Answer: In California, you go see a mediator to have a custody agreement drawn and filed with the court. (Make sure you get everything in writing! You never know when her life-situation will change or she'll change her mind.)

Answer: What state are you in? An arrangement like this usually includes the "cans and cant's" for this situation. His father should be financially responsible for getting him back and forth. Is the child in school? If so, going back and forth half of the week is not possible. I would think that no judge would allow this even if the child is not in school because of stability issues. Question: Joint custody???? I have two questions here. First, my ex is 8 weeks pregnant and already going on about child support and me not having custody. So my questions is how is joint custody awarded to the father? Does the mother have to agree on it? Answer: I would wait to contact a lawyer because she is not passed the window of where miscarriage is still possible, which is typically 20 weeks. I would probably wait till after the 20 week mark, or you can contact them to let them know and then they can direct you what to do from there. I have sole custody of my children, but my husband is telling me that he needs joint custody for the children to receive medical benefits. Answer: ALLOW HIM? You don't think much of your kids to deny them the benefit of their father to the maximum extend. Yes, I know you will now come up with some inflate claims about him, but on the surface, you're the more harmful parent right now. Answer: Medical is through Tricare as a Retiree he pays a yearly amount for it. They may be able to add the children to that but not necessarily. They can use base facilities but it is restricted as they are Retirees not AD, so things like Day Care are not an option.

Answer: Unless he's in jail, joint custody is what it means. Even rights to the child. With a violent past,perhaps SUPERVISED visitation could be persued. Answer: Child support is not based on custody nor sex of the parent. IT is based on the amount of time spent with the child and who there residental parent is. Joint physical custody simply means that you both have the same rights. Joint RESIDENTIAL custody means you share the exact amount of time with the child in residence. However, even if the child stays with you 50% of the time, whomever is designated as the custodial parent will be due a certain amount of support, albeit not at the statutory 20%. It will be determined based on the above and the income of the two of you.

Answer: In these cases, it is possible for a court to order joint custody in so far as you both have joint decision making for the child. However, it is unlikely, given a residence in two separate states, that a judge will order joint PHYSICAL custody. This would be very complicated, given the distance and making travel arrangements constantly. I would see if you can find an attorney to represent you, pro bono, meaning without paying him a fee. Or see if you have any legal aid resources in your community. You will need to be able to prove to the court that you are primary care giver, and have always been. And that you are well equipped to care for your child on your own. That way, you will more likely to meet the court's criteria and get full physical custody, with, maybe joint decision making. Question: What is the best arrangement for joint custody? I work 5 days a week 8-4:30 every day and have weekends off. What would be the best arrangement to see my child with joint custody that is realistic and doable. She is willing to let me have my son 3 weekends a month (Fri evening, Sat, Sun day, every Thursday evening, and the fourth week I will see him only on Thurs. I also get him on holidays too. Answer: Keep him on the weekends. I don't know about you, but I remember weekends far better than I ever did weekdays, and you want your son to remember you better out of the two of you, so weekends + holidays = much better. Weekdays get cluttered up with school and one day blends into another. You may lose out on getting to do much of your own stuff, esp. if that occurs on weekends, but there are plenty of things you can do together to let off some steam.

Answer: Since you're only 15, you personally can't do anything about the visitation. Talk to your mom about this. She will have to get an attorney and go to court to have the original order changed. I don't think he has to be there, but I'm not an attorney. Since he hasn't seen you since you were small, he's not really exercising his rights and taking them away will do nothing. Answer: It slightly depends on what your divorce case is about. For example if it's because of domestic violence from your side, then she will have the upper hand. But if it's just a normal divorce then you should have a well enough chance to get joint custody as the courts nowadays prefer both parents to be in the childs life when possible. If she fights for full custody then by all means fight for your son because if you do you'll at LEAST get visitation rights ordered by the court (also CAFCASS) but if you don't fight and think it's a losing battle then it's in her right to decide when, where and if you get to see your son. And though you have your parental rights still (I presume you do) she can still move far away (in the country you live in) and it will be up to the courts to say if she or you has to make the effort to drive that distance in order for you to keep contact with your son. But she will not be allowed to take him abroad without your say so (you can take that to court)

Answer: Talk to a lawyer. Start documenting all the times you see her and make sure you pay child support on time. Do everything you can to prove that you are already being a fit parent. A lawyer will be able to help you more with actually going through the legal stuff.

Answer: I really don't know that a court will approve joint custody between you and your brother unless the court prove you to but unfit as parents and you don't want that. Not to mention the fact that you would be required to pay him child support. If you and you husband want your son to live with your brother, you can give permission. I would check into that first. The school may be fine with it.
