Question: judge vacates default judgement and writes a scheduling order? I had a default judgement on me for a debt. it was beacuse of the clerks error(placed my answer in a different file) anyways the judge vacates it. and set a scheduling order, do i get a scheduling order or does a plaintiff, and who sets the dates? or is a scheduling order for the plaintiff to comply with my discovery?

Answer: Both parties will get a copy of the scheduling order. It sets the dates that discovery is to be finished by, and the deadline for filing any dispositive motions (such as summary judgment).

Question: I am representing myself pro se. I have been requested to prepare an agreed scheduling order? The court has stated that my case will be dismissed if I do not have a scheduling order set. How do I prepare an agreed scheduling order or file a motion requesting such action by the court? Please help! I am running out of time. Answer: The courts hate pro per/pro se litigants. Most likely they are trying to get you to hire a double-agent liar, commonly refered to as a lawyer or atorney. There are many resources on the internet, I like "outlaws legal service"(outlaw meaning someone denied equal protection under the law, not criminal). Try searching around for examples/forms of this order on yahoo,google, etc. I've represented myself several times at ohio courts and never had to file such an order, it was done by the court/judge. Sounds to me like you simply need to file a schedule of the times/dates for the upcoming procedures of your case that the other party agrees to, most likely ones not attended at court and/or before a judge. In civil matters you are commonly expected to have communications with the opposing party outside of court. Sorry I couldn't be of more help. BEST WISHES IN YOUR ENDEAVOR!!!

Answer: A motions hearing has nothing to do with a scheduling order. Why don't you submit a motion to enter a scheduling order to the court? Why are you letting it drag on? The fault is yours, not the court's.

Answer: Scheduling conference -- a meeting involving attorneys from both sides and the Judge. They sit and discuss what still needs to be accomplished before the matter can be brought to court for disposition, i.e. depositions that need to be taken, expert reports, rulings on outstanding motions. The list can go on and on. Order of the Court -- a mandate handed down by a Judge compelling someone to comply to a specified instruction as "ordered by the court."

Answer: Basically, three-fourths of the students (and teachers) will be at school at any given time while the other one-fourth will be on vacation. The students will be in school for 45 days, then have 15 days of vacation. So, for example: Day 1-15: Class A is in Room 1; Class B is in Room 2; Class C is in Room 3; Class D is on vacation. Day 16-30: Class B is in Room 1; Class C is in Room 2; Class D is in Room 3; Class A is on vacation. Day 31-45: Class C is in Room 1; Class D is in Room 2; Class A is in Room 3; Class B is on vacation. Day 46-60: Class D is in Room 1; Class A is in Room 2; Class B is in Room 3; Class C is on vacation. This way, four classes can fit in the space that would normally be occupied by only three classes.

Question: Could a florist use scheduling software? My friends and I are developing some scheduling software. Basically, a customer could go online and schedule a flower order and delivery. Would this work for a floriest? Why or why not?

Answer: Probably not. I've been a floral designer for a little over 20 years and I don't think I could use this. Things change so quickly in the course of an hour even at a florist, you cannot keep things hard and fast and have to have a good level of flexibility. You might have a handful of orders in the AM and then have family come in to order family funeral work. The funeral work has to come first and the home deliveries then get taken care of afterwards. That is why it is sometimes very difficult to give customers a specific time frame for delivery because there are just too many variables. We can usually promise BY a certain time especially if it is afternoon and someone will only be at work until 3 or something along those lines. But we really cannot be held to a set schedule because of orders that continue to come in, the variability in how long certain things take to make (say comparing a quick vase, compared to a casket spray), when shipments of flowers come in, etc..... So that is the long answer, short answer is probably not. It's also a LOT more helpful for us if customers call us instead of ordering online. When they order online, they cannot find out directly from us what flowers we have in the store at that very minute. They might be looking at pictures that have a HUGE assortment of flowers in them and unless we have a couple of days notice (sometimes more) we simply don't have every flower in every shade in stock at all times. When we talk to a customer on the phone, we can go over what is in stock in our store, what is in season, out of season, what looks nicest, etc..... so for me personally, even though I'm a big internet user, I much prefer for customers to call us directly.

Answer: Yes I do that on a regular basis. Its the first thing I do even before work is check my calender for the day to see who I am meeting with.

Answer: In each match there will be one loser. You need 255 losers to get to 1 winner, so you need 255 matches. You don't even need to think about how you pair people up. However, if you did it the long way you'd get to the same answer. Let's say you scheduled 128 matches in round 1. That would eliminate 128 players. Then you could have 64 matches in round 2, leaving 64 players, etc. 128 + 64 + 32 + 16 + 8 + 4 + 2 + 1 = 255 Hmm... same answer!

Answer: You need to establish a routine by going to bed earlier and setting an alarm to get up in the morning,Try going to bed at 12:30 and try getting up by10:30,Each day alter it by 1/2 hour.By then you'll probably be on track for school.

Answer: There's no guarantee that you'll have delivered by your due date, you might end up missing this wedding if you go over. See what you can do about having the dress taken in, there are plenty of places that can do alterations, even in an emergency, then order something that you feel will fit directly after giving birth and have it altered a couple of days before if you need to. Better to have a dress that's too big that can be taken in than have a dress that's too small on the day and there's nothing you can do about it. I had my wedding dress altered a week before my wedding to allow for the last minute stress related weight loss and they had it don for me overnight

Question: when is the order of the 2008 schedules determined? i know they've already determined which teams play each other, but when do they tell us what order teams schedules will be, like who they play in week 1, week 2, week 3, etc.

Answer: Late March or early April, after the owners' meeting. I think the schedule came out April 10 last season. Cheers!

For example think of the use of token economies (currency for one :)). Tokens are given out to reinforce a certain behaviour according to a specific schedule (the token-reinforcement schedule). Answer: Yes, if you mean working out with weights, you do need to have a plan and a routine. Check out websites about strength training and you will get lots of information.

Answer: The NFL schedule is based on how teams finished the previous season. Some teams finish poorly and will have a tough schedule. Others will finishe poorly and have an easy schedule. It's the luck of the draw. However, games are NOT going to change unless there is an act of God, which is how the Ravens game was rescheduled last year. Just imagine if more than a handful of teams were seriously affected by that cancellation...

Answer: 52 weeks a year. 52-28= 24 weeks remaining 24/2= 12 regular average 12 + 6 = 18 above average to make up time lost 18/24 = 3/4 sales per week (or 3 sales per 4 weeks)

Question: How to get my sleeping schedule back in order before school starts up again? I am currently on summer break. And even though i try so hard to keep my sleeping schedule some what normal it always ends up horrible. Like staying up til 3 and 4 and sleeping all day long! Answer: I can relate: been there, done that. In your question you didn't say if this was because of a new job etc, so I will assume it is just nerves and the like. The best way is to get your circadian rhythm back in order. The way to do that is to do *whatever* it takes to stay awake at least until the sun comes up. Get as much sunlight as possible (bright artificial light at the very least) When you cannot stay awake a moment longer - go ahead - sleep. BUT sleep with the curtains open and the lights on. When you awake, if it is still daylight, go outside (or sit by an open window) and allow yourself to experience the light dimming naturally. After about an hour of darkness, try to sleep again. If you can - fantastic, but if not, stay in darkness. Do not turn on lights if at all possible. After a few days of this, your body will reset itself and all should be back to normal. As for your girlfriend. Promise her that you are trying, and then really try. Give yourself (and her) a time-table after which if all is not better you will seek the help of a medical doctor. Question: What is a protection order hearing? I just found out that there is a protective order hearing scheduled for me for April 21st and the plaintiff is "State of Nevada" and the attorney is "District Attorney". Aren't these for like stalking charges? I haven't done anything like that.

Answer: Sounds like somebody you know doesn't want you around anymore. It's possible that someone you know is about to sue you. Protection orders are common in these cases. Get in any fights lately? Get kicked out of the neighborhood tavern one too many times?
