith Esoteric Priest 2 years ago. Not ALL Priests (or Priestesses) are Catholic. They would simply send it back to you with a letter saying that it cannot be filed due to state law. Whether they would request a civil union certificate or not is anyone's guess. No, you wouldn't get arrested. BTW, I am licensed in both Missouri and Arkansas; you might consider multi-state registry. The only thing you would accomplish in sending in the wrong certificate is wasting postage. Good luck to you.
PS when you say you are marrying a lesbian couple, MOST of us understood that you were performing the ceremony, not taking part in the actual union as a participant. :) Some peeps are just SLOW.

Answer: Well, if you're already married, you can't file a K-1, that's for fiances, not spouses. You would have to file an I-130 IR-1 immigrant visa petition, assuming you're an American. However, you'd have to file that in the US through USCIS, unless you're currently a resident overseas, in her country. You can file a K-3 I-129f petition as well, but you'd still have to file the IR-1 petition, since the K-3 is bases on the IR-1 filing. The K-3 is supposed to be faster to process, but these days, there really isn't that much difference in time.
As for the work visa, she could only use it if she's still employed with the company that filed the original work petition. If she's not still employed with that company, it's no longer valid.

Edit: well, if she's still employed and intends to continue working for the same employer after she arrives, there's no reason she can't use the employment visa to return. then, you'd be able to file everything in the US, and, of course, live together while USCIS is processing the paperwork.

When you apply for a marriage certificate, you have to sign a legally binding statement that states that you are not currently married and that you are free to marry this person. If you sign that while you are still married to another person, you are committing fraud. If you go ahead and marry someone without divorce from the other, then you are not only committing bigamy in the states eyes, you are also committing bigamy in the eyes of the Lord. The second marriage is not legally binding in any way because it was done fraudulently.
While it is true that most states do not have the monetary resources to research the marriage files for everyone who applies for a marriage certificate prior to granting the certificate, it is true that you will be committing a crime and if you are EVER found out, you will be severely prosecuted.
Your lawyer can be fined or even suspended for giving you this very wrong and illegal advice.

Answer: You cannot get the date of birth changed in educational certificates/degrees & personal certificate such as Marriage certificate, however you can get the necessary change of date of birth made in the Birth & death Record of the district where the birth was recorded & registered under THE REGISTRATION OF BIRTHS AND DEATHS ACT, 1969. This Act provides for the Correction or cancellation of entry in the register of births and deaths, section 15 of the Act provides :- If it is proved to the satisfaction of the Registrar that any entry of a birth or death in any register kept by him under this Act is erroneous in form or substance, or has been fraudulently or improperly made, he may, subject to such rules as may be made by the State Government with respect to the conditions on which and the circumstances in which such entries may be corrected or cancelled, correct the error or cancel the entry by suitable entry in the margin, without any alteration of the original entry, and shall sign the marginal entry and add thereto the date of the correction or cancellation.
Therefore contact the Municipality wherein the record of birth exist & get the necessary made under this provision. The new Birth certificate with changes in date of birth can be obtained & used for future purposes of immigration etc. Edit:- Based on new facts by you, it seems your case is one of typical typographic mistake where the Clerk of the Registrar of Marriages office wrongly mentioned the date of birth & neither you nor the Registrar of Marriages detected this mistake before signing & stamping it. Since this is typographic mistake it wont be a big issue as your date of birth as mentioned in your original birth certificate or any of your educational certificates/SSC/School leaving certificate will be considered as correct not one in your Marriage Certificate, secondly you should personally meet the Registrar of Marriages who has issued this certificate, tell him about this typographic mistake & get it amended which he will do as his record regarding your date of birth will be stating the correct date & this mistake was made by his official clerk for which the Registrar of Marriages is responsible & he has to do this amendment done without any other legal formalities of court order etc as one of my learned lawyer friend suggest here.

I applied at the beginning on March 2009 -and the said it would be 6 to 8 weeks. Still, I am waiting! Answer: Number of times I have answered such questions regarding inter-religious marriages apart from getting them solemnized before the marriage officer. You both belonging to different religion can marry in the court without changing your individual religion. Registered/Court marriage as you call it is solemnized under the Special Marriage Act, 1954 all such marriages can take place between any two Indian citizens as well one Indian citizen with a foreigner irrespective of their religion, caste or creed, and you can say this is the secular form of marriage available in our country. Such a marriage is solemnized before the marriage officer/registrar usually D.C. deputy commissioner of the area /SDM where both or any of the parties to such a marriage reside permanently or for at least one month. Cost of such a marriage as the rate prevalent in your area. Now how you proceed? Both the parties to the marriage file a joint application/notice before the marriage officer along with individual affidavit attested by notary public specifying the age(boy 21yrs &girl 18yrs), place of residence, marital status(unmarried or divorcee as the case maybe), mental status(not idiot or not with unfit mind), not related to each other. Along with this you have to give proof of age (School certificate, Passport, Pan card), proof of residence (Passport, ration card, voters ID card, rent agreement), & the application/notice of such a marriage maybe asked to be witnessed by 3 independent adult persons, affix one photograph of each of the parties & all the 3 witnesses. You have made such an application/notice to the marriage officer in person along with all the 3 witnesses. On receiving such an application/notice the marriage officer issues a month notice regarding the intended marriage & get such a notice affixed on the notice board out side his office, a copy of such notice is sent to the marriage officer under whose jurisdiction the other party lives, also a copy is to the individual parties address. After expiry of the period of notice a date is fixed on which all the persons parties to the marriage & 3 witnesses appear again before the marriage officer who declare them married & issue a certificate to this regard. Incase of any objections raised the marriage officer will settle these objections. Now what can be objections that can be raised? These can ONLY BE REGARDING THE CONDITIONS NECESSARY FOR SUCH MARIAGE & NOTHING ELSE. What are the conditions? As I stated above i.e. Age, martial status, mental status, prohibited relationship (related to each other by blood). This is the brief & general procedures I have told you here. It’s always better to engage a lawyer to get such marriage solemnized to avoid any legal impediments which he will be able to handle.
